47Power under section 46: time limit(1)

The power under section 46 may not be exercised after the end of two years beginning with—

(a)

in the case of a conviction, the date on which the conviction became conclusive, or

(b)

in the case of an inclusion on a barred list, the date on which the cleric was included on the list.

(2)

But the President of Tribunals may on application extend that period if, after giving the cleric in question an opportunity to make representations and taking any representations into account, the President is satisfied that the applicant for the extension did not know of the conviction or inclusion.

(3)

An application under subsection (2) may be made—

(a)

in a case involving a priest or deacon, by the bishop of the relevant diocese (which has the meaning given in section 46);

(b)

in a case involving a bishop, by the archbishop of the province concerned;

(c)

in a case involving an archbishop, by the other archbishop.
