uk:target="true"><num>46</num><heading>Conviction for offence etc: power to impose penalty etc</heading><subsection eId="section-46-1"><num>(1)</num><content><p>Where a priest, deacon, bishop or archbishop (a “cleric”) is convicted of an offence (whether in England or elsewhere) or included on a barred list, a penalty or administrative sanction may be imposed on the cleric without the need for a complaint to be made.</p></content></subsection><subsection eId="section-46-2"><num>(2)</num><intro><p>The power under <ref href="#section-46">this section</ref> is exercisable—</p></intro><level class="para1" eId="section-46-2-a"><num>(a)</num><content><p>in the case of a priest or deacon, by the bishop of the relevant diocese;</p></content></level><level class="para1" eId="section-46-2-b"><num>(b)</num><content><p>in the case of a bishop, by the archbishop of the province which includes the relevant diocese after consulting the two most senior bishops of that province;</p></content></level><level class="para1" eId="section-46-2-c"><num>(c)</num><content><p>in the case of an archbishop, by the President of Tribunals after consulting the other archbishop.</p></content></level></subsection><subsection eId="section-46-3"><num>(3)</num><intro><p>Before exercising the power under <ref href="#section-46">this section</ref>, the bishop or archbishop or the President of Tribunals must, by following the procedure set out in the rules—</p></intro><level class="para1" eId="section-46-3-a"><num>(a)</num><content><p>obtain a report from the Investigation and Tribunals Team,</p></content></level><level class="para1" eId="section-46-3-b"><num>(b)</num><content><p>give the cleric an opportunity to make written representations, and</p></content></level><level class="para1" eId="section-46-3-c"><num>(c)</num><intro><p>in a case where the conduct constituting the offence involves a child or vulnerable adult or in a case of inclusion on a barred list, consult—</p></intro><level class="para2" eId="section-46-3-c-i"><num>(i)</num><content><p>the diocesan safeguarding officer who would have a proper interest in a complaint against the cleric, or</p></content></level><level class="para2" eId="section-46-3-c-ii"><num>(ii)</num><content><p>the national director of safeguarding.</p></content></level></level></subsection><subsection eId="section-46-4"><num>(4)</num><intro><p>The bishop or archbishop, when proposing to exercise the power under <ref href="#section-46">this section</ref>, must require the relevant registrar to give (if practicable) at least 14 days’ written notice to the cleric of the time and place at which the power will be exercised, and the cleric is entitled to be present when it is; and “<term refersTo="#term-the-relevant-registrar" eId="term-the-relevant-registrar">the relevant registrar</term>” means—</p></intro><level class="para1" eId="section-46-4-a"><num>(a)</num><content><p>where the bishop proposes to exercise the power, the registrar of the bishop’s diocese;</p></content></level><level class="para1" eId="section-46-4-b"><num>(b)</num><content><p>where the archbishop proposes to exercise the power, the registrar of the archbishop’s province.</p></content></level></subsection><subsection eId="section-46-5"><num>(5)</num><content><p>The rules may make provision for a case where the power under <ref href="#section-46">this section</ref> is exercisable by the President of Tribunals.</p></content></subsection><subsection eId="section-46-6"><num>(6)</num><content><p>When exercising the power under <ref href="#section-46">this section</ref>, a person must have due regard to the Code of Practice and to any advice given under <ref href="#">section 9</ref><ref href="#">(1)</ref><ref href="#">(a)</ref> (penalties etc).</p></content></subsection><subsection eId="section-46-7"><num>(7)</num><content><p>The relevant registrar must attend on the bishop or archbishop for the exercise of the power; and the decision on the penalty or administrative sanction to impose must be recorded in writing, with a copy being sent to each of the persons specified in the rules.</p></content></subsection><subsection eId="section-46-8"><num>(8)</num><content><p>Where a penalty is imposed in exercise of the power under <ref href="#section-46">this section</ref>, the penalty has effect as if it had been imposed by a tribunal or court on a complaint; and <span><ref href="#">sections 38</ref> to <ref href="#">45</ref></span> apply accordingly but with the requirement for a recommendation in <ref href="#">sections 41</ref> and <ref href="#">42</ref> being ignored.</p></content></subsection><subsection eId="section-46-9"><num>(9)</num><content><p>The rules may provide that <ref href="#section-46">this section</ref> does not apply to a specified offence or an offence of a specified description.</p></content></subsection><subsection eId="section-46-10"><num>(10)</num><intro><p>The reference in <ref href="#section-46-1">subsection (1)</ref> to a conviction or an inclusion on a barred list includes a reference to a conviction or an inclusion on a barred list—</p></intro><level class="para1" eId="section-46-10-a"><num>(a)</num><content><p>which occurred before the cleric in question was in Holy Orders;</p></content></level><level class="para1" eId="section-46-10-b"><num>(b)</num><content><p>which occurred before the commencement of <ref href="#section-46">this section</ref>.</p></content></level></subsection><subsection eId="section-46-11"><num>(11)</num><intro><p>The “relevant diocese”, in a case involving a priest, deacon or bishop, is—</p></intro><level class="para1" eId="section-46-11-a"><num>(a)</num><content><p>the diocese in which the cleric held a form of authority to exercise ministry on the date on which the conviction became conclusive or the cleric was included in the barred list, or</p></content></level><level class="para1" eId="section-46-11-b"><num>(b)</num><content><p>if, on that date, the cleric did not hold a form of authority to exercise ministry but resided in a diocese, the diocese in which the cleric resided at that date, or</p></content></level><level class="para1" eId="section-46-11-c"><num>(c)</num><intro><p>if, on that date, the cleric did not hold a form of authority to exercise ministry or reside in a diocese—</p></intro><level class="para2" eId="section-46-11-c-i"><num>(i)</num><content><p>the diocese in which the cleric last held before that date a form of authority to exercise ministry, or</p></content></level><level class="para2" eId="section-46-11-c-ii"><num>(ii)</num><content><p>if, in a case involving a priest or deacon, the cleric has held no form of authority to exercise ministry in any diocese, the diocese in which the cleric was
