<Text>A bishop’s disciplinary tribunal or the Vicar-General’s court, when exercising a power under <InternalLink Ref="section-38" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/38" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/38">section 38</InternalLink>, may impose—</Text>

<Text>In a case where either or each of the administrative sanctions under <InternalLink Ref="section-37" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/37" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/37">section 37</InternalLink><InternalLink Ref="section-37-2" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/37/2" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/37/2">(2)</InternalLink> is imposed, a penalty may not also be imposed.</Text>

<P2 DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/39/4" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/39/4" id="section-39-4">
<Pnumber>4</Pnumber>
<P2para>
<Text>Where the tribunal or court is considering the length of the period to specify in a limited prohibition under <InternalLink Ref="section-37" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/37" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/37">section 37</InternalLink><InternalLink Ref="section-37-1" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/37/1" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/37/1">(1)</InternalLink><InternalLink Ref="section-37-1-g" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/37/1/g" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/37/1/g">(g)</InternalLink>, it may take into account the amount of time for which the respondent has been suspended under <InternalLink Ref="section-34" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/34" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/34">section 34</InternalLink> pending determination of the complaint, except in so far as doing so would extinguish the period to be specified in the limited prohibition.</Text>

<Pnumber>5</Pnumber>

<Text>Before imposing a penalty, the tribunal or court may invite the responsible bishop to give a written opinion on what an appropriate penalty would be; but the invitation may not be made if the responsible bishop gave evidence in the proceedings on the complaint.</Text>

<Pnumber>6</Pnumber>

<Text>The tribunal or court, having received a written opinion under <InternalLink Ref="section-39-5" IdURI="http://www.legislation.gov.uk/id/ukcm/2026/1/section/39/5" DocumentURI="http://www.legislation.gov.uk/ukcm/2026/1/section/39/5">subsection (5)</InternalLink>—</Text>
