complaint</heading><section eId="section-16" uk:target="true"><num>16</num><heading>Complaint: procedure</heading><subsection eId="section-16-1"><num>(1)</num><intro><p>A complaint must be made—</p></intro><level class="para1" eId="section-16-1-a"><num>(a)</num><content><p>in the form specified in the rules, and</p></content></level><level class="para1" eId="section-16-1-b"><num>(b)</num><content><p>by following the procedure set out in the rules.</p></content></level></subsection><subsection eId="section-16-2"><num>(2)</num><intro><p>A complaint against a priest or deacon must—</p></intro><level class="para1" eId="section-16-2-a"><num>(a)</num><content><p>if the complaint alleges that the priest or deacon officiated as a minister without authority, be made to the bishop of the diocese in which the priest or deacon is alleged to have done so, or</p></content></level><level class="para1" eId="section-16-2-b"><num>(b)</num><intro><p>in any other case, be made to the bishop of the diocese in which, at the time that the conduct alleged in the complaint occurred, the priest or deacon—</p></intro><level class="para2" eId="section-16-2-b-i"><num>(i)</num><content><p>held a form of authority to exercise ministry, or</p></content></level><level class="para2" eId="section-16-2-b-ii"><num>(ii)</num><content><p>if not at that time holding a form of authority to exercise ministry, was resident.</p></content></level></level></subsection><subsection eId="section-16-3"><num>(3)</num><intro><p>A complaint against a bishop (other than an archbishop) must—</p></intro><level class="para1" eId="section-16-3-a"><num>(a)</num><content><p>if the complaint alleges that the bishop officiated as a minister without authority, be made to the archbishop of the province in which the bishop is alleged to have done so, or</p></content></level><level class="para1" eId="section-16-3-b"><num>(b)</num><intro><p>in any other case, be made to the archbishop of the province in which, at the time that the conduct alleged in the complaint occurred, the bishop—</p></intro><level class="para2" eId="section-16-3-b-i"><num>(i)</num><content><p>held a form of authority to exercise ministry, or</p></content></level><level class="para2" eId="section-16-3-b-ii"><num>(ii)</num><content><p>if not at that time holding a form of authority to exercise ministry, was resident.</p></content></level></level></subsection><subsection eId="section-16-4"><num>(4)</num><content><p>A complaint against an archbishop must be made to the President of Tribunals; and the President, having received the complaint, must notify the other archbishop.</p></content></subsection><subsection eId="section-16-5"><num>(5)</num><content><p>A complaint against a chaplain of one of the armed forces of the Crown must be made to the Archbishop of Canterbury.</p></content></subsection><subsection eId="section-16-6"><num>(6)</num><content><p>A complaint against a minister who has a licence to preach from an archbishop must be made to the archbishop to whom the complaint would be made under <ref href="#section-16-3">subsection (3)</ref> if the references in <ref href="#section-16-3-a">paragraphs (a)</ref> and <ref href="#section-16-3-b">(b)</ref> of <ref href="#section-16-3">that subsection</ref> to the bishop were references to the licensed minister.</p></content></subsection><subsection eId="section-16-7"><num>(7)</num><content><p>A complaint against a minister who has a licence to preach from the University of Oxford or the University of Cambridge must be made to the Archbishop of Canterbury.</p></content></subsection><subsection eId="section-16-8"><num>(8)</num><content><p>A complaint against a clerk in Holy Orders who holds office in a Royal Peculiar may be made in so far as the rules may provide; and for that purpose, the rules may apply provisions of this Measure with modifications.</p></content></subsection><subsection eId="section-16-9"><num>(9)</num><content><p><span><ref href="#section-16-2">Subsections (2)</ref> to <ref href="#section-16-4">(4)</ref></span> apply subject to <span><ref href="#section-16-5">subsections (5)</ref> to <ref href="#section-16-8">(8)</ref></span>.</p></content></subsection><subsection eId="section-16-10"><num>(10)</num><content><p>A complaint may not be made about the exercise of a function conferred by or under this Measure unless the permission of the President of Tribunals has been obtained.</p></content></subsection><subsection eId="section-16-11"><num>(11)</num><content><p>In the case of a minister licensed to serve in a diocese by the bishop, the licence may not be terminated because of misconduct otherwise than as a result of a complaint being made.</p></content></subsection><subsection eId="section-16-12"><num>(12)</num><content><p>The bishop or archbishop to whom a complaint is required to be made is referred to in this Measure as “the responsible
