<Pnumber>2</Pnumber>
<P2para>
<Text>A person is the “surviving partner” of a deceased person if that person is the deceased’s surviving spouse, surviving civil partner or other surviving partner.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukcm/2025/4/section/31/3" IdURI="http://www.legislation.gov.uk/id/ukcm/2025/4/section/31/3" id="section-31-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>A person is the “other surviving partner” of a deceased person if, immediately before the death, they were not married to, or civil partners of, each other but—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukcm/2025/4/section/31/3/a" IdURI="http://www.legislation.gov.uk/id/ukcm/2025/4/section/31/3/a" id="section-31-3-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>were living together as if they were, or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukcm/2025/4/section/31/3/b" IdURI="http://www.legislation.gov.uk/id/ukcm/2025/4/section/31/3/b" id="section-31-3-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>were in a relationship having other characteristics of a marriage or civil partnership.</Text>

</P3>

</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>“<Term id="term-child">Child</Term>”, in relation to a person, includes a step-child of that person and a child of that person’s civil partner or other partner; and for that purpose—</Text>

<Pnumber>a</Pnumber>

<Text>a reference to a child is not limited to a person aged under 18, and</Text>

<Pnumber>b</Pnumber>

<Text>a reference to a person’s other partner is to be construed in accordance with <InternalLink Ref="section-31-3" IdURI="http://www.legislation.gov.uk/id/ukcm/2025/4/section/31/3" DocumentURI="http://www.legislation.gov.uk/ukcm/2025/4/section/31/3">subsection (3)</InternalLink>.</Text>

<Pnumber>5</Pnumber>
<P2para>
<Text>A person is a “dependant child” of a deceased person if—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukcm/2025/4/section/31/5/a" IdURI="http://www.legislation.gov.uk/id/ukcm/2025/4/section/31/5/a" id="section-31-5-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>the person is a child of the deceased for whom, immediately before the death, the deceased had a financial or caring responsibility, or</Text>
</P3para>
</P3>

<Text>the deceased had, immediately before the death, parental responsibility for the person.</Text>

<Text>“<Term id="term-parental-responsibility">Parental responsibility</Term>” has the meaning given in the <Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/contents" id="c00026" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="contents">Children Act 1989</Citation>.</Text>
