Status

The term provision is used to describe a definable element in a piece of legislation that has legislative effect – such as a Part, Chapter or section. A version of a provision is prospective either:

  1. where the provision (Part, Chapter or section) has never come into force or;
  2. where the text of the provision is subject to change, but no date has yet been appointed by the appropriate person or body for those changes to come into force.

1Attachment of Channel Islands to diocese of SalisburyE

(1)Her Majesty may by Order in Council provide for—

(a)the attachment of the Bailiwicks to the diocese of Salisbury instead of to the diocese of Winchester, and

(b)the transfer to the Bishop of Salisbury of such jurisdiction as the Bishop of Winchester has in relation to the Bailiwicks.

(2)In this Measure, “the Bailiwicks” means both—

(a)the Bailiwick of Jersey, and

(b)the Bailiwick of Guernsey.

(3)The reference to the Bailiwick of Jersey is a reference to the Island of Jersey, its dependencies and the adjacent territorial waters.

(4)The reference to the Bailiwick of Guernsey is a reference to the Islands of Guernsey, Alderney and Sark, the dependencies of each of them and the adjacent territorial waters.

(5)A reference in this Measure to both the Bailiwicks, or to each, either or one of them, is to be read in accordance with subsection (2).

(6)The power under this section may be exercised either—

(a)by way of a single Order which applies to both the Bailiwicks, or

(b)by way of two Orders each of which applies to only one of the Bailiwicks.

(7)An Order under this section may make consequential, supplementary, transitional or transitory provision; and the power conferred by this subsection is not restricted by section 2.

(8)An Order under this section which applies to both the Bailiwicks may make different provision in relation to each of them.

Prospective

2Section 1: consequential amendmentsE

(1)In each of the following provisions, for “Winchester” substitute “ Salisbury ”

(a)in section 1 of the Channel Islands (Church Legislation) Measure 1931, the definition of “the Bishop”;

(b)in section 1 of the Channel Islands (Representation) Measure 1931, the definition of “the Bishop” and the definition of “the Diocesan Synod”;

(c)section 84 of the Ecclesiastical Jurisdiction Measure 1963 (exclusion of Islands from diocese);

(d)Rule 31(3)(c) of the Church Representation Rules (diocesan synod: membership of house of clergy).

(2)The references in each of the Channel Islands (Church Legislation) Measure 1931 and the Channel Islands (Representation) Measure 1931 to the Islands, or to either or each of them, are to be read as references to the Bailiwicks or to either or each of them.

3Application of Measures to Channel IslandsE

A Measure which provides that it may be applied to the Islands or either of them in accordance with the Channel Islands (Church Legislation) Measures 1931 and 1957 may instead be applied to the Bailiwicks or either of them (with or without modifications) under any other procedure for doing so which has effect in the Bailiwicks or (as the case may be) in the Bailiwick in question (whether that procedure took effect before or after the passing of this Measure).

4Church representation for Channel IslandsE

(1)In section 4 of the Channel Islands (Representation) Measure 1931 (qualification of electors), for paragraph (b) substitute—

(b)is either—

(i)a member of the Church of England or of a Church in communion with it, or

(ii)a member of the Church of England and a member in good standing of a Church which is not in communion with it but subscribes to the doctrine of the Holy Trinity;.

(2)In that section of that Measure, in paragraph (c), for “of seventeen years or upwards” substitute “ aged 16 or over ”.

(3)In the Schedule to that Measure (application for enrolment on church electoral roll), for paragraphs (i) to (vi) of the declaration substitute—

”.

Commencement Information

I1S. 4 in force at the date on which the commencing Order is registered by the Royal Court of Guernsey by virtue of S.I. 2022/1180, art. 4

5Commencement and short titleE

(1)Sections 1 and 3 and this section come into force on the day on which this Measure is passed.

(2)Section 2 comes into force on the commencement of the Order or Orders made under section 1.

(3)Section 4 comes into force—

(a)on such day as may be specified in the Order or Orders made under section 1, or

(b)on such day as Her Majesty in Council may specify in an Order under this subsection.

(4)This Measure may be cited as the Channel Islands Measure 2020.
