Clergy Discipline Measure 2003 (Appointed Day Instrument 2005)
Whereas the Clergy Discipline Measure received the royal Assent on the tenth day of July 2003
And Whereas by section 48(2) of the said Measure it is provided that the said Measure shall come into force on such date as the Archbishops of Canterbury and York may jointly appoint and that different dates may be appointed for different provisions
And Whereas by an Instrument dated the thirtieth day of September 2003 under the hand of the Most Reverend Rowan Douglas Archbishop of Canterbury and that of the Most Reverend David Michael formerly Archbishop of York the said archbishops did jointly appoint that certain provisions of the said Measure should come into force on the first day of October 2003
And Whereas the See of York became vacant on the twenty–eighth day of February 2005 by reason of the resignation of the said the Most Reverend David Michael former archbishop of York
And Whereas by an Instrument dated the twenty sixth day of May 2005 under the hand of the said the Most Reverend Rowan Douglas Archbishop of Canterbury the said archbishop appointed that certain further provisions of the said Measure should come into force on the first day of June 2005
And Whereas by an Instrument dated the seventh day of September 2005 under the hand of the said Most Reverend Rowan Douglas Archbishop of Canterbury the said archbishop appointed that certain further provisions of the said Measure should come into force on the eighth day of September 2005
And Whereas the election of the Most Reverend John Tucker Mugabi Sentamu to the See of York was confirmed on the fifth day of October 2005
And Whereas no other provisions of the said Measure have yet been brought into force
Now therefore WE ROWAN DOUGLAS by Divine Providence Archbishop of Canterbury and JOHN TUCKER MUGABI SENTAMU by Divine Providence Archbishop of York do hereby jointly appoint that the remaining provisions of the said Measure that is to say;
Sections 1 and 2
Sections 6 to 20
Sections 22 to 38
Sections 40 to 43
Subsections (1), (2) and (5) of section 44
Sections 46 and 47
Schedules 1 and 2
shall come into force on the first day of January 2006.
