<Text>This Order may be cited as the Civic Government (Scotland) Act 1982 (Licensing of Non-surgical Procedures) Order 2026 and comes into force on the day after the day on which this Order is made.</Text>

<Title>Interpretation</Title>

<Text>In this Order—</Text>

<Text>“<Term id="term-the-1978-act">the 1978 Act</Term>” means the National Health Service (Scotland) Act 1978<FootnoteRef Ref="f00002"/>,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-the-1982-act">the 1982 Act</Term>” means the Civic Government (Scotland) Act 1982,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-his">HIS</Term>” means Healthcare Improvement Scotland,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-licensing-authority">licensing authority</Term>” has the meaning given in section 2(2) of the 1982 Act.</Text>

<Title>Definition of non-surgical procedure</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>In this Order, a “non-surgical procedure”—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>means a procedure that is carried out on a natural person which—</Text>

<Pnumber>i</Pnumber>
<P4para>
<Text>pierces or penetrates the person’s skin, including by means of a needle, chemical, medicine, heat, cold, light, laser, sound or electricity, and</Text>
</P4para>
</P4>

<Text>is of a kind specified in schedule 1, but</Text>

<Text>that is carried out on an intimate area, unless it is non-ablative laser treatment for hair removal,</Text>

<Text>that is provided by a person acting for or on behalf of the health service,</Text>

<Text>that is provided by a health care provider for the purpose of, or in connection with, preventing, diagnosing or treating an illness of the person mentioned in paragraph (a),</Text>

<Text>that is carried out in excepted premises.</Text>

<Text>In this article—</Text>

<Text>“<Term id="term-care-home">care home</Term>” means accommodation occupied exclusively or mainly by individuals aged 16 or over that is provided by an organisation carrying on a care home service (within the meaning of paragraph 2 of schedule 12 of the Public Services Reform (Scotland) Act 2010<FootnoteRef Ref="f00004"/>),</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-excepted-premises">excepted premises</Term>” means—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>any premises of an independent hospital that is registered with HIS,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>any premises of an independent clinic—</Text>
<OrderedList Type="roman" Decoration="parens">
<ListItem>
<Para>
<Text>that is registered with HIS, and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>whose services are provided or managed by any of the following persons—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem NumberOverride="aa">
<Para>
<Text>a registered medical practitioner,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="bb">
<Para>
<Text>a person registered in the dentists register under the Dentists Act 1984<FootnoteRef Ref="f00005"/>,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="cc">
<Para>
<Text>a registered nurse who is noted in the Nursing and Midwifery Register as being qualified to order drugs, medicines and appliances as a nurse independent prescriber,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="dd">
<Para>
<Text>a registered midwife who is noted in the Nursing and Midwifery Register as being qualified to order drugs, medicines and appliances as a nurse independent prescriber,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="ee">
<Para>
<Text>a pharmacist independent prescriber,</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>any premises (or vehicle), other than a dwelling or care home, at or in which general dental services are provided in accordance with an agreement pursuant to section 25 of the 1978 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>premises, other than a dwelling or care home, whose address is specified in an agreement pursuant to section 17C of the 1978 Act as one at which primary medical services are to be provided in accordance with the agreement,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>premises, other than a dwelling or care home, whose address is specified in a contract pursuant to section 17J of the 1978 Act as one at which general medical services are to be provided in accordance with the contract, or</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>a registered pharmacy within the meaning of section 74 of the Medicines Act 1968<FootnoteRef Ref="f00006"/>,</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-health-care-provider">health care provider</Term>” means—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>an independent health care service that is registered with HIS,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>a regulated health care professional, or</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>a person who, in providing the procedure, is acting in accordance with the directions of a regulated health care professional,</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-health-service">health service</Term>” means the health service established under section 1 of the 1978 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-illness">illness</Term>” includes—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>mental disorder within the meaning of section 328 of the Mental Health (Care and Treatment) (Scotland) Act 2003<FootnoteRef Ref="f00007"/>, and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>any injury or disability requiring medical, surgical or dental treatment or nursing,</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-independent-clinic">independent clinic</Term>” has the meaning given by section 10F(2) of the 1978 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-independent-health-care-service">independent health care service</Term>” has the meaning given by section 10F of the 1978 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-independent-hospital">independent hospital</Term>” has the meaning given by section 10F(2) of the 1978 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-intimate-area">intimate area</Term>” means anus or genitals or an area around the anus or genitals,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-nursing-and-midwifery-register">Nursing and Midwifery Register</Term>” means the register maintained under article 5 of the Nursing and Midwifery Order 2001<FootnoteRef Ref="f00008"/>,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-pharmacist-independent-prescriber">pharmacist independent prescriber</Term>” means a person who is—</Text>
<OrderedList Type="alpha" Decoration="parens">
<ListItem>
<Para>
<Text>registered as a pharmacist in—</Text>
<OrderedList Type="roman" Decoration="parens">
<ListItem>
<Para>
<Text>Part 1 of the register maintained under article 19 of the Pharmacy Order 2010<FootnoteRef Ref="f00009"/>, or</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the register maintained in pursuance of articles 6 and 9 of the Pharmacy (Northern Ireland) Order 1976<FootnoteRef Ref="f00010"/>, and</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>noted in that register as being qualified to order drugs, medicines and appliances as a pharmacist independent prescriber,</Text>
</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-prescribed-anaesthetic">prescribed anaesthetic</Term>” means an anaesthetic that is a prescription only medicine within the meaning given by regulation 8 of the Human Medicines Regulations 2012<FootnoteRef Ref="f00011"/>,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Term id="term-regulated-health-care-professional">regulated health care professional</Term>” means a person who is regulated by any of the following—</Text>

<Text>the General Medical Council,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the General Dental Council,</Text>
</Para>
</ListItem>
<ListItem>

<Text>the General Optical Council,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the General Osteopathic Council,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the General Chiropractic Council,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the General Pharmaceutical Council</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>the Nursing and Midwifery Council,</Text>
</Para>
</ListItem>

<Title>Licensing of activity</Title>

<Text>The provision of a non-surgical procedure is designated as an activity for which a licence under Part 1 of the 1982 Act is required.</Text>
</P2para>
</P2>

<Text>But a licence is not required in respect of the carrying on of that activity before 6 September 2027.</Text>

<Title>Application of Part 1 of the 1982 Act</Title>

<Text>A person who on or after 6 September 2027 carries on the activity designated by article 4 without a licence under Part 1 of the 1982 Act is not guilty of an offence under section 7(1) of that Act if—</Text>

<Text>a non-surgical procedure is to be administered by a practitioner wearing disposable non latex gloves which must be changed for each person to whom a non-surgical procedure is to be provided (“a client”),</Text>

<Text>a supply of the following items is to be maintained—</Text>

<Title>EXPLANATORY NOTE</Title>

<Text>This Order designates, at article 4, the activity of the provision of non-surgical procedures as an activity for which a licence under Part 1 of the Civic Government (Scotland) Act 1982 (“<Term>the 1982 Act</Term>”) is required in terms of section 44(1)(b) of that Act.</Text>
</P>
<P>
<Text>Non-surgical procedures are defined in article 3 and schedule 1 of this Order.</Text>
</P>
<P>
<Text>The Order requires that the designated activity is to be licensed from 6 September 2027 (article 4), but transitional provision is made where an application is made before that date for the grant of an appropriate licence (article 6). In such a case the activity may be carried out (without a licence) until the licensing authority has made a decision on the licence. Where a decision to refuse an application is then appealed to the sheriff, the activity may be carried out until that appeal has been disposed of.</Text>

<Text>The licensing provisions of Part 1 of the 1982 Act, including schedule 1 of that Act, will apply to such licences with the following modifications in place, as set out in schedule 2 of this Order (article 5)—</Text>
