The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 28(2) of the Good Food Nation (Scotland) Act 2022(1).

Citation, commencement, and interpretation

1.—(1) These Regulations may be cited as the Good Food Nation (Scotland) Act 2022 (Commencement No. 2 (Amendment) and Commencement No. 3) Regulations 2025 and come into force on 10 March 2025.

(2) In these Regulations, “the Act” means the Good Food Nation (Scotland) Act 2022.

Amendment of the Good Food Nation (Scotland) Act 2022 (Commencement No. 2) Regulations 2024

2.  In the table in schedule 2 (provisions of the Act coming into force on 30 June 2025) of the Good Food Nation (Scotland) Act 2022 (Commencement No. 2) Regulations 2024(2)—

(a)omit the fourth row (section 21 – independence of the Commission),

(b)omit the seventh row (schedule, paragraph 3 – powers),

(c)in the first column of the eighth row (schedule, paragraphs 4, 5, 6, 7 and 8 – procedure), for “4, 5, 6, 7 and 8” substitute “6 and 7”.

Appointed day

3.—(1) 10 March 2025 is the day appointed for the coming into force of the provisions of the Act specified in column 1 of the table in the schedule (the subject matter of which is described in column 2 of that table).

(2) Where a purpose is specified in column 3 of the table in the schedule in relation to any provision specified in column 1 of the table in the schedule, that provision comes into force on 10 March 2025 only for that purpose.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Good Food Nation (Scotland) Act 2022 (Commencement No. 2) Regulations 2025 and bring into force provisions of the Good Food Nation (Scotland) Act 2022 (“the Act”) on 10 March 2025.

Regulation 2 amends the Good Food Nation (Scotland) Act 2022 (Commencement No. 2) Regulations 2024 by omitting the entries in the table in schedule 2 for section 21 and paragraphs 3, 4, 5 and 8 of the schedule of the Act. Those omitted provisions will now come into force on 10 March 2025 in terms of regulation 3 of these Regulations. The provisions remaining in the table in schedule 2 of the No. 2 Regulations will come into force on 30 June 2025.

Regulation 3 appoints 10 March 2025 as the date for the coming into force of the provisions listed in the schedule of these Regulations.

Section 21 relates to the independence of the Scottish Food Commission. Section 26 provides the Scottish Ministers with a power to make by regulations any ancillary provision they consider appropriate for the purposes of, in connection with or for giving full effect to this Act or any provision made under it. The paragraphs of the schedule of the Act make provision about powers and procedure of the Scottish Food Commission.
