These Regulations amend Commission Implementing Regulation (EU) 2019/1793 on the temporary increase of official controls and emergency measures governing the entry into the Union of certain goods from certain third countries (“Regulation (EU) 2019/1793”).

Regulation 2(2), (3) and (4) amends Regulation (EU) 2019/1793 so that references to ‘CN Codes’, ‘TARIC subdivision’ and ‘Combined Nomenclature’ are substituted with ‘commodity codes’ to align with the language provided for by the UK Integrated Tariff System.

Regulation 2(5) amends regulation 7(2) of Regulation (EU) 2019/1793 to make clear that the provision refers to ‘commodity codes’.

Regulation 2(6) provides that Annex I of Regulation (EU) 2019/1793 is substituted, with amendments, with a new Annex I in schedule 1 of these Regulations, which contains a list which sets out food and feed of non-animal origin from certain third countries which is subject to a temporary increase of official controls at border control posts and control points in Great Britain.

Regulation 2(7) provides that Annex II of Regulation (EU) 2019/1793 is substituted, with amendments, with a new Annex in schedule 2 of these Regulations. The new Annex II in schedule 2 comprises two tables. Table 1 contains the list of food and feed from certain third countries subject to special conditions for entry into Great Britain due to contamination risk by mycotoxins, including aflatoxins, pesticide residues and microbiological contamination. Table 2 contains the list of compound food containing any of the foods listed in Table 1 of Annex 2 due to the risk of contamination by aflatoxins in a quantity above 20% of either a single product or as the sum of those products.

Regulation 2(8) provides that references to ‘CN codes’ and ‘TARIC subdivision’ in Annex II(a) are substituted with ‘commodity code’ to align with the language provided for by the UK Integrated Tariff System.
