The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2(10) and paragraph 2A of Schedule 1 of the National Health Service (Scotland) Act 1978(1) and all other powers enabling them to do so.

Citation and commencement

1.  These Regulations may be cited as the Health Boards (Membership and Procedure) (Scotland) Amendment Regulations 2025 and comes into force on 7 July 2025.

2.  In regulation 3 of the Health Boards (Membership and Procedure) (Scotland) Regulations 2001(2) before “Grampian” insert “Fife, ”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Health Boards (Membership and Procedure) (Scotland) Regulations 2001 (“the Principal Regulations”) which make provision as to the membership and procedure of Health Boards established under the National Health Service (Scotland) Act 1978 (“the 1978 Act”). Appointments to the Health Boards are made by the Scottish Ministers.

Regulation 2 adds Fife Health Board to the Health Boards listed in Regulation 3 of the Principal Regulations. For the purposes of paragraph 2A of Schedule 1 of the 1978 Act, the Health Boards listed in Regulation 3 must have at least one appointed member who holds a post at a university with a medical or dental school. The other Health Boards listed in Regulation 3 are the Boards in Grampian, Greater Glasgow, Lothian and Tayside.

1978 c. 29. Section 108(1) contains definitions of “prescribed” and “regulations” relevant to the exercise of the statutory powers under which these Regulations are made; paragraph 2A of Schedule 1 was inserted by section 27(3) and paragraph 2 of Schedule 5 of the National Health Service and Community Care Act 1990 (c. 19) and amended by section 1(3) of the Health Boards (Membership and Elections) (Scotland) Act 2009 (asp 5) for the purposes specified in article 2 of S.S.I. 2009/242. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
