The Sheriff (Removal from Office) Order 2024

Coming into force
The First Minister makes the following Order in exercise of the powers conferred on him by section 25(2) of the Courts Reform (Scotland) Act 20141, and all other powers enabling him to do so.

In accordance with section 25(1) of that Act this Order is made—

  1. (a)

    after considering a report by a tribunal constituted under section 21(1) of that Act to the First Minister that Sheriff John Albert Brown is unfit to hold the office of sheriff by reason of misbehaviour; and

  2. (b)

    that report being laid by the First Minister before the Scottish Parliament in accordance with section 24(2) of that Act.

Citation and commencement1.

This Order may be cited as the Sheriff (Removal from Office) Order 2024 and comes into force on 7 June 2024.

Removal from office2.

Sheriff John Albert Brown, a sheriff for the Sheriffdom of Grampian, Highland and Islands, is removed from the office of sheriff.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order removes Sheriff John Albert Brown, a sheriff for the Sheriffdom of Grampian, Highland and Islands, from the office of sheriff. The Order follows a report submitted to the First Minister by a tribunal constituted under section 21(1) of the Courts Reform (Scotland) Act 2014 reporting that the sheriff is unfit to hold office by reason of misbehaviour and that report being laid before the Scottish Parliament.
