Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by section 23(1) of the Gender Recognition Act 20041 and all other powers enabling them to do so.
In accordance with section 23(5) of that Act, the Scottish Ministers have undertaken appropriate consultation with persons likely to be affected by it.
Citation and commencement1
This Order may be cited as the Gender Recognition (Marriage and Civil Partnership Registration) (Modification) (Scotland) Amendment Order 2022 and comes into force on 23 September 2022.
Amendment of the Gender Recognition (Marriage and Civil Partnership Registration) (Modification) (Scotland) Order 20162

The Gender Recognition (Marriage and Civil Partnership Registration) (Modification) (Scotland) Order 20162 is amended as follows.

In article 4(7) (modification of the operation of section 98 of the Civil Partnership Act 2004), after “this article” insert “and article 5”
.

After article 4, insert—
Modification of the operation of section 41A of the Registration of Births, Deaths and Marriages (Scotland) Act 1965 – civil partnerships5

The operation of section 41A(1) of the 1965 Act (admissibility of registration information as evidence)3 in relation to qualifying Scottish civil partnerships registered under regulation 10 of the 2016 Regulations is modified as follows.

Where the extract issued is an extract of a new civil partnership register entry, it shall be sufficient evidence of the date the civil partnership recorded in that entry was registered only where that date is the same as it is on the corresponding existing civil partnership register entry.
