Citation and commencement1.
These Regulations may be cited as the Official Controls (Transitional Staging Period) (Miscellaneous Amendments) (Scotland) (No. 2) Regulations 2021 and come into force on 1 October 2021.

These Regulations are made in exercise of the powers conferred by paragraph 1(1) and (3) of schedule 2 and paragraph 21(b) of schedule 7 of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(d)) arising from the withdrawal of the UK from the European Union. These Regulations amend provisions in Regulation (EU) 2017/625 and the Trade in Animals and Related Products (Scotland) Regulations 2012 (“the 2012 Regulations”) which modify the application of Regulation (EU) 2017/625 and the 2012 Regulations during a transitional staging period in relation to animals and goods which originate from territories subject to special transitional import arrangements.
Regulations 2 and 3(2)(a) amend Regulation (EU) 2017/625 and the 2012 Regulations to change the date from which transitional prior notification requirements for products of animal origin for human consumption apply from 1 October 2021 to 1 January 2022.
Regulation 3(2)(b) amends the 2012 Regulations to change the date from which products of animal origin and animal by-products are required to be accompanied by a health certificate from 1 October 2021 to 1 January 2022.
A Business and Regulatory Impact Assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
