EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are the second set of commencement regulations made by the Scottish Ministers under section 29 of the Human Tissue (Authorisation) (Scotland) Act 2019 (“the Act”) and bring into force the provisions of the Act, so far as not already in force, on 26 March 2021 (see article 2). The amendments also make provision about the authorisation of removal and use of part of the body of a deceased person.

The commencement of sections 7 and 23 for all purposes has the effect of bringing into force the following regulations—

The Bill for the Act received Royal Assent on 18 July 2019. Sections 25, 26, 29 and 30 came into force the following day.
