The Genetically Modified Organisms and Pesticides (EU Exit) (Scotland) (Amendment etc.) Regulations 2020

Coming into force in accordance with regulation 1(2)

The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraphs 1(1) and (3) and 11M(1) of schedule 2, and paragraph 21(b) of schedule 7, of the European Union (Withdrawal) Act 20181 and all other powers enabling them to do so.

In accordance with paragraph 4(a) of schedule 2 of the European Union (Withdrawal) Act 20182 they have consulted with the Secretary of State.

Citation and commencement1

These Regulations may be cited as the Genetically Modified Organisms and Pesticides (EU Exit) (Scotland) (Amendment etc.) Regulations 2020.

They come into force immediately before IP completion day.

Amendment of the Genetically Modified Organisms (EU Exit) (Scotland) (Amendment) Regulations 20192

In Regulation 4(a)(i) of the Genetically Modified Organisms (EU Exit) (Scotland) (Amendment) Regulations 20193 for “the United Kingdom” substitute “Great Britain”.

Amendment of the Fertilisers and Pesticides (EU Exit) (Scotland) (Miscellaneous Amendments etc.) Regulations 20193

In regulation 4(1)(a) and (b) of the Fertilisers and Pesticides (EU Exit) (Scotland) (Miscellaneous Amendments etc.) Regulations 20194 for “exit day” substitute “IP completion day”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made by the Scottish Ministers in exercise of the powers conferred by paragraphs 1(1) and (3) and 11M(1) of schedule 2, and paragraph 21(b) of schedule 7, of the European Union (Withdrawal) Act 2018 (c.16). The Regulations are made in order to address failures of retained EU law to operate effectively and other deficiencies arising as a result of the withdrawal of the UK from the European Union and to implement the Protocol on Ireland/Northern Ireland in the withdrawal agreement.

These Regulations make amendments to legislation in the field of genetically modified organisms and pesticides.

No Business and Regulatory Impact Assessment has been prepared in relation to these Regulations as no significant impact upon business, charities or voluntary bodies is foreseen.
