<P2para><Text>This regulation applies where CAC material—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para><Text>has affixed to it, in the form of a label, a supplier’s document in a colour other than yellow, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para><Text>such supplier’s document was in use before 1 April 2020.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para><Text>Notwithstanding paragraph 6A of Part 2 (supplier’s documents for CAC material) of schedule 5 (official labels, supplier’s documents and accompanying documents), a supplier may market in Scotland CAC material described in paragraph (1).</Text>

<Pnumber>3</Pnumber>
<P2para><Text>A supplier who markets CAC material described in paragraph (1) must ensure that the supplier’s document states that it is marketed in accordance with Article 3 of Commission Implementing Directive 2019/1813<FootnoteRef Ref="f00003"/>.</Text>

<P2para><Text>This regulation ceases to have effect on 30 June 2021.</Text>

<P><Text>They amend the Marketing of Fruit Plant and Propagating Material (Scotland) Regulations 2017 (“the principal Regulations”).</Text></P>
<P><Text>Regulation 2 amends schedule 5 of the principal Regulations to make provision for a supplier’s document affixed in the form of a label to <Emphasis>Conformitas Agraria Communitatis</Emphasis> (“CAC”) material to be yellow, and reduces the information required to be included in a supplier’s document.</Text></P>
<P><Text>Regulation 2 also amends Part 5 of the principal Regulations to make transitional provisions that enable CAC material affixed with a supplier’s document in the form of a label that is in a colour other than yellow and was in use before 1 April 2020 to be marketed in Scotland until 30 June 2021.</Text></P>
<P><Text>No business and regulatory impact assessment has been prepared for these Regulations as no impact upon business, charities or voluntary bodies is foreseen.</Text></P>

Section 2(2) was amended by the Scotland Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1998/46" id="c00006" Class="UnitedKingdomPublicGeneralAct" Year="1998" Number="0046">1998 (c.46)</Citation> (“the 1998 Act”), schedule 8, paragraph 15(3) (which was amended by section 27(4) of the Legislative and Regulatory Reform Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/2006/51" id="c00007" Class="UnitedKingdomPublicGeneralAct" Year="2006" Number="0051">2006 (c.51)</Citation> (“the 2006 Act”)). Section 2(2) was also amended by section 27(1)(a) of the 2006 Act and by the European Union (Amendment) Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/2008/7" id="c00008" Class="UnitedKingdomPublicGeneralAct" Year="2008" Number="0007">2008 (c.7)</Citation> (“the 2008 Act”), section 3(3) and schedule 1, Part 1.
