<Pnumber>1</Pnumber>
<P2para><Text>The installation, alteration or replacement of a reverse vending machine in a wall of a shop or within the curtilage of a shop.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para><Text>Development is not permitted by this class if—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para><Text>the reverse vending machine would exceed 3.5 metres in height,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para><Text>its footprint would exceed 80 square metres,</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para><Text>in the case of a reverse vending machine installed in the wall of a shop, any part of the development would protrude 2 metres beyond the outer surface of that wall,</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para><Text>it would be situated within 15 metres of the curtilage of a building used for residential purposes,</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para><Text>it would face onto and be within 5 metres of a road,</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para><Text>it would be within—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para><Text>a site of archaeological interest,</Text></P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para><Text>a national scenic area,</Text></P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para><Text>a historic garden or designed landscape,</Text></P4para>
</P4>
<P4>
<Pnumber>iv</Pnumber>
<P4para><Text>a historic battlefield,</Text></P4para>
</P4>
<P4>
<Pnumber>v</Pnumber>
<P4para><Text>a conservation area,</Text></P4para>
</P4>
<P4>
<Pnumber>vi</Pnumber>
<P4para><Text>a National Park, or</Text></P4para>
</P4>
<P4>
<Pnumber>vii</Pnumber>
<P4para><Text>a World Heritage Site.</Text></P4para>

<Pnumber>3</Pnumber>
<P2para><Text>Development is permitted by this class subject to the following conditions—</Text>

<Pnumber>a</Pnumber>
<P3para><Text>where the reverse vending machine is no longer in operation—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para><Text>the development must be removed as soon as reasonably practicable, and</Text></P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para><Text>the land on which the development was situated, including any wall in which the development was installed must, as soon as reasonably practicable, and so far as reasonably practicable, be reinstated to its condition before that development was carried out.</Text></P4para>
</P4>

<P2>
<Pnumber>4</Pnumber>
<P2para><Text>For the purpose of this class—</Text>

<Para><Text>“footprint” means an area of ground covered by development,</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“reverse vending machine” means a machine for the purpose of accepting scheme packaging, reimbursing deposits for each item of scheme packaging accepted, and retaining the scheme packaging for collection within the meaning of the Deposit and Return Scheme for Scotland Regulations 2020<FootnoteRef Ref="f00003"/>, and any associated enclosure, building, canopy or other structure,</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“scheme packaging” has the meaning given in regulation 3(2) of the Deposit and Return Scheme for Scotland Regulations 2020,</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“shop” means a building used for any purpose within class 1 of the schedule of the Use Classes Order, and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“World Heritage Site” means land appearing on the World Heritage List kept under article 11(2) of the 1972 UNESCO Convention for the Protection of the World Cultural and Natural Heritage<FootnoteRef Ref="f00004"/>.</Text>
</Para>
</ListItem>
