Section 275 was relevantly amended by section 54(16) of the Planning etc. (Scotland) Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/asp/2006/17">2006 (asp 17)</ref> and paragraph 32 of schedule 3 of the Regulatory Reform (Scotland) Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/asp/2014/3">2014 (asp 3)</ref>. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c.46)</ref>.</p></authorialNote> and all other powers enabling them to do so.</p></formula></preamble><body><article eId="article-1"><heading>Citation and commencement</heading><num>1.</num><content><p>This Order may be cited as the Town and Country Planning (General Permitted Development) (Coronavirus) (Scotland) Amendment Order 2020 and comes into force on 24 April 2020.</p></content></article><article eId="article-2"><heading>Amendment of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992</heading><num>2.</num><content><p>The Town and Country Planning (General Permitted Development) (Scotland) Order 1992<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1992/223">S.I. 1992/223</ref> which has been relevantly amended by <ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2011/377">S.S.I. 2011/377</ref> and <ref eId="c00007" href="http://www.legislation.gov.uk/id/ssi/2014/142">S.S.I. 2014/142</ref>.</p></authorialNote> is amended in accordance with article 3.</p></content></article><article eId="article-3"><heading>Amendment of Schedule 1</heading><num>3.</num><content><p><mod>In schedule 1 (permitted development), after Part 25B (ancient monuments) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><part><num>PART 25C</num><heading><b>Development by Local Authorities and Health Service Bodies</b></heading><hcontainer name="wrapper1"><intro><p><b>Class 72C</b></p></intro><paragraph><num>(1)</num><intro><p><b>Development by, or on behalf of, a local authority</b> <b>or health service body for the purposes of—</b></p></intro><level class="para1"><num>(a)</num><content><p><b>preventing an emergency,</b></p></content></level><level class="para1"><num>(b)</num><content><p><b>reducing, controlling or mitigating the effects of an emergency, or</b></p></content></level><level class="para1"><num>(c)</num><content><p><b>taking other action in connection with an emergency.</b></p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Development is not permitted by this Class if—</p></intro><level class="para1"><num>(a)</num><intro><p>any part of the development is on land which is, or forms part of—</p></intro><level class="para2"><num>(i)</num><content><p>a site of special scientific interest,</p></content></level><level class="para2"><num>(ii)</num><content><p>site of archeological interest,</p></content></level><level class="para2"><num>(iii)</num><content><p>a historic battlefield, or</p></content></level><level class="para2"><num>(iv)</num><content><p>a historic garden or designed landscape,</p></content></level></level><level class="para1"><num>(b)</num><content><p>any development, other than a change of use, would be carried out within 5 metres of any boundary of the curtilage of a dwellinghouse,</p></content></level><level class="para1"><num>(c)</num><intro><p>the height of any new building exceeds—</p></intro><level class="para2"><num>(i)</num><content><p>a height of 6 metres above ground where any part of the new building is within 10 metres of any boundary of the land, or</p></content></level><level class="para2"><num>(ii)</num><content><p>a height of 18 metres above the ground, or, where the development is within the curtilage of a building, the height of the highest part of the roof of the original building, whichever is the greater,</p></content></level></level><level class="para1"><num>(d)</num><intro><p>the height of any building enlarged, improved or altered exceeds—</p></intro><level class="para2"><num>(i)</num><content><p>the height of the highest part of the roof of the original building, or a height of 6 metres above the ground, whichever is the greater, where any part of the enlarged, improved or altered building is within 10 metres of an boundary of the curtilage of the original building, or</p></content></level><level class="para2"><num>(ii)</num><content><p>the height of the highest part of the roof of the original building, or height of 18 metres above the ground, whichever is the greater, or</p></content></level></level><level class="para1"><num>(e)</num><intro><p>any moveable structure, works, plant or machinery required temporarily and in connection with and for the duration of the development would be located in a position—</p></intro><level class="para2"><num>(i)</num><content><p>within 5 metres of any boundary of the land, or</p></content></level><level class="para2"><num>(ii)</num><content><p>within 10 metres of any boundary of the curtilage of a dwellinghouse.</p></content></level></level></paragraph><paragraph><num>(3)</num><intro><p>Development is permitted by this Class subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><content><p>if the developer is not the planning authority, the developer must, as soon as practicable after commencing development, notify the planning authority of the development,</p></content></level><level class="para1"><num>(b)</num><content><p>any use of the land for the purposes of this Class ceases on or before 31st<span ukl:Name="NonBreakingSpace"> </span>December<span ukl:Name="NonBreakingSpace"> </span>2020, and</p></content></level><level class="para1"><num>(c)</num><intro><p>on or before the expiry of a period of 6 months beginning with the date on which the use of the land ceases for the purpose of this Class—</p></intro><level class="para2"><num>(i)</num><content><p>any building, works, plant, machinery, structure or erection permitted by this Class is removed, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the land is restored to its condition before the development took place or to such other state as may be approved by the planning authority.</p></content></level></level></paragraph></hcontainer><hcontainer name="wrapper1"><intro><p><b>Interpretation of Part 25C</b></p></intro><paragraph><num>(1)</num><intro><p>For the purposes of this Part—</p></intro><hcontainer name="definition"><content><p>“emergency” means an event or situation which threatens serious damage to human welfare in a place in the United Kingdom,</p></content></hcontainer><hcontainer name="definition"><intro><p>“health service body” means—</p></intro><level class="para1"><num>(a)</num><content><p>a Health Board constituted by an order under section 2(1)(a) of the National Health Service (Scotland) Act 1978<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 c.29</ref>.</p></authorialNote>,</p></content></level><level class="para1"><num>(b)</num><content><p>a Special Health Board constituted by an order under section 2(1)(b) of the National Health Service (Scotland) Act 1978,</p></content></level><level class="para1"><num>(c)</num><content><p>the Common Services Agency<authorialNote class="footnote" eId="f00004" marker="4"><p>The Common Service Agency is constituted under section 10 of the National Health Service (Scotland) Act <ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 (c.29)</ref>.</p></authorialNote>,</p></content></level><level class="para1"><num>(d)</num><content><p>Public Health Scotland<authorialNote class="footnote" eId="f00005" marker="5"><p>Public Health Scotland is a Special Health Board for the whole of Scotland constituted under the Public Health Scotland Order 2019 (<ref eId="c00010" href="http://www.legislation.gov.uk/id/ssi/2019/336">S.S.I. 2019/336</ref>).</p></authorialNote>,</p></content></level><level class="para1"><num>(e)</num><content><p>Healthcare Improvement Scotland <authorialNote class="footnote" eId="f00006" marker="6"><p>Healthcare Improvement Scotland is established under section 10A of the National Health Service (Scotland) Act 1978 which was introduced by section 108 of the Public Services Reform (Scotland) Act <ref eId="c00011" href="http://www.legislation.gov.uk/id/asp/2010/8">2010 (asp 8)</ref>.</p></authorialNote>, and</p></content></level><level class="para1"><num>(f)</num><content><p>NHS 24<authorialNote class="footnote" eId="f00007" marker="7"><p>NHS 24 is a Special Health Board for the whole of Scotland constituted under the NHS (Scotland) 2001/137</ref>).</p></authorialNote>.</p></content></level></hcontainer></paragraph><paragraph><num>(2)</num><intro><p>For the purposes of paragraph (1), an event or situation threatens serious damage to human welfare only if it involves, causes or may cause—</p></intro><level class="para1"><num>(a)</num><content><p>loss of human life,</p></content></level><level class="para1"><num>(b)</num><content><p>human illness or injury,</p></content></level><level class="para1"><num>(c)</num><content><p>homelessness,</p></content></level><level class="para1"><num>(d)</num><content><p>damage to property,</p></content></level><level class="para1"><num>(e)</num><content><p>disruption of a supply of money, food, water, energy, or fuel,</p></content></level><level class="para1"><num>(f)</num><content><p>disruption of a system of communication,</p></content></level><level class="para1"><num>(g)</num><content><p>disruption of facilities for transport, or</p></content></level><level class="para1"><num>(h)</num><content><p>disruption of services relating to health.</p></content></level></paragraph><paragraph><num>(3)</num><content><p>For the purposes of this Part, where 2 or more original buildings are within the same curtilage and are used for the same undertaking they are to be treated as a single original building in making any measurement.</p></content></paragraph></hcontainer></part></quotedStructure><inline
