The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 28A(5) and 28D(3) of the Education (Scotland) Act 1980(1) and section 22 of, and paragraphs 4(3) and 6(6) of schedule 2 of the Education (Additional Support for Learning) (Scotland) Act 2004(2) and all other powers enabling them to do so.
1980 c.44. Section 28A and 28D of the Education (Scotland) Act 1980 were inserted by section 1(1) of the Education (Scotland) Act 1981 (c.58). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
