Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 6A(1)(aa) and (1B) of the Valuation and Rating (Scotland) Act 19561 and all other powers enabling them to do so.

In accordance with section 6A(1D) that Act2 they have consulted such associations of local authorities and such other persons as they think appropriate.

Citation and commencement1

This Order may be cited as the Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment (No. 2) Order 2019 and comes into force on 31 March 2019.

Amendment of the Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment Order 20192

The Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment Order 20193 is amended as follows.

In the table in article 6 (company names and registration numbers for fixed line telecommunications operators)—

a

in the entry for “Centurylink Communications UK Limited”, for the registration number substitute “02495998”,

b

omit the entry for “Orange Limited” and the corresponding registration number,

c

omit the entry for “Pipex Broadband Limited” and the corresponding registration number,

d

for “Sky Telecommunications Services Ltd” substitute “Sky Telecommunications Services Limited”, and

e

for “Talk Talk Communications Ltd” substitute “Talktalk Communications Limited”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment Order 2019 (“the 2019 Order”).

That Order replaces a table in the Non-Domestic Rating (Valuation of Utilities) (Scotland) Order 2005 (S.S.I. 2005/127). The table details companies to be regarded as “fixed line operators” for the purposes of entries in the valuation roll. The effect is that specified lands and heritages occupied by those operators are entered as a single entry in the valuation roll for Renfrewshire, despite being situated in different rating authority areas.

This Order updates entries in the table in the 2019 Order, so that when it comes into force on 1 April 2019 it states accurately the names and registration numbers of the companies it details. Two entries are omitted, as a result of dissolution of the companies to which they related.
