The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 1(1), (2)(f), 3(1) and 3(3)(b) of, and paragraph 6(c) of schedule 2 of, the Public Service Pensions Act 2013(1) and all other powers enabling them to do so.
In accordance with section 21 of that Act, the Scottish Ministers consulted the representatives of such persons as appeared to the Scottish Ministers likely to be affected by these Regulations.
1.—(1) These Regulations may be cited as the Firefighters’ Pension Scheme (Scotland) Amendment Regulations 2019.
(2) These Regulations come into force on 10 December 2019 and have effect from 1 April 2015.
2.—(1) The Firefighters’ Pension Scheme (Scotland) Regulations 2015(2) are amended in accordance with paragraph 2(2).
(2) In paragraph 45 of schedule 2 (acceptance of club transfer value payments) after “relates to a member’s final salary benefit” insert “, apart from a payment from the 1992 Scheme as that scheme has effect in England, Wales and Northern Ireland,”.

These Regulations amend the Firefighters’ Pension Scheme (Scotland) Regulations 2015 (“the 2015 Regulations”). Regulation 2(2) amends the 2015 Regulations to clarify that protected members of the 1992 Scheme constituted by the Firemen’s Pension Scheme Order 1992 transferring to Scotland from England, Wales and Northern Ireland continue to be entitled to remain as members of that scheme.
