85(1)(a), (2) and (4), 86(1) and (3) and 88(1), (2) and (6) of the Marine (Scotland) Act 2010<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/asp/2010/5">2010 asp 5</ref>.</p></authorialNote> and all other powers enabling them to do so.</p><p>In accordance with section 85(1)(a) of that Act, this Order is made for the purpose of furthering the stated conservation objectives for the Loch Carron MPA<authorialNote class="footnote" eId="f00002" marker="2"><p>The Loch Carron Nature Conservation Marine Protected Area was designated by the Loch Carron Nature Conservation Marine Protected Area Order 2019 (“the 2019 Order”). The 2019 Order is available at <a href="https://www2.gov.scot/Topics/marine/marine-environment/mpanetwork/developing/CarronCO2019">https://www2.gov.scot/Topics/marine/marine-environment/mpanetwork/developing/CarronCO2019</a>. Within the 2019 Order, the conservation objectives are set out in in article 5 and the protected features are specified in schedule 2.</p></authorialNote>.</p><p>In accordance with section 87(2) of that Act, the Scottish Ministers have sent a copy of a draft of this Order to persons whom they considered were likely to be interested in or affected by the making of this Order.</p><p>In accordance with section 87(3) of that Act, the Scottish Ministers have placed a copy of a draft of this Order in such places as they considered were likely to be most convenient for the purpose of enabling it to be inspected by persons likely to be affected by the making of this Order.</p><formula name="enactingText"><p>In accordance with section 87(6) and (7) of that Act, the Scottish Ministers have published notice of their proposal to make this Order.</p></formula></preamble><body><article eId="article-1"><heading>Citation and commencement</heading><num>1.</num><content><p>This Order may be cited as the Loch Carron Marine Conservation Order 2019 and comes into force on 19 May 2019.</p></content></article><article eId="article-2"><heading>Interpretation</heading><num>2.</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“the Loch Carron MPA” means the area designated as a nature conservation marine protected area by, and described in article 3 of, the Loch Carron Nature Conservation Marine Protected Area Order 2019<authorialNote class="footnote" eId="f00003" marker="3"><p>The 2019 Order was made by the Scottish Ministers under powers conferred by sections 67(1)(a), 68, 69, 74 and 79(1) of the Marine (Scotland) Act 2010. By virtue of section 165(3) of that Act the 2019 Order is not a Scottish Statutory Instrument but is a Scottish Ministerial Order.</p></authorialNote>, and</p></content></hcontainer><hcontainer name="definition"><content><p>“the protected area” means the area described in article 3.</p></content></hcontainer></article><article eId="article-3"><heading>The protected area</heading><num>3.</num><intro><p>For the purposes of this Order, the area protected by it is—</p></intro><level class="para1" eId="article-3-a"><num>(a)</num><content><p>the seabed and subsoil, and</p></content></level><level class="para1" eId="article-3-b"><num>(b)</num><content><p>all of the water covering the seabed,</p></content></level><wrapUp><p>within the Loch Carron MPA.</p></wrapUp></article><article eId="article-4"><heading>Prohibited and regulated activities</heading><num>4.</num><paragraph eId="article-4-1"><num>(1)</num><content><p>Paragraphs (2) and (3) apply in order to further the stated conservation objectives for the Loch Carron MPA.</p></content></paragraph><paragraph eId="article-4-2"><num>(2)</num><content><p>A person must not deploy (by any means) or use any fishing gear within the protected area.</p></content></paragraph><paragraph eId="article-4-3"><num>(3)</num><content><p>While a fishing vessel is within the protected area the master of the vessel must ensure that any fishing gear carried on board the vessel is properly lashed and stowed in such a way that it may not be readily used.</p></content></paragraph><paragraph eId="article-4-4"><num>(4)</num><content><p>Paragraphs (2) and (3) do not apply to the deployment or use of any fishing gear within the protected area for the purpose of saving life, or for the purpose of securing the safety of a vessel, aircraft or marine structure.</p></content></paragraph><paragraph eId="article-4-5"><num>(5)</num><intro><p>In this article—</p></intro><hcontainer name="definition"><content><p>“beam trawl” means a type of demersal trawl which has its mouth extended by a beam, bar or other rigid device,</p></content></hcontainer><hcontainer name="definition"><content><p>“creel” means a basket, small cage, pot, receptacle or container with one or more openings or entrances which may be baited and placed on the seabed for the purpose of catching fish or shellfish,</p></content></hcontainer><hcontainer name="definition"><content><p>“demersal seine net” means an encircling net, attached to ropes, which is laid on, and towed across, the seabed,</p></content></hcontainer><hcontainer name="definition"><content><p>“demersal trawl” means a net which is towed along the seabed,</p></content></hcontainer><hcontainer name="definition"><intro><p>“dredge” means—</p></intro><level class="para1"><num>(a)</num><content><p>a mechanical dredge, or</p></content></level><level class="para1"><num>(b)</num><content><p>a suction dredge which raises material, fish and shellfish from the seabed by the use of a solids pump, air lift or water jets which dig into the seabed,</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“fishing gear” means any beam trawl, demersal seine net, demersal trawl, dredge, any other device used for fishing purposes, and any rope or wire associated with the gear but excluding–</p></intro><level class="para1"><num>(a)</num><content><p>passive gear,</p></content></level><level class="para1"><num>(b)</num><content><p>a pelagic trawl,</p></content></level><level class="para1"><num>(c)</num><content><p>a rod and line, and</p></content></level><level class="para1"><num>(d)</num><content><p>a handline,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“handline” means a single fishing line which is held in a person’s hand,</p></content></hcontainer><hcontainer name="definition"><content><p>“parlour creel” means a creel which has at least two compartments, entry to one or more of which is likely to be gained only through an internal connection from another compartment,</p></content></hcontainer><hcontainer name="definition"><intro><p>“passive gear” means any gear or catch operation which does not require an active movement of the gear, including—</p></intro><level class="para1"><num>(a)</num><content><p>gillnets, trammel nets and trap nets,</p></content></level><level class="para1"><num>(b)</num><content><p>drifting gillnets, and drifting trammel nets, any of which may be equipped with anchoring, floating or navigational gear,</p></content></level><level class="para1"><num>(c)</num><content><p>long lines and lines, and</p></content></level><level class="para1"><num>(d)</num><content><p>creels and parlour creels,</p></content></level><wrapUp><p>and includes any rope or wire associated with the gear, and</p></wrapUp></hcontainer><hcontainer name="definition"><content><p>“pelagic trawl” means any trawl or encircling net which has no contact with the seabed during a fishing operation, and includes any rope or wire associated with the gear.</p></content></hcontainer></paragraph></article><article eId="article-5"><heading>Disapplication of exception to the offences under sections 94 and 95 of the Marine (Scotland) Act 2010</heading><num>5.</num><paragraph eId="article-5-1"><num>(1)</num><intro><p>Section 97(1)(b) (exception to certain offences where act authorised by a public authority <abbr title="et cetera" xml:lang="la">etc.</abbr>) of the 2010 Act does not apply in relation to—</p></intro><level class="para1" eId="article-5-1-a"><num>(a)</num><content><p>an offence under section 94 of the 2010 Act of contravening this Order,</p></content></level><level class="para1" eId="article-5-1-b"><num>(b)</num><content><p>an offence under section 95 of the 2010 Act committed in relation to the protected area.</p></content></level></paragraph><paragraph eId="article-5-2"><num>(2)</num><content><p>In this article “the 2010 Act” means the Marine (Scotland) Act 2010.</p></content></paragraph></article><article eId="article-6"><heading>Revocations</heading><num>6.</num><content><p>The Loch Carron Urgent Marine Conservation (<abbr title="Number">No.</abbr> 2) Order 2017<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/ssi/2017/205">S.S.I. 2017/205</ref>.</p></authorialNote> and the Loch Carron Urgent Marine Conservation (<abbr title="Number">No.</abbr> 2) Order 2017 (Urgent Continuation) Order 2018<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00003" environmental legislation.</p></blockContainer><blockContainer ukl:Name="P"><p>The Loch Carron Nature Conservation Marine Protected Area Order 2019 (“the 2019 Order”) designated that part of the Scottish marine area which is within Loch Carron as a nature conservation marine protected area (“the Loch Carron MPA”). The 2019 Order provides that flame shell beds and maerl beds within Loch Carron are protected features.</p></blockContainer><blockContainer ukl:Name="P"><p>This Order furthers the stated conservation objectives for the Loch Carron MPA.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 3 describes the area protected by this Order (“the protected area”). It is the seabed and subsoil and all of the water covering the seabed within the Loch Carron MPA.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 4 prohibits and regulates activities within the protected area.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 4(2) provides that a person must not deploy or use any fishing gear within the protected area. The term “fishing gear” and associated terms are defined in article 4(5) of the Order.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 4(3) regulates the storage of fishing gear on fishing vessels within the protected area.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 4(4) provides that article 4(2) and (3) does not apply to activities carried out in the protected area for the purpose of saving life or for the purpose of securing the safety of a vessel, aircraft or marine structure.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 5 provides that of section 97(1)(b) (exception to certain offences where act authorised by a public authority <abbr title="et cetera" xml:lang="la">etc.</abbr>) of the Marine (Scotland) Act 2010 does not apply in relation to an offence under section 94 of that Act of contravening this Order or an offence under section 95 of that Act committed in relation to the protected area.</p></blockContainer><blockContainer ukl:Name="P"><p>A person who contravenes this Order commits an offence and is liable on summary conviction to a fine of up to £50,000, and on conviction on indictment to an unlimited fine.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 6 revokes the Loch Carron Urgent Marine Conservation (<abbr title="Number">No.</abbr> 2) Order 2017 and the Loch Carron Urgent Marine Conservation (<abbr title="Number">No.</abbr> 2) Order 2017 (Urgent Continuation) Order 2018.</p></blockContainer><blockContainer ukl:Name="P"><p>A Business and Regulatory Impact Assessment (“BRIA”) has been prepared in relation to this Order and placed in the Scottish Parliament Information Centre.
