Coming into force in accordance with regulation 1

The Scottish Ministers make the following Regulations in exercise of the powers conferred on them by paragraph 1(1) and (3) of schedule 2 of the European Union (Withdrawal) Act 2018 F1 and all other powers enabling them to do so.

In accordance with paragraph 1(6) of schedule 7 of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

There has been consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.

These Regulations may be cited as the Fishery Products (Official Controls Charges) (EU Exit) (Scotland) (Amendment) Regulations 2019 and come into force on exit day.

Amendment of the Fishery Products (Official Controls Charges) (Scotland) Regulations 2007I22

The Fishery Products (Official Controls Charges) (Scotland) Regulations 2007 F2 are amended as follows.

In regulation 2 (interpretation) for the definition of “third country” substitute “third country” (except in the expression “third country import”) means any country or territory other than the British Islands;

For regulation 4 (sterling equivalents of euro), substitute—

Any reference in these Regulations to a specified number of Euros (“EUR”) is to be read as that sum converted into pounds sterling (“GBP”) using the exchange rate of GBP1 = EUR1.1413.

These Regulations are made in exercise of the powers conferred by paragraph 1(1) and (3) of schedule 2 of the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the UK from the European Union.

These Regulations make amendments to the Fishery Products (Official Controls Charges) (Scotland) Regulations 2007 (S.S.I. 2007/537).
