<Text>In these Regulations unless otherwise specified, references to a section are to a section of the Burial and Cremation (Scotland) Act 2016.</Text>

<Text>In these Regulations—</Text>

<Para><Text>“electronic communication” has the meaning given in section 15(1) of the Electronic Communications Act 2000<FootnoteRef Ref="f00002"/> and similar expressions are to be construed accordingly, and</Text>
</Para>

<Para><Text>“patient identifier” means a patient’s—</Text>

</ListItem>

<Para><Text>where that number is not known, any other number or other indicator which from time to time may be used to identify a patient individually.</Text></Para>

IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/b" id="regulation-2-2-b"><Pnumber>b</Pnumber><P3para><Text>the woman’s home address,</Text></P3para></P3><P3 IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/d" id="regulation-2-2-d"><Pnumber>d</Pnumber><P3para><Text>the gestational age of pregnancy,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/e" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/e" id="regulation-2-2-e"><Pnumber>e</Pnumber><P3para><Text>any decision by the appropriate health body that it is not in the woman’s best interests to be given an opportunity to decide on the matters in paragraph (3),</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/f" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/f" id="regulation-2-2-f"><Pnumber>f</Pnumber><P3para><Text>where the appropriate health body considers that it is in the woman’s best interests to give the woman an opportunity to decide on the matters in paragraph (3)—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/f/i" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/f/i" id="regulation-2-2-f-i"><Pnumber>i</Pnumber><P4para><Text>that the woman made no decision on the matters, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/f/ii" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/f/ii" id="regulation-2-2-f-ii"><Pnumber>ii</Pnumber><P4para><Text>the decision of the woman on the matters,</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/g" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/g" id="regulation-2-2-g"><Pnumber>g</Pnumber><P3para><Text>where the woman decides she wishes to authorise the appropriate health body to make arrangements for the remains of the fetus to be buried  <Substitution ChangeId="key-7c643329c4d2eb9cfcea07a75f71e4a6-1777381839491" CommentaryRef="key-7c643329c4d2eb9cfcea07a75f71e4a6">, cremated or hydrolysed</Substitution>—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/g/i" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/g/i" id="regulation-2-2-g-i"><Pnumber>i</Pnumber><P4para><Text>the name of the individual to whom the decision is communicated by the woman,</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/g/ii" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/g/ii" id="regulation-2-2-g-ii"><Pnumber>ii</Pnumber><P4para><Text>the position held in the appropriate health body by the individual to whom the decision is communicated by the woman, and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/g/iii" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/g/iii" id="regulation-2-2-g-iii"><Pnumber>iii</Pnumber><P4para><Text>the date on which the decision is communicated to the individual by the woman, and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/2/h" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/2/h" id="regulation-2-2-h"><Pnumber>h</Pnumber><P3para><Text>where the woman decides she wishes to authorise the appropriate health body to make arrangements for the remains of the fetus to be buried  <Substitution ChangeId="key-dedf0f3eef7d9632c7a904962f544efc-1777381877590" CommentaryRef="key-dedf0f3eef7d9632c7a904962f544efc">, cremated or hydrolysed</Substitution>  in a way specified by the IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3" id="regulation-2-3"><Pnumber>3</Pnumber><P2para><Text>The matters are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/a" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/a" id="regulation-2-3-a"><Pnumber>a</Pnumber><P3para><Text>whether the woman wishes to make the arrangements for the remains of the fetus to be buried  <Substitution ChangeId="key-09e0acc2cd8c5154b74848670c1e5765-1777381904808" CommentaryRef="key-09e0acc2cd8c5154b74848670c1e5765">, cremated or hydrolysed</Substitution>,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/b" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/b" id="regulation-2-3-b"><Pnumber>b</Pnumber><P3para><Text>whether the woman wishes to authorise the appropriate health body to make those arrangements—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/b/i" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/b/i" id="regulation-2-3-b-i"><Pnumber>i</Pnumber><P4para><Text>in a way specified by the woman, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/b/ii" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/b/ii" id="regulation-2-3-b-ii"><Pnumber>ii</Pnumber><P4para><Text>in a way specified by the body,</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/c" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/c" id="regulation-2-3-c"><Pnumber>c</Pnumber><P3para><Text>if the woman wishes to authorise the appropriate health body under paragraph (b), whether she wishes to authorise the body to make those arrangements—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/c/i" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/c/i" id="regulation-2-3-c-i"><Pnumber>i</Pnumber><P4para><Text>as soon as practicable after the pregnancy is terminated, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2018/384/regulation/2/3/c/ii" IdURI="http://www.legislation.gov.uk/id/ssi/2018/384/regulation/2/3/c/ii" <Title>EXPLANATORY NOTE</Title>

</Comment>
<P><Text>These Regulations make provision regarding arrangements for burial or cremation following pregnancy loss under Part 3 (arrangements) of the Burial and Cremation (Scotland) Act 2016 (“the 2016 Act”).</Text></P>
<P><Text>Regulation 2 makes provision for the prescribed information to be recorded where, as provided in section 69(1) of the 2016 Act, a woman’s pregnancy is to be terminated after its 24th week by virtue of section 1(1)(b), (c) or (d) of the Abortion Act 1967 (”the 1967 Act”).</Text></P>
<P><Text>Regulation 3 makes provision for the prescribed information to be recorded where, as provided in section 71(1) of the 2016 Act, a woman’s pregnancy is terminated after its 24th week by virtue of section 1(1)(b), (c) or (d) of the 1967 Act and no arrangements for burial or cremation have been or are being made by virtue of section 69(2) of the 2016 Act.</Text></P>
<P><Text>Regulation 4 makes provision for the prescribed information to be recorded where, as provided in section 72(1) of the 2016 Act, a woman is informed that it is likely that the woman’s pregnancy will end with a still-birth other than in consequence of the termination of the pregnancy by virtue of section 1(1)(b), (c) or (d) of the 1967 Act.</Text></P>
<P><Text>Regulation 5 makes provision for the prescribed information to be recorded where, as provided in section 74(1) of the 2016 Act, a still-birth occurs other than in consequence of the termination of the pregnancy by virtue of section 1(1)(b), (c) or (d) of the 1967 Act and no arrangements for burial or cremation have been or are being made by virtue of section 72(2) of the 2016 Act.</Text></P>
<P><Text>Regulation 6 and schedule 1 are relevant where burial or cremation of a still-born child is authorised under section 74(4)(a) of the 2016 Act. They make provision for the prescribed form of record of the nearest relative’s decision under section 75(3) of the 2016 Act that arrangements for burial or cremation authorised under section 74(4)(a) of the 2016 Act may be made before the expiry of the period of 7 days beginning on the day on which that authorisation was given.</Text></P>
<P><Text>Regulation 7 makes provision for the prescribed information to be recorded where, as provided in section 77(1) of the 2016 Act, a woman is informed that it is likely that the woman’s pregnancy will end before or on completion of its 24th week.</Text></P>
<P><Text>Regulation 8 and schedule 2 are relevant where, as provided in section 79(1) of the 2016 Act, a woman’s pregnancy ends before completion of its 24th week and no arrangements for burial or cremation have been made. They make provision for the prescribed form of record of—</Text><UnorderedList Decoration="bullet">

<Text>the matters mentioned in section 79(8) of the 2016 Act: either a decision under section 79(2) of the 2016 Act by the woman after that 7 day period or the fact that no such decision has been notified;</Text>

<P><Text>Regulation 9 and schedule 3 are relevant where an individual is authorised under section 79(2)(b) of the 2016 Act to make arrangements for burial or cremation. They make provision for the prescribed form of record of—</Text><UnorderedList Decoration="bullet">
