The Licensing (Fees) (Scotland) Amendment Regulations 2018

Coming into force
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 136(1) and (2) and section 146(2) of the Licensing (Scotland) Act 20051 and all other powers enabling them to do so.

In accordance with section 136(3) of that Act, they have consulted such bodies as appeared to them to be representative of the interests of Licensing Boards, councils and those likely to be affected by these Regulations.

Citation and commencement1.

These Regulations may be cited as the Licensing (Fees) (Scotland) Amendment Regulations 2018 and come into force on 1st October 2018.

Amendment of the Licensing (Fees) (Scotland) Regulations 20072.

After regulation 17 of the Licensing (Fees) (Scotland) Regulations 20072 insert:

“17A.

The fee payable in respect of an application under section 78 of the Act received by a Board after 1700 hours on 1st October 2018 is £50.”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend the Licensing (Fees) (Scotland) Regulations 2007 by inserting a new regulation 17A to make provision for a fee to be payable to Licensing Boards under the Licensing (Scotland) Act 2005 for a personal licence renewal application where that application has been received after 17.00 on 1st October 2018.
