In this schedule, “fixed monetary penalty”, “variable monetary penalty”, “VMP undertaking”, “enforcement undertaking”, “non-compliance penalty” “certificate of non-compliance” and “notice of intent” have the same meaning as in the Environmental Regulation (Enforcement Measures) (Scotland) Order 2015(1).
