Act of Sederunt (Fees of Solicitors in the Court of Session, Sheriff Appeal Court and Sheriff Court) (Amendment) 2018

In accordance with section 4 of the Scottish Civil Justice Council and Criminal Legal Assistance Act 20131, the Court of Session has approved draft rules submitted to it by the Scottish Civil Justice Council.

The Court of Session therefore makes this Act of Sederunt under the powers conferred by sections 103(1), 105(1) and 106(1) of the Courts Reform (Scotland) Act 20142 and all other powers enabling it to do so.

Citation and commencement, etc.1

This Act of Sederunt may be cited as the Act of Sederunt (Fees of Solicitors in the Court of Session, Sheriff Appeal Court and Sheriff Court) (Amendment) 2018.

It comes into force on 24th September 2018.

A certified copy is to be inserted in the Books of Sederunt.

Amendment of the Act of Sederunt (Fees of Solicitors in the Sheriff Court) (Amendment and Further Provisions) 19932

Schedule 1 of the Act of Sederunt (Fees of Solicitors in the Sheriff Court) (Amendment and Further Provisions) 19933 is amended in accordance with this paragraph.

In paragraph 15 of the General Regulations4, for “£35” substitute “£37”.

In the provisions of the Table of Fees which are mentioned in column 1 of schedule 1 of this Act of Sederunt, for the amounts specified in column 2, substitute the amounts specified in column 3.

Amendment of the Rules of the Court of Session 19943

Rule 42.16 (table of fees) of the Rules of the Court of Session 19945 is amended in accordance with this paragraph.

In paragraph (1A)6, for “£35” substitute “£37”.

In the provisions of the Table of Fees in paragraph (3) which are mentioned in column 1 of schedule 2 of this Act of Sederunt, for the amounts specified in column 2, substitute the amounts specified in column 3.

The Act of Sederunt (Fees of Solicitors in the Sheriff Appeal Court) 20157 is amended in accordance with this paragraph.

In the provisions of schedule 1 (detailed fees) mentioned in column 1 of Part 1 of schedule 3 of this Act of Sederunt, for the amounts specified in column 2, substitute the amounts specified in column 3.

In the provisions of schedule 2 (inclusive fees) mentioned in column 1 of Part 2 of schedule 3 of this Act of Sederunt, for the amounts specified in column 2, substitute the amounts specified in column 3.

Paragraphs 2, 3 and 4 have no effect as regards fees payable in respect of work carried out before 24th September 2018.

EXPLANATORY NOTE

(This note is not part of the Act of Sederunt)

This Act of Sederunt amends the fees that are prescribed in the tables of solicitors’ fees in Act of Sederunt (Fees of Solicitors in the Sheriff Court) (Amendment and Further Provisions) 1993, in the Rules of the Court of Session 1994, and in Act of Sederunt (Fees of Solicitors in the Sheriff Appeal Court) 2015. The tables in question regulate the fees that can be recovered under an award of expenses in respect of work carried out by a party’s solicitor in civil proceedings in the Court of Session, Sheriff Appeal Court and sheriff court. The amended fees have effect in respect of work carried out on or after 24th September 2018.
