Coming into force
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 56(1) of the Finance Act 19731 and all other powers enabling them to do so.
Citation, commencement and extent1

These Regulations may be cited as the Marketing of Fruit Plant and Propagating Material (Fees) (Scotland) Regulations 2018 and come into force on 1st July 2018.

These Regulations extend to Scotland only.
Interpretation2

In these Regulations “the 2017 Regulations” means the Marketing of Fruit Plant and Propagating Material (Scotland) Regulations 20172.

Other words and expressions used in these Regulations have the same meaning as in the 2017 Regulations.
Application of fees to matters set out in the schedule

Other than in relation to sampling and testing to which regulation 4 applies—
a
in respect of the matters set out in column 1 of Table 1 in the schedule (fees: official inspection: material grown in the field or in pots) a supplier must pay to the Scottish Ministers the fee specified in column 2 (material grown in the field or in pots) of that Table; and
b
in respect of the matters set out in column 1 of Table 2 in the schedule (fees: official inspection: material produced by micropropagation) a supplier must pay to the Scottish Ministers the fee specified in column 2 (material produced by micropropagation) of that Table.

This regulation applies in respect of sampling and testing under and in accordance with paragraph 11(1), 18(1) or 24(1) of schedule 2 of the 2017 Regulations.

In respect of the matters to which this regulation applies, a supplier must pay to the Scottish Ministers the fee specified in Table 3 in the schedule (fees: soil requirements: sampling and testing).
