The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c.46)</ref>.</p></authorialNote> and all other powers enabling them to do so.</p></formula></preamble><body><article eId="article-1"><heading>Citation and commencement</heading><num>1.</num><content><p>This Order may be cited as the Town and Country Planning (General Permitted Development) (Scotland) Amendment Order 2018 and comes into force on 1st July 2018.</p></content></article><article eId="article-2"><heading>Application</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>The amendments made by this Order do not apply to development begun before 1st July 2018.</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p>For the purposes of paragraph (1) development is to be taken to be begun on the earliest date on which any material operation (within the meaning of section 27(4) of the Town and Country Planning (Scotland) Act 1997) comprised in the development begins to be carried out.</p></content></paragraph></article><article eId="article-3"><heading>Amendment of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992</heading><num>3.</num><content><p>The Town and Country Planning (General Permitted Development) (Scotland) Order 1992<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1992/223">S.I. 1992/223</ref> which has been relevantly amended by <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1992/2084">S.I. 1992/2084</ref>, <ref eId="c00007" href="http://www.legislation.gov.uk/id/ssi/2012/131">S.S.I. 2012/131</ref> and <ref eId="c00008" href="http://www.legislation.gov.uk/id/ssi/2012/285">S.S.I. 2012/285</ref>.</p></authorialNote> is amended in accordance with articles 4 and 5.</p></content></article><article eId="article-4"><heading>Amendment of article 3</heading><num>4.</num><intro><p>In article 3 (permitted development)<authorialNote class="footnote" eId="f00003" marker="3"><p>Article 3(4A) was inserted by <ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/1992/2084">S.I. 1992/2084</ref>.</p></authorialNote>—</p></intro><level class="para1" eId="article-4-a"><num>(a)</num><content><p><mod>after paragraph (4A)(b) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(c)</num><content><p>in the case of a permission granted in connection with an existing fish farm, the placement or assembly of equipment forming that fish farm is unlawful.</p></content></level></quotedStructure><inline name="appendText"> and</inline></mod></p></content></level><level class="para1" eId="article-4-b"><num>(b)</num><content><p><mod>after paragraph (4A) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(4B)</num><intro><p>Paragraph (4A)(c) does not apply where—</p></intro><level class="para1"><num>(a)</num><content><p>the equipment in question is equipment of the same size, colour and design and is in the same location as the equipment which it replaces; or</b></p></content></level><level class="para1"><num>(c)</num><content><p><b>installing an additional mooring.</b></p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Development, other than where the development in question is the replacement of an existing mooring in the same location with a mooring of the same size, colour and design and that location is not within a European site or a nature conservation MPA, is permitted by this class subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><intro><p>the developer must before beginning the development apply to the planning authority for a determination as to whether the prior approval of the authority is required in respect of—</p></intro><level class="para2"><num>(i)</num><content><p>the size, colour and design of the mooring; and</p></content></level><level class="para2"><num>(ii)</num><content><p>its location;</p></content></level></level><level class="para1"><num>(b)</num><intro><p>the application is to be accompanied by—</p></intro><level class="para2"><num>(i)</num><content><p>a description of the proposed mooring, including details of its size, colour and design;</p></content></level><level class="para2"><num>(ii)</num><content><p>where the mooring is an additional mooring, a description of its proposed location;</p></content></level><level class="para2"><num>(iii)</num><content><p>a description of the area of the existing fish farm, including details of the coordinates of the anchorage or mooring point used in relation to the fish farm; and</p></content></level><level class="para2"><num>(iv)</num><content><p>any fee required to be paid;</p></content></level></level><level class="para1"><num>(c)</num><intro><p>the development is not to be commenced before the occurrence of one of the following—</p></intro><level class="para2"><num>(i)</num><content><p>the receipt by the applicant from the planning authority of a written notice of their determination that their prior approval is not required;</p></content></level><level class="para2"><num>(ii)</num><content><p>the expiry of a period of 28 days following the date on which the application was received by the planning authority without the planning authority giving notice to the applicant of their determination that, or the extent to which, such approval is required; or</p></content></level><level class="para2"><num>(iii)</num><content><p>the applicant has (or to the extent required has) received such approval from the planning authority;</p></content></level></level><level class="para1"><num>(d)</num><intro><p>the development must, except to the extent that the planning authority otherwise agree in writing, be carried out—</p></intro><level class="para2"><num>(i)</num><content><p>to the extent to which prior approval is required, in accordance with the details approved;</p></content></level><level class="para2"><num>(ii)</num><content><p>to the extent to which prior approval is not required, in accordance with the details submitted with the application; and</p></content></level></level><level class="para1"><num>(e)</num><content><p>the development is to be carried out within a period of three years from the date on which all approvals required in accordance with this paragraph have been given.</p></content></level></paragraph><paragraph><num>(3)</num><content><p>All development is permitted by this class subject to the condition that in the event of the equipment falling into disrepair or becoming damaged, adrift, stranded, abandoned or sunk in such a manner as to cause an obstruction or danger to navigation, such works (including lighting, buoying, raising, repairing, moving or destroying the whole or any part of that equipment) as may be needed to remove the obstruction or danger to navigation must be carried out.</p></content></paragraph><paragraph><num>(4)</num><content><p>In this class “nature conservation MPA” means an area designated as a nature conservation marine protected area by a designation order made by the Scottish Ministers under section 67 of the Marine (Scotland) Act 2010<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00012" href="http://www.legislation.gov.uk/id/asp/2010/5">2010 asp 5</ref>.</p></authorialNote>.</p></content></paragraph><p><b>Class 21H</b></p><paragraph><num>(1)</num><intro><p><b>The placing or assembly of equipment within the area of an existing fish farm for the purpose of replacing an existing finfish pen net in the same location with a finfish pen net—</b></p></intro><level class="para1"><num>(a)</num><content><p><b>of the same size, colour and design; or</b></p></content></level><level class="para1"><num>(b)</num><content><p><b>of the same size but of a different colour or design.</b></p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Where the development in question is either development described in paragraph (1)(a) within the area of a fallow fish farm or development described in paragraph (1)(b), the development is permitted by this class subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><content><p>the developer must before beginning the development apply to the planning authority for a determination as to whether the prior approval of the authority is required in respect of the colour and design of the finfish pen net;</p></content></level><level class="para1"><num>(b)</num><intro><p>the application is to be accompanied by—</p></intro><level class="para2"><num>(i)</num><content><p>a description of the proposed finfish pen net, including details of its size, colour and design;</p></content></level><level class="para2"><num>(ii)</num><content><p>a description of the area of the existing fish farm, including details of the coordinates of the anchorage or mooring point used in relation to the fish farm; and</p></content></level><level class="para2"><num>(iii)</num><content><p>any fee required to be paid;</p></content></level></level><level class="para1"><num>(c)</num><intro><p>the development is not to be commenced before the occurrence of one of the following—</p></intro><level class="para2"><num>(i)</num><content><p>the receipt by the applicant from the planning authority of a written notice of their determination that their prior approval is not required;</p></content></level><level class="para2"><num>(ii)</num><content><p>the expiry of a period of 28 days following the date on which the application was received by the planning authority without the planning authority giving notice to the applicant of their determination that, or the extent to which, such approval is required; and</p></content></level></level><level class="para1"><num>(e)</num><content><p>the development is to be carried out within a period of three years from the date on which all approvals required in accordance with this paragraph have been given.</p></content></level></paragraph><paragraph><num>(3)</num><content><p>All development is permitted by this class subject to the condition that in the event of the equipment falling into disrepair or becoming damaged, adrift, stranded, abandoned or sunk in such a manner as to cause an obstruction or danger to navigation, such works (including lighting, buoying, raising, repairing, moving or destroying the whole or any part of that equipment) as may be needed to remove the obstruction or danger to navigation must be carried out.</p></content></paragraph><p><b>Class 21I</b></p><paragraph><num>(1)</num><content><p><b>The placing or assembly of equipment within the area of an existing fish farm for the purpose of installing a secondary net structure</b></p></content></paragraph><paragraph><num>(2)</num><intro><p>Development is permitted by this class subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><content><p>the developer must before beginning the development apply to the planning authority for a determination as to whether the prior approval of the authority is required in respect of the size, colour and design of the secondary net structure;</p></content></level><level class="para1"><num>(b)</num><intro><p>the application is to be accompanied by—</p></intro><level class="para2"><num>(i)</num><content><p>a description of the proposed secondary net structure, including details of its size, colour and design;</p></content></level><level class="para2"><num>(ii)</num><content><p>a description of its proposed location;</p></content></level><level class="para2"><num>(iii)</num><content><p>a description of the area of the existing fish farm, including details of the coordinates of the anchorage or mooring point used in relation to the fish farm; and</p></content></level><level class="para2"><num>(iv)</num><content><p>any fee required to be paid;</p></content></level></level><level class="para1"><num>(c)</num><intro><p>the development is not to be commenced before the occurrence of one of the following—</p></intro><level class="para2"><num>(i)</num><content><p>the receipt by the applicant from the planning authority of a written notice of their determination that their prior approval is not required;</p></content></level><level class="para2"><num>(ii)</num><content><p>the expiry of a period of 28 days following the date on which the application was received by the planning authority without the planning authority giving notice to the applicant of their determination that, or the extent to which, such approval is required; or</p></content></level><level class="para2"><num>(iii)</num><content><p>the applicant has (or to the extent required has) received such approval from the planning authority;</p></content></level></level><level class="para1"><num>(d)</num><intro><p>the development must, except to the extent that the planning authority otherwise agree in writing, be carried out—</p></intro><level class="para2"><num>(i)</num><content><p>to the extent to which prior approval is required, in accordance with the details approved;</p></content></level><level class="para2"><num>(ii)</num><content><p>to the extent to which prior approval is not required, in accordance with the details submitted with the application;</p></content></level></level><level class="para1"><num>(e)</num><content><p>the development is to be carried out within a period of three years from the date on which all approvals required in accordance with this paragraph have been given; and</p></content></level><level class="para1"><num>(f)</num><content><p>in the event of the equipment falling into disrepair or becoming damaged, adrift, stranded, abandoned or sunk in such a manner as to cause an obstruction or danger to navigation, such works (including lighting, buoying, raising, repairing, moving or destroying the whole or any part of that equipment) as may be needed to remove the obstruction or danger to navigation must be carried out.</p></content></level></paragraph><paragraph><num>(7)</num><content><p>In this class, “secondary net structure” means a net structure including a sea lice skirt or predator net which is secondary to a main containing finfish pen net.</p></content></paragraph><p><b>Class 21J</b></p><paragraph><num>(1)</num><intro><p><b>The placing or assembly of equipment within the area of an existing shellfish farm for the purpose of—</b></p></intro><level class="para1"><num>(a)</num><intro><p><b>replacing an existing trestle, in the same or a different location, with a trestle of—</b></p></intro><level class="para2"><num>(i)</num><content><p><b>the same size, colour and design; or</b></p></content></level><level class="para2"><num>(ii)</num><content><p><b>a different size, colour or design;</b></p></content></level></level><level class="para1"><num>(b)</num><content><p><b>relocation of a trestle; or</b></p></content></level><level class="para1"><num>(c)</num><content><p><b>installing an additional trestle.</b></p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Development is not permitted by paragraph (1)(c) of this class if—</p></intro><level class="para1"><num>(a)</num><content><p>the area of the existing shellfish farm is greater than 2 hectares; or</p></content></level><level class="para1"><num>(b)</num><content><p>the installation of a trestle would result in more than a 10% increase in the number of trestles which are located within the area of the existing shellfish farm when compared with the number of trestles which comprise original equipment in relation to that shellfish farm.</p></content></level></paragraph><paragraph><num>(3)</num><intro><p>Development, other than where the development in question is the replacement of an existing trestle in the same location with a trestle of the same size, colour and design and is not within the area of a fallow fish farm, is permitted by this class subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><intro><p>the developer must before beginning the development apply to the planning authority for a determination as to whether the prior approval of the authority is required in respect of—</p></intro><level class="para2"><num>(i)</num><content><p>the size, colour and design of the trestle; and</p></content></level><level class="para2"><num>(ii)</num><content><p>its location;</p></content></level></level><level class="para1"><num>(b)</num><intro><p>the application is to be accompanied by—</p></intro><level class="para2"><num>(i)</num><content><p>a description of the proposed trestle, including details of its size, colour and design;</p></content></level><level class="para2"><num>(ii)</num><content><p>where the trestle is to be relocated, a description of both its current location within the area of the existing shellfish farm and its proposed location;</p></content></level><level class="para2"><num>(iii)</num><content><p>where the trestle is an additional trestle, a description of its proposed location;</p></content></level><level class="para2"><num>(iv)</num><content><p>a description of the area of the existing shellfish farm, including details of the coordinates of the anchorage or mooring point used in relation to the shellfish farm; and</p></content></level><level class="para2"><num>(v)</num><content><p>any fee required to be paid;</p></content></level></level><level class="para1"><num>(c)</num><intro><p>the development is not to be commenced before the occurrence of one of the following—</p></intro><level class="para2"><num>(i)</num><content><p>the receipt by the applicant from the planning authority of a written notice of their determination that their prior approval is not required;</p></content></level><level class="para2"><num>(ii)</num><content><p>the expiry of a period of 28 days following the date on which the application was received by the planning authority without the planning authority giving notice to the applicant of their determination that, or the extent to which, such approval is required; or</p></content></level><level class="para2"><num>(iii)</num><content><p>the applicant has (or to the extent required has) received such approval from the planning authority;</p></content></level></level><level class="para1"><num>(d)</num><intro><p>the development must, except to the extent that the planning authority otherwise agree in writing, be carried out—</p></intro><level class="para2"><num>(i)</num><content><p>to the extent to which prior approval is required, in accordance with the details approved;</p></content></level><level class="para2"><num>(ii)</num><content><p>to the extent to which prior approval is not required, in accordance with the details submitted with the application; and</p></content></level></level><level class="para1"><num>(e)</num><content><p>the development is to be carried out within a period of three years from the date on which all approvals required in accordance with this paragraph have been given.</p></content></level></paragraph><paragraph><num>(4)</num><content><p>All development is permitted by this class subject to the condition that in the event of the equipment falling into disrepair or becoming damaged, adrift, stranded, abandoned or sunk in such a manner as to cause an obstruction or danger to navigation, such works (including lighting, buoying, raising, repairing, moving or destroying the whole or any part of that equipment) as may be needed to remove the obstruction or danger to navigation must be carried out.</p></content></paragraph><paragraph><num>(5)</num><content><p>In this class “shellfish farm” means a fish farm which is used solely for the purpose of breeding, rearing or keeping shellfish.</p></content></paragraph></quotedStructure><inline name="appendText"> .</inline></mod></p></content></paragraph><paragraph eId="article-5-8"><num>(8)</num><intro><p>In the interpretation section of Part 6A—</p></intro><level class="para1" eId="article-5-8-a"><num>(a)</num><intro><p>in paragraph (1)—</p></intro><level class="para2" eId="article-5-8-a-i"><num>(i)</num><content><p><mod>before the definition of “equipment” insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><hcontainer name="definition"><content><p>“authorised mooring” means a mooring which is original equipment or which is placed or assembled by virtue of planning permission granted by Part 6A of this Order;</p></content></hcontainer></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para2" eId="article-5-8-a-ii"><num>(ii)</num><content><p><mod>after the definition of “fish farm” insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><hcontainer name="definition"><content><p>“fallow fish farm” means a fish farm treated as forming an existing fish farm by virtue of paragraph (1A);</p></content></hcontainer><hcontainer name="definition"><content><p>“finfish pen” means a tank or cage used for the purposes of fish farming other than for the breeding, rearing or keeping of shellfish (including any kind of sea urchin, crustacean or mollusc);</p></content></hcontainer><hcontainer name="definition"><content><p>“mooring” includes an anchor;</p></content></hcontainer></quotedStructure><inline name="appendText">;</inline></mod></p></content></level></level><level class="para1" eId="article-5-8-b"><num>(b)</num><content><p><mod>after paragraph (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(1A)</num><intro><p>Where—</p></intro><level class="para1"><num>(a)</num><content><p>before 1st July 2018 all equipment relating to a fish farm, other than one or more moorings, has been removed; or</p></content></level><level class="para1"><num>(b)</num><intro><p>on or after 1st July 2018 all equipment relating to a fish farm, other than three or more moorings, has been removed and the planning authority have been given notice in writing of—</p></intro><level class="para2"><num>(i)</num><content><p>the date on which the last item of such equipment was removed; and</p></content></level><level class="para2"><num>(ii)</num><content><p>the location of the remaining moorings,</p></content></level></level><wrapUp><p>then to the extent that the remaining mooring or moorings are authorised moorings, that remaining equipment is to be treated as forming an existing fish farm for a period of 9 years after the date on which the last item of such other equipment was removed notwithstanding the removal of that equipment.</p></wrapUp></paragraph><paragraph><num>(1B)</num><intro><p>In relation to placement or assembly of equipment for the purpose of replacement or relocation of equipment—</p></intro><level class="para1"><num>(a)</num><content><p>references to existing equipment are to be treated as including the removed equipment but in relation to replacement or placement or assembly of equipment in the area of a fallow fish farm only where no more than 9 years have passed since the equipment in question was removed; and</p></content></level><level class="para1"><num>(b)</num><content><p>references to the current location of the equipment which is to be relocated are references to the location of the equipment before it is removed or relocated.</p></content></level></paragraph></quotedStructure><inline name="appendText">; Article 4 amends article 3 of the 1992 Order to provide that, other than in the cases specified in new paragraph (4B), permitted development rights do not apply where the existing fish farm is the result of unlawful placement or assembly of equipment.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 5 amends Classes 21A, 21C and 21E, in particular to alter the conditions relating to the scale of permitted development and to remove the need for prior notification where there is like for like replacement of equipment. The range of changes of use permitted under Class 21F is extended. Article 5 also introduces new Classes 21AA, 21G to 21J into Part 6A of Schedule 1 to the 1992 Order. Class 21AA now deals with the like for like replacement of finfish pens in the same location previously dealt with under Class 21A. The other new classes extend permitted development rights, subject to conditions, to the placement or assembly of moorings, cage nets, secondary net structures and trestles used for the purposes of fish farming.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
