					<dc:description>The Tribunals (Scotland) Act 2014 created a new structure for tribunals dealing with devolved matters under the judicial leadership of the Lord President of the Court of Session as head of the Scottish Tribunals. It provided for a First-tier Tribunal and an Upper Tribunal and for the First-tier Tribunal to be divided into chambers dependent on the subject-matter of the case before it and similarly for the Upper Tribunal to be divided into divisions. The First-tier Tribunal has been divided into chambers, one of which is the general regulatory chamber. These Regulations provide for the rules of procedure which are to apply in that chamber when hearing charity appeals, which are set out in the schedule of the regulations. Paragraph 4 of schedule 9 of the Tribunals (Scotland) Act 2014 enables the Scottish Ministers, by regulations, to make Tribunal Rules until such time as the provisions conferring responsibility on the Scottish Civil Justice Council and the Court of Session for the making of Tribunal Rules are commenced.</dc:description>

<Text>The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraph 4(2) of schedule 9 of the Tribunals (Scotland) Act 2014<FootnoteRef Ref="f00001"/> and all other powers enabling them to do so.</Text></P>

IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2" id="schedule-paragraph-2-2"><Pnumber>2</Pnumber><P2para><Text>Dealing with proceedings fairly and justly includes—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/2/2/a" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2/a" id="schedule-paragraph-2-2-a"><Pnumber>a</Pnumber><P3para><Text>dealing with the proceedings in a manner which is proportionate to the complexity of the issues and the resources of the parties;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/2/2/b" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2/b" id="schedule-paragraph-2-2-b"><Pnumber>b</Pnumber><P3para><Text>avoiding unnecessary formality and seeking flexibility in the proceedings;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/2/2/c" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2/c" id="schedule-paragraph-2-2-c"><Pnumber>c</Pnumber><P3para><Text>ensuring so far as practicable, that the parties are able to participate fully in proceedings;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/2/2/d" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2/d" id="schedule-paragraph-2-2-d"><Pnumber>d</Pnumber><P3para><Text>using any special expertise of the First-tier Tribunal effectively; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/2/2/e" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/2/2/e" id="schedule-paragraph-2-2-e"><Pnumber>e</Pnumber><P3para><Text>avoiding delay, so far as compatible with proper consideration of the issues.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Application by First-tier Tribunal of the overriding objective</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/3" id="schedule-paragraph-3"><Pnumber><CommentaryRef Ref="key-727566907c9b098591c7f9c75ff4d551"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/3/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/3/1" id="schedule-paragraph-3-1"><Pnumber>1</Pnumber><P2para><Text>The First-tier Tribunal must seek to give effect to the such form, and in accordance with such intimation requirements on other parties to proceedings (including any other relevant authorities) as the First-tier Tribunal may IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/3A/9" id="schedule-paragraph-3A-9"><Pnumber><Addition ChangeId="key-c6bb7977697950e9d1e550616fe874d6-1779267516996" CommentaryRef="key-c6bb7977697950e9d1e550616fe874d6">9</Addition></Pnumber><P2para><Text><Addition ChangeId="key-c6bb7977697950e9d1e550616fe874d6-1779267516996" CommentaryRef="key-c6bb7977697950e9d1e550616fe874d6">The First-tier Tribunal may sist proceedings if it considers it necessary to do so while the compatibility question is being IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/3A/10" id="schedule-paragraph-3A-10"><Pnumber><Addition ChangeId="key-c6bb7977697950e9d1e550616fe874d6-1779267516996" CommentaryRef="key-c6bb7977697950e9d1e550616fe874d6">Where a relevant authority does not take part as a party to proceedings at first instance, the relevant authority is not precluded from intervening in any subsequent appeal to the Upper Tribunal, so far as those proceedings relate to a compatibility question.</Addition></Text></P2para></P2><P2 the relevant authority of this as soon as practicable.</Addition></Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Delegation to staff</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/4" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/4" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/4/1" id="schedule-paragraph-4-1"><Pnumber>1</Pnumber><P2para><Text>Staff of the Scottish Courts and Tribunals Service with appropriate legal qualifications may, with the approval of the Chamber President, carry out functions of a judicial nature permitted or required to be done by the First-tier Tribunal provided the functions are of a preliminary or incidental nature.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/4/2" or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/11/2/c" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/11/2/c" id="schedule-paragraph-11-3"><Pnumber>3</Pnumber><P2para><Text>The First-tier Tribunal may consent to a witness giving, or require any witness to give, evidence on oath, and may administer an oath for that purpose.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Sending and delivery of documents</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/12" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/12" id="schedule-paragraph-12"><Pnumber><CommentaryRef Ref="key-a2ebc616e1526e32145aeac7387669fa"/>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/12/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/12/1" id="schedule-paragraph-12-1"><Pnumber>1</Pnumber><P2para><Text>Any document to be provided to the First-tier Tribunal under these Rules, a practice direction or an order must be—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/12/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/12/1/a" id="schedule-paragraph-12-1-a"><Pnumber>a</Pnumber><P3para><Text>sent by pre-paid post or document exchange, or provides a fax number, email address or other details for the electronic transmission of documents to them, that party or representative must accept delivery of documents by that id="schedule-paragraph-12-3"><Pnumber>3</Pnumber><P2para><Text>If a party informs the First-tier Tribunal and all other parties that a particular form of communication (other than pre-paid post or delivery by hand) should not be used to provide documents to that party, that form of communication must not be so used.</Text></P2para></P2><P2 the hearing of the parties and witnesses, the bringing of documents, the right of representation, the right of assistance by a supporter and the procedure applicable to the hearing, having regard to IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/14/1" id="schedule-paragraph-14-1"><Pnumber>1</Pnumber><P2para><Text>Where either party to the appeal informs the First-tier Tribunal that it does not intend to appear at the hearing, the First-tier Tribunal shall determine a date by which that party may provide further written submissions to be considered at the hearing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/14/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/14/2" at or after the beginning of a hearing, a member of the First-tier Tribunal other than the chairing member is absent, the appeal may, with the consent of the parties, be heard by the other two members id="schedule-paragraph-16-1"><Pnumber>1</Pnumber><P2para><Text>A party may be represented in any proceedings by a legal representative or lay representative whose details must be communicated to the First-tier Tribunal prior to any hearing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/16/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/16/2" id="schedule-paragraph-16-2"><Pnumber>2</Pnumber><P2para><Text>A party may disclose any document or communicate any information about the proceedings to that party’s legal representative or lay representative without contravening any prohibition or restriction on disclosure of the document or information.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/16/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/16/3" id="schedule-paragraph-16-3"><Pnumber>3</Pnumber><P2para><Text>Where a document or information is disclosed under paragraph (2), the legal representative or lay representative is subject to any prohibition or restriction on disclosure in the same way that the party is.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/16/4" send all documents and notices concerning references or claims to the representative instead of the party.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Supporters</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/17" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/17" id="schedule-paragraph-17"><Pnumber><CommentaryRef Ref="key-fdbb42c32ba86c314198bd4dcca6a487"/>17</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/17/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/17/1" id="schedule-paragraph-17-1"><Pnumber>1</Pnumber><P2para><Text>A party who is an individual may be accompanied by another person to act as a supporter.</Text></P2para></P2><P2 information about the proceedings to that party’s supporter without contravening any prohibition or restriction on disclosure of the document or information.</Text></P2para></P2><P2 id="schedule-paragraph-18"><Pnumber><CommentaryRef Ref="key-243ade812fbec1f66f0d25767a223ed6"/>18</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/18/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/18/1" id="schedule-paragraph-18-1"><Pnumber>1</Pnumber><P2para><Text>If a party fails to be present or represented at a hearing, the First-tier Tribunal may, if it is satisfied that the party was duly notified of the hearing and is not aware of any good reason for such absence<Strong>—</Strong></Text><P3 a party, the First-tier Tribunal must consider any representations in writing submitted by that party.</Text></P2para></P2><P2 id="schedule-paragraph-19-1"><Pnumber>1</Pnumber><P2para><Text>A hearing must be held in public unless the First-tier Tribunal, on its own initiative or on an application by a party, decides that in the interests of justice, it is necessary to do otherwise.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/19/2" recording, visual recording or any other recording at any hearing if satisfied that, in the interests of justice, such a prohibition is required</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Exclusion of persons disrupting proceedings</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/20" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/20" id="schedule-paragraph-20"><Pnumber><CommentaryRef Ref="key-5015af3e3ff582cb41d4e329ed31eebc"/>20</Pnumber><P1para><P2 id="schedule-paragraph-20-1"><Pnumber>1</Pnumber><P2para><Text>Without prejudice to any other powers it has, the First-tier Tribunal may exclude from any hearing, or part of it,—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/20/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/20/1/a" id="schedule-paragraph-20-1-a"><Pnumber>a</Pnumber><P3para><Text>any person (including a party, a representative or supporter) whose conduct has disrupted or is likely, in the opinion of the First-tier Tribunal, to disrupt the hearing;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/20/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/20/1/b" id="schedule-paragraph-20-1-b"><Pnumber>b</Pnumber><P3para><Text>any person (including a party, a representative or supporter) whose presence the First-tier Tribunal considers is likely to prevent another person from giving evidence or making submissions freely.</Text></P3para></P3></P2para></P2><P2 id="schedule-paragraph-20-2"><Pnumber>2</Pnumber><P2para><Text>In deciding whether to exercise the power conferred by paragraph (1) the First-tier Tribunal must, apart from other considerations, have id="schedule-paragraph-20-2-b"><Pnumber>b</Pnumber><P3para><Text>in the case of the exclusion of a party or a representative, whether the party will be adequately IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/20/3" id="schedule-paragraph-20-3"><Pnumber>3</Pnumber><P2para><Text>If the First-tier Tribunal decides to exclude a party it must allow the representative of that party sufficient opportunity to consult the party.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Orders</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21" id="schedule-paragraph-21"><Pnumber><CommentaryRef Ref="key-cf0802fe61c2923d51cd4b1d465597fe"/>21</Pnumber><P1para><P2 id="schedule-paragraph-21-1"><Pnumber>1</Pnumber><P2para><Text>At any stage of the proceedings the First-tier Tribunal may, either on its own cause or on the application of a party, make such orders as it considers necessary for the hearing of the appeal and in particular may order—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/1/a" id="schedule-paragraph-21-1-a"><Pnumber>a</Pnumber><P3para><Text>a party to provide any further particulars, supplementary statements or documents which may reasonably be required;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/1/b" id="schedule-paragraph-21-1-b"><Pnumber>b</Pnumber><P3para><Text>a party which has access to information which is not reasonably available to the other party, to prepare and file a document recording the information;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/1/c" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/1/c" id="schedule-paragraph-21-1-c"><Pnumber>c</Pnumber><P3para><Text>a party to set out the issues upon which the First-tier Tribunal requires to hear evidence;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/1/d" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/1/d" id="schedule-paragraph-21-1-d"><Pnumber>d</Pnumber><P3para><Text>that evidence should be excluded if the evidence is irrelevant, unnecessary or improperly obtained;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/1/e" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/1/e" id="schedule-paragraph-21-1-e"><Pnumber>e</Pnumber><P3para><Text>a party to lodge, before the hearing, an outline argument.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/2" id="schedule-paragraph-21-2"><Pnumber>2</Pnumber><P2para><Text>An application by a party for an order under paragraph (1) (otherwise than during a hearing) must, not later than 7 days before the hearing, be made to the First-tier Tribunal in writing and must set out the order which the party is seeking to have made together with the reasons for the application.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/3" id="schedule-paragraph-21-3"><Pnumber>3</Pnumber><P2para><Text>If a party objects to the order sought, the First-tier Tribunal must consider the objection and, if it considers it necessary for deciding the application, must give the parties an opportunity of being present or represented before the First-tier Tribunal.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/4" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/4" id="schedule-paragraph-21-4"><Pnumber>4</Pnumber><P2para><Text>For the purposes of this rule, a party is not obliged to produce a document which that party would be entitled to refuse to produce in civil proceedings before a court in Scotland.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/21/5" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/21/5" id="schedule-paragraph-21-5"><Pnumber>5</Pnumber><P2para><Text>In giving effect to this rule, the First-tier Tribunal must take into account the need to protect any matter that relates to personal or financial circumstances, is commercially sensitive or consists of information communicated or obtained in confidence.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Alteration of arrangements for hearing and adjournments</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22" id="schedule-paragraph-22"><Pnumber><CommentaryRef Ref="key-6e6396aaf1df11ece29a246c97ae7346"/>22</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22/1" id="schedule-paragraph-22-1"><Pnumber>1</Pnumber><P2para><Text>The First-tier Tribunal may, prior to commencement of the hearing, alter the date, time or place of any hearing and the First-tier Tribunal must give the parties not less than 14 days’ notice of any such alteration unless—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22/1/a" id="schedule-paragraph-22-1-a"><Pnumber>a</Pnumber><P3para><Text>a shorter period of notice is agreed by the parties; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22/1/b" id="schedule-paragraph-22-1-b"><Pnumber>b</Pnumber><P3para><Text>the requirement to alter the date of the hearing is due to the illness of a member of the First-tier Tribunal or other exceptional circumstance which affects the availability of a member of the First-tier Tribunal to attend the hearing.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22/2" id="schedule-paragraph-22-2"><Pnumber>2</Pnumber><P2para><Text>If the First-tier Tribunal alters the date of the hearing under paragraph (1), that date must not, unless the parties agree, be before the date fixed in terms of rule 13(1).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/22/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/22/3" id="schedule-paragraph-22-3"><Pnumber>3</Pnumber><P2para><Text>The First-tier Tribunal may from time to time adjourn the hearing and, if the date, time and place of the adjourned hearing are announced before the adjournment, no further notice shall be required.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Persons entitled to be present</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/23" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/23" id="schedule-paragraph-23"><Pnumber><CommentaryRef Ref="key-dbfe25b2c59ee0e6b778f0029bdc2ccf"/>23</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/23/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/23/1" id="schedule-paragraph-23-1"><Pnumber>1</Pnumber><P2para><Text>Subject to rule 20 the following persons shall be entitled to attend a hearing whether or not it is in private—</Text><P3 id="schedule-paragraph-23-1-b"><Pnumber>b</Pnumber><P3para><Text>a member of staff of the Scottish Courts and Tribunals Service; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/23/1/c" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/23/1/c" id="schedule-paragraph-23-1-c"><Pnumber>c</Pnumber><P3para><Text>any other person permitted by the First-tier Tribunal with the consent of the parties.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/23/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/23/2" id="schedule-paragraph-23-2"><Pnumber>2</Pnumber><P2para><Text>None of the persons specified above who are present at the First-tier Tribunal’s deliberations may take any part in those deliberations.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/23/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/23/3" id="schedule-paragraph-23-3"><Pnumber>3</Pnumber><P2para><Text>Where the First-tier Tribunal sits in private it may admit persons to the hearing on such terms and conditions as it considers appropriate.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Expenses</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/24" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/24" id="schedule-paragraph-24"><Pnumber><CommentaryRef Ref="key-2efa3887241c877d5436a23e3fe1314d"/>24</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/24/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/24/1" id="schedule-paragraph-24-1"><Pnumber>1</Pnumber><P2para><Text>The First-tier Tribunal may make an order for expenses as taxed by the Auditor of the Court of Session against a party if that party’s act, omission or other conduct has caused any other party to incur expense which it would be unreasonable for that other party to be expected to pay, with the maximum recoverable expenses being the expenses incurred.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/24/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/24/2" id="schedule-paragraph-24-2"><Pnumber>2</Pnumber><P2para><Text>The First-tier Tribunal, of its own initiative or on the application of a party or the parties, may in exceptional circumstances fix by order a sum payable by a party in discharge of an award of expenses.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="S" RestrictStartDate="2018-01-12"><Title>Decisions of the First-tier Tribunal</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25" id="schedule-paragraph-25"><Pnumber><CommentaryRef Ref="key-29f873801c939f71f500ac4bb63ddf18"/>25</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/1" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/1" id="schedule-paragraph-25-1"><Pnumber>1</Pnumber><P2para><Text>A decision of the First-tier Tribunal may be taken by a majority and the decision must record whether it was unanimous or taken by a majority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/2" id="schedule-paragraph-25-2"><Pnumber>2</Pnumber><P2para><Text>Where the First-tier Tribunal is constituted by two members, the chairing member shall have a second vote.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/3" id="schedule-paragraph-25-3"><Pnumber>3</Pnumber><P2para><Text>A decision of the First-tier Tribunal may be given at the end of the hearing or within 30 days of the hearing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/4" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/4" id="schedule-paragraph-25-4"><Pnumber>4</Pnumber><P2para><Text>The decision must be recorded as soon as possible in a decision document which must also contain a statement of reasons for the decision and be signed by the chairing member and dated.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/5" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/5" id="schedule-paragraph-25-5"><Pnumber>5</Pnumber><P2para><Text>The First-tier Tribunal must send a copy of the decision to each party to the appeal together with a notice explaining the rights of the parties to appeal the decision of the First-tier Tribunal and the time within which, and the manner in which, the right of appeal may be exercised.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/25/6" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/25/6" id="schedule-paragraph-25-6"><Pnumber>6</Pnumber><P2para><Text>Except where a decision is announced at the end of the hearing, it shall be treated as having been made on the date on which the chairing member signs the decision.</Text></P2para></P2><P2 id="schedule-paragraph-26-1"><Pnumber>1</Pnumber><P2para><Text>The First-tier Tribunal must make arrangements for the public pronouncement of its decisions, whether by giving its decisions orally at a public hearing or by publishing its decisions in writing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/26/2" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/26/2" id="schedule-paragraph-26-2"><Pnumber>2</Pnumber><P2para><Text>Where the First-tier Tribunal has made an order in terms of rule 25(7), the First-tier Tribunal may make any necessary amendments to the text of the decision for the purposes of publication.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/26/3" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/26/3" id="schedule-paragraph-26-3"><Pnumber>3</Pnumber><P2para><Text>Where any decision refers to any evidence that has been heard in private, the material relating to that evidence must be omitted from the decision and the First-tier Tribunal may make any necessary amendments to the text of the decision for the purposes of publication.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/26/4" IdURI="http://www.legislation.gov.uk/id/ssi/2017/364/schedule/paragraph/26/4" RestrictStartDate="2018-01-12"><Title>The register</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2017/364/schedule/paragraph/27" reviewed at a hearing unless the First-tier Tribunal considers, having regard to any response to the notice provided under paragraph (4), that a hearing is not necessary in the interests of <Title>EXPLANATORY NOTE</Title>

<P><Text>The Tribunals (Scotland) Act 2014 created a new structure for tribunals dealing with devolved matters under the judicial leadership of the Lord President of the Court of Session as head of the Scottish Tribunals. It provided for a <Abbreviation Expansion="First-tier Tribunal for Scotland General Regulatory Chamber">First-tier Tribunal</Abbreviation> and an Upper Tribunal and for the First-tier Tribunal to be divided into chambers dependent on the subject-matter of the case before it and similarly for the Upper Tribunal to be divided into divisions. The First-tier Tribunal has been divided into chambers, one of which is the general regulatory chamber. These Regulations provide for the rules of procedure which are to apply in that chamber when hearing charity appeals, which are set out in the schedule of the regulations. Paragraph 4 of schedule 9 of the Tribunals (Scotland) Act 2014 enables the Scottish Ministers, by regulations, to make Tribunal Rules until such time as the provisions conferring responsibility on the Scottish Civil Justice Council and the Court of Session for the making of Tribunal Rules are commenced.</Text></P>
