leadership of the Lord President of the Court of Session as head of the Scottish Tribunals. It provided for a First-tier Tribunal and an Upper Tribunal and for the First-tier Tribunal to be divided into chambers dependent on the subject-matter of the case before it and similarly for the Upper Tribunal to be divided into divisions. The First-tier Tribunal has been divided into chambers, one of which is the general regulatory chamber. These Regulations provide for the rules of procedure which are to apply in that chamber when hearing charity appeals, which are set out in the schedule of the regulations. Paragraph 4 of schedule 9 of the Tribunals (Scotland) Act 2014 enables the Scottish Ministers, by regulations, to make Tribunal Rules until such time as the provisions conferring responsibility on the ukl:ChangeId="key-ff67da8a25207608c7dddf9bfe607ecd-1779267516996" ukl:CommentaryRef="key-ff67da8a25207608c7dddf9bfe607ecd">” has the meaning given by section 31(1) of the 2024 Act;</ins></p></content></hcontainer><hcontainer name="definition"><content><p>“decision” means a decision of OSCR referred to in section 76(1) of the 2005 Act unless the context requires otherwise;</p></content></hcontainer><hcontainer name="definition"><content><p>“electronic communication” has the meaning given to it by section 15(1) of the Electronic</p></content></hcontainer><hcontainer name="definition"><content><p>Communications Act 2000<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/2000/7">2000 c.7</ref>, as amended by paragraph 158 of schedule 17 of the Communications Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/2003/21">2003 (c.21)</ref>.</p></authorialNote> and “electronic signature” has the same meaning as in section 7</p><p>of that Act<authorialNote class="footnote" eId="f00005" marker="5"><p>Section 7 was amended by paragraph 1 of schedule 3 of the Electronic Identification and Trust Services for Electronic Transaction Regulations <ref eId="c00005" href="http://www.legislation.gov.uk/id/ssi/2016/696">2016/696</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“First-tier Tribunal” means the First-tier Tribunal for Scotland General Regulatory Chamber;</p></content></hcontainer><hcontainer name="definition"><content><p>“hearing” means a sitting of the First-tier Tribunal for the ukl:CommentaryRef="key-9410a4d04dda2d398a17cd9073af30ef">” means the Lord Advocate, the Commissioner for Children and Young People in Scotland or the Scottish Commission for Human Rights;</ins></p></content></hcontainer><hcontainer name="definition"><content><p>“review” means the internal review provided for by section 43(1) of the 2014 Act.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e273"><heading>Overriding objective</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-paragraph-2-1"><num>(1)</num><content><p>The overriding objective of the First-tier Tribunal is to deal with the proceedings fairly and justly.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-2"><num>(2)</num><intro><p>Dealing with proceedings fairly and justly includes—</p></intro><level class="para1" eId="schedule-paragraph-2-2-a"><num>(a)</num><content><p>dealing with the proceedings in a manner which is proportionate to the complexity of the issues and the resources of the parties;</p></content></level><level class="para1" eId="schedule-paragraph-2-2-b"><num>(b)</num><content><p>avoiding unnecessary formality and seeking flexibility in the proceedings;</p></content></level><level class="para1" eId="schedule-paragraph-2-2-c"><num>(c)</num><content><p>ensuring so far as practicable, that the parties are able to participate fully in proceedings;</p></content></level><level class="para1" eId="schedule-paragraph-2-2-d"><num>(d)</num><content><p>using any special expertise of the First-tier Tribunal effectively; and</p></content></level><level class="para1" eId="schedule-paragraph-2-2-e"><num>(e)</num><content><p>avoiding delay, so far as compatible with proper consideration of the issues.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e323"><heading>Application by First-tier Tribunal of the overriding objective</heading><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3.</num><subparagraph eId="schedule-paragraph-3-1"><num>(1)</num><intro><p>The First-tier Tribunal must seek to give effect to the overriding objective when it—</p></intro><level class="para1" eId="schedule-paragraph-3-1-a"><num>(a)</num><content><p>exercises any power under these Rules; or</p></content></level><level class="para1" eId="schedule-paragraph-3-1-b"><num>(b)</num><content><p>interprets any rule.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><content><p>In particular the First-tier Tribunal must manage appeals actively in accordance with the overriding objective.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e355"><heading><ins class="first" class="commentary"/>Compatibility question under the 2024 Act - raising, intimation and notice</ins></heading><paragraph eId="schedule-paragraph-3A" class="schProv1"><num><ins the relevant authority of this as soon as practicable.</ins></p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e567"><heading>Delegation to staff</heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><content><p>Staff of the Scottish Courts and Tribunals Service with appropriate legal qualifications may, with the approval of the Chamber President, carry out functions of a judicial nature permitted or required to be done by the First-tier Tribunal provided the functions are of a preliminary or incidental nature.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><content><p>The approval referred to at paragraph (1) may apply generally to the carrying out of specified functions by members of staff of a specified description in specified circumstances.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e587"><heading>Notice of appeal</heading><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5.</num><subparagraph eId="schedule-paragraph-5-1"><num>(1)</num><content><p>An appeal to the First-tier Tribunal in terms of section 76 of the 2005 Act shall be made by giving notice in writing in accordance with the following paragraphs.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-2"><num>(2)</num><intro><p>The notice shall be addressed to the First-tier Tribunal and shall include—</p></intro><level class="para1" eId="schedule-paragraph-5-2-a"><num>(a)</num><content><p>the name and address of the appellant;</p></content></level><level class="para1" eId="schedule-paragraph-5-2-b"><num>(b)</num><content><p>the date and, if known, the reference number of the decision against which the appeal is made;</p></content></level><level class="para1" eId="schedule-paragraph-5-2-c"><num>(c)</num><content><p>the name and address of the representative of the appellant (if any);</p></content></level><level class="para1" eId="schedule-paragraph-5-2-d"><num>(d)</num><content><p>a brief statement setting out the reasons for the appeal; and</p></content></level><level class="para1" eId="schedule-paragraph-5-2-e"><num>(e)</num><content><p>a statement that the notice is a notice of appeal.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-5-3"><num>(3)</num><content><p>The appellant or the representative of the appellant (if any) must sign the notice of appeal.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e643"><heading>Confirmation of appeal by the First-tier Tribunal</heading><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6.</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><intro><p>Within 14 days of receipt of the notice of appeal, the First-tier Tribunal shall–</p></intro><level class="para1" eId="schedule-paragraph-6-1-a"><num>(a)</num><content><p>send an acknowledgement of receipt of the notice of appeal to the appellant;</p></content></level><level class="para1" eId="schedule-paragraph-6-1-b"><num>(b)</num><content><p>enter the particulars of the appeal referred to in rule 5(2)(a) and (b) in the register; and</p></content></level><level class="para1" eId="schedule-paragraph-6-1-c"><num>(c)</num><intro><p>advise the appellant and OSCR, in writing, of the following—</p></intro><level class="para2" eId="schedule-paragraph-6-1-c-i"><num>(i)</num><content><p>the case number of the appeal;</p></content></level><level class="para2" eId="schedule-paragraph-6-1-c-ii"><num>(ii)</num><content><p>the date by which the appellant may submit written representations to the First-tier Tribunal together with copies of all documentation provided to OSCR for the purpose of OSCR reaching the decision against which the appeal is made; and</p></content></level><level class="para2" eId="schedule-paragraph-6-1-c-iii"><num>(iii)</num><content><p>the date by which OSCR may make written representations to the First-tier Tribunal and by which it must send to the First-tier Tribunal an authenticated copy of the decision against which the appeal is made.</p></content></level></level></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><content><p>The date referred to in (1)(c)(ii) is to be no later than 28 days after the date of acknowledgement of receipt of the appeal.</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><content><p>The date referred to in (1)(c)(iii) is to be no later than 42 days after the date of acknowledgement of receipt of the appeal.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e705"><heading>Appeal documents</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7.</num><content><p>The First-tier Tribunal must as soon as possible after receipt of any document from a party to proceedings, send a copy of that document to the other party.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e715"><heading>Withdrawal of appeal</heading><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-paragraph-8-1"><num>(1)</num><intro><p>The appellant may withdraw the appeal<b>—</b></p></intro><level class="para1" eId="schedule-paragraph-8-1-a"><num>(a)</num><content><p>at any time before the hearing of the appeal by sending a notice of withdrawal to the First-tier Tribunal; or</p></content></level><level class="para1" eId="schedule-paragraph-8-1-b"><num>(b)</num><content><p>at the hearing of the appeal.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-8-2"><num>(2)</num><content><p>Where an appeal is withdrawn, no further appeal may be made in relation to the same decision.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e749"><heading>Withdrawal of response by OSCR</heading><paragraph eId="schedule-paragraph-9" class="schProv1"><num>9.</num><intro><p>OSCR may give notice to the First-tier Tribunal of the withdrawal of its response and opposition to the appeal<b>—</b></p></intro><level class="para1" eId="schedule-paragraph-9-a"><num>(a)</num><content><p>at any time before the hearing of the appeal by sending a notice of withdrawal to the First-tier Tribunal; or</p></content></level><level class="para1" eId="schedule-paragraph-9-b"><num>(b)</num><content><p>at the hearing of the appeal.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e773"><heading>Additional, substitution and removal of parties</heading><paragraph eId="schedule-paragraph-10" class="schProv1"><num>10.</num><subparagraph eId="schedule-paragraph-10-1"><num>(1)</num><intro><p>The First-tier Tribunal may give an order adding, substituting or removing a party as an appellant or a respondent including where—</p></intro><level class="para1" eId="schedule-paragraph-10-1-a"><num>(a)</num><content><p>the wrong person has been named as a party; or</p></content></level><level class="para1" eId="schedule-paragraph-10-1-b"><num>(b)</num><content><p>the addition, substitution or removal has become necessary because of a change in circumstances since the start of proceedings.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-10-2"><num>(2)</num><content><p>If the First-tier Tribunal makes an order under paragraph (1) it may make such consequential orders as it considers appropriate.</p></content></subparagraph><subparagraph eId="schedule-paragraph-10-3"><num>(3)</num><content><p>A person who is not a party may make a written application to the First-tier Tribunal to be added or substituted as a party under this rule.</p></content></subparagraph><subparagraph eId="schedule-paragraph-10-4"><num>(4)</num><content><p>If the First-tier Tribunal refuses an application under paragraph (3) it must consider whether to permit the person who made the application to provide submissions or evidence to the First-tier Tribunal.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e818"><heading>Evidence and submissions</heading><paragraph eId="schedule-paragraph-11" class="schProv1"><num>11.</num><subparagraph eId="schedule-paragraph-11-1"><num>(1)</num><intro><p>The First-tier Tribunal may give orders as to—</p></intro><level class="para1" eId="schedule-paragraph-11-1-a"><num>(a)</num><content><p>issues on which it requires evidence or submissions;</p></content></level><level class="para1" eId="schedule-paragraph-11-1-b"><num>(b)</num><content><p>the nature of any such evidence;</p></content></level><level class="para1" eId="schedule-paragraph-11-1-c"><num>(c)</num><content><p>whether the parties are permitted or required to provide expert evidence, and if so whether the parties must jointly appoint a single expert to provide such evidence;</p></content></level><level class="para1" eId="schedule-paragraph-11-1-d"><num>(d)</num><content><p>any limit on the number of witnesses whose evidence a party may put forward, whether in relation to a particular issue or generally;</p></content></level><level class="para1" eId="schedule-paragraph-11-1-e"><num>(e)</num><intro><p>the manner in which any evidence or submissions are to be provided, which may include an order for them to be given—</p></intro><level class="para2" eId="schedule-paragraph-11-1-e-i"><num>(i)</num><content><p>orally at a hearing; or</p></content></level><level class="para2" eId="schedule-paragraph-11-1-e-ii"><num>(ii)</num><content><p>by written submissions or witness statement; and</p></content></level></level><level class="para1" eId="schedule-paragraph-11-1-f"><num>(f)</num><content><p>the time at which any evidence or submissions are to be provided.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-11-2"><num>(2)</num><intro><p>The First-tier Tribunal may exclude evidence that would otherwise be admissible where—</p></intro><level class="para1" eId="schedule-paragraph-11-2-a"><num>(a)</num><content><p>the evidence was not, without reasonable excuse, provided within the time allowed by an order or a practice direction;</p></content></level><level class="para1" eId="schedule-paragraph-11-2-b"><num>(b)</num><content><p>the evidence was otherwise, without reasonable excuse, provided in a manner that did not comply with an order or a practice direction; or</p></content></level><level class="para1" eId="schedule-paragraph-11-2-c"><num>(c)</num><content><p>it would otherwise be unfair to admit the evidence.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-11-3"><num>(3)</num><content><p>The First-tier Tribunal may consent to a witness giving, or require any witness to give, evidence on oath, and may administer an oath for that purpose.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e910"><heading>Sending and delivery of documents</heading><paragraph eId="schedule-paragraph-12" class="schProv1"><num>12.</num><subparagraph eId="schedule-paragraph-12-1"><num>(1)</num><intro><p>Any document to be provided to the First-tier Tribunal under these Rules, a practice direction or an order must be—</p></intro><level class="para1" eId="schedule-paragraph-12-1-a"><num>(a)</num><content><p>sent by pre-paid post or document exchange, or delivered by hand, to the address of the First-tier Tribunal; or</p></content></level><level class="para1" eId="schedule-paragraph-12-1-b"><num>(b)</num><content><p>sent or delivered by such other method as the First-tier Tribunal may permit or order.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-12-2"><num>(2)</num><content><p>Subject to paragraph (3), if a party or representative provides a fax number, email address or other details for the electronic transmission of documents to them, that party or representative must accept delivery of documents by that method.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-3"><num>(3)</num><content><p>If a party informs the First-tier Tribunal and all other parties that a particular form of communication (other than pre-paid post or delivery by hand) should not be used to provide documents to that party, that form of communication must not be so used.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-4"><num>(4)</num><content><p>If the First-tier Tribunal or a party sends a document to a party or the First-tier Tribunal by email or any other electronic means of communication, the recipient may request that the sender provide a hard copy of the document to the recipient. The recipient must make such a request as soon as reasonably practicable after receiving the document electronically.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-5"><num>(5)</num><content><p>The First-tier Tribunal and each party may assume that the address provided by a party or its representative is and remains the address to which documents should be sent or delivered until receiving notification to the contrary.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e960"><heading>Notice of hearing</heading><paragraph eId="schedule-paragraph-13" class="schProv1"><num>13.</num><subparagraph eId="schedule-paragraph-13-1"><num>(1)</num><content><p>The First-tier Tribunal must give each party entitled to attend a hearing reasonable notice of the time and place of any hearing and not less than 14 days before the date so fixed, send to each party a notice of hearing.</p></content></subparagraph><subparagraph eId="schedule-paragraph-13-2"><num>(2)</num><intro><p>The notice of hearing must state<b>—</b></p></intro><level class="para1" eId="schedule-paragraph-13-2-a"><num>(a)</num><content><p>the date, time and place of the hearing;</p></content></level><level class="para1" eId="schedule-paragraph-13-2-b"><num>(b)</num><content><p>the members of the First-tier Tribunal hearing the case; and</p></content></level><level class="para1" eId="schedule-paragraph-13-2-c"><num>(c)</num><content><p>the manner and order of proceedings, having regard to any applicable burden and standard of proof and rules of evidence.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-13-3"><num>(3)</num><intro><p>The notice of hearing should, where appropriate<b>—</b></p></intro><level class="para1" eId="schedule-paragraph-13-3-a"><num>(a)</num><content><p>provide information and guidance as to attendance at the hearing of the parties and witnesses, the bringing of documents, the right of representation, the right of assistance by a supporter and the procedure applicable to the hearing, having regard to any applicable rules of evidence and burden and standard of proof;</p></content></level><level class="para1" eId="schedule-paragraph-13-3-b"><num>(b)</num><content><p>explain the right of the parties to receive reasons in writing for a decision of the First-tier Tribunal;</p></content></level><level class="para1" eId="schedule-paragraph-13-3-c"><num>(c)</num><content><p>explain the possible advantages of attendance, consequences of non-attendance, and the right of the appellant and of OSCR, if not present and not represented, to make representations in writing; and</p></content></level><level class="para1" eId="schedule-paragraph-13-3-d"><num>(d)</num><content><p>specify the date by which the appellant and OSCR must inform the First-tier Tribunal whether or not they intend to be present or represented at the hearing, and that date must not be later than 7 days before the hearing.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-13-4"><num>(4)</num><content><p>The notice must include a request to inform the First-tier Tribunal of any reasonable adjustments which any party may have which are relevant to the attendance of that party at the hearing.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1038"><heading>Hearing in absence of a party</heading><paragraph eId="schedule-paragraph-14" class="schProv1"><num>14.</num><subparagraph eId="schedule-paragraph-14-1"><num>(1)</num><content><p>Where either party to the appeal informs the First-tier Tribunal that it does not intend to appear at the hearing, the First-tier Tribunal shall determine a date by which that party may provide further written submissions to be considered at the hearing.</p></content></subparagraph><subparagraph eId="schedule-paragraph-14-2"><num>(2)</num><content><p>The First-tier Tribunal shall advise both parties to the appeal of the date determined in terms of paragraph (1).</p></content></subparagraph><subparagraph eId="schedule-paragraph-14-3"><num>(3)</num><content><p>Where both parties inform the First-tier Tribunal that they do not intend to appear or be represented at the hearing, the First-tier Tribunal may proceed to decide the appeal at any time after the date determined by the First-tier Tribunal in terms of paragraph (1).</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1064"><heading>Absence of member of the First-tier Tribunal</heading><paragraph eId="schedule-paragraph-15" class="schProv1"><num>15.</num><content><p>If, at or after the beginning of a hearing, a member of the First-tier Tribunal other than the chairing member is absent, the appeal may, with the consent of the parties, be heard by the other two members and, in that event, the First-tier Tribunal shall be deemed to be properly constituted.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1074"><heading>Representatives</heading><paragraph eId="schedule-paragraph-16" class="schProv1"><num>16.</num><subparagraph eId="schedule-paragraph-16-1"><num>(1)</num><content><p>A party may be represented in any proceedings by a legal representative or lay representative whose details must be communicated to the First-tier Tribunal prior to any hearing.</p></content></subparagraph><subparagraph eId="schedule-paragraph-16-2"><num>(2)</num><content><p>A party may disclose any document or communicate any information about the proceedings to that party’s legal representative or lay representative without contravening any prohibition or restriction on disclosure of the document or information.</p></content></subparagraph><subparagraph eId="schedule-paragraph-16-3"><num>(3)</num><content><p>Where a document or information is disclosed under paragraph (2), the legal representative or lay representative is subject to any prohibition or restriction on disclosure in the same way that the party is.</p></content></subparagraph><subparagraph eId="schedule-paragraph-16-4"><num>(4)</num><content><p>Anything permitted or required to be done by a party under these Rules, a practice direction or an order may be done by a lay representative, except signing of an affidavit or precognition.</p></content></subparagraph><subparagraph eId="schedule-paragraph-16-5"><num>(5)</num><intro><p>The First-tier Tribunal may order that a lay representative is not to represent a party if—</p></intro><level class="para1" eId="schedule-paragraph-16-5-a"><num>(a)</num><content><p>it is of the opinion that the lay representative is an unsuitable person to act as a lay representative (whether generally or in the proceedings concerned); or</p></content></level><level class="para1" eId="schedule-paragraph-16-5-b"><num>(b)</num><content><p>it is satisfied that to do so would be in the interests of the efficient administration of justice.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-16-6"><num>(6)</num><content><p>Where a party is represented, the First-tier Tribunal must send all documents and notices concerning references or claims to the representative instead of the party.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1130"><heading>Supporters</heading><paragraph eId="schedule-paragraph-17" class="schProv1"><num>17.</num><subparagraph eId="schedule-paragraph-17-1"><num>(1)</num><content><p>A party who is an individual may be accompanied by another person to act as a supporter.</p></content></subparagraph><subparagraph eId="schedule-paragraph-17-2"><num>(2)</num><intro><p>A supporter may assist the party by—</p></intro><level class="para1" eId="schedule-paragraph-17-2-a"><num>(a)</num><content><p>providing moral support;</p></content></level><level class="para1" eId="schedule-paragraph-17-2-b"><num>(b)</num><content><p>helping to manage tribunal documents and other papers;</p></content></level><level class="para1" eId="schedule-paragraph-17-2-c"><num>(c)</num><content><p>taking notes of the proceedings;</p></content></level><level class="para1" eId="schedule-paragraph-17-2-d"><num>(d)</num><intro><p>quietly advising on—</p></intro><level class="para2" eId="schedule-paragraph-17-2-d-i"><num>(i)</num><content><p>points of law and procedure;</p></content></level><level class="para2" eId="schedule-paragraph-17-2-d-ii"><num>(ii)</num><content><p>issues which the party might wish to raise with the tribunal.</p></content></level></level></subparagraph><subparagraph eId="schedule-paragraph-17-3"><num>(3)</num><content><p>A party may disclose any document or communicate any information about the proceedings to that party’s supporter without contravening any prohibition or restriction on disclosure of the document or information.</p></content></subparagraph><subparagraph eId="schedule-paragraph-17-4"><num>(4)</num><content><p>Where a document or information is disclosed under paragraph (3), the supporter is subject to any prohibition or restriction on disclosure in the same way that the party is.</p></content></subparagraph><subparagraph eId="schedule-paragraph-17-5"><num>(5)</num><content><p>A supporter may not represent the party.</p></content></subparagraph><subparagraph eId="schedule-paragraph-17-6"><num>(6)</num><intro><p>The First-tier Tribunal may order that a person is not to act as a supporter of a party if—</p></intro><level class="para1" eId="schedule-paragraph-17-6-a"><num>(a)</num><content><p>it is of the opinion that the supporter is an unsuitable person to act as a supporter (whether generally or in the proceedings concerned); or</p></content></level><level class="para1" eId="schedule-paragraph-17-6-b"><num>(b)</num><content><p>it is satisfied that to do so would be in the interests of the efficient administration of justice.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1222"><heading>Failure of parties to attend</heading><paragraph eId="schedule-paragraph-18" class="schProv1"><num>18.</num><subparagraph eId="schedule-paragraph-18-1"><num>(1)</num><intro><p>If a party fails to be present or represented at a hearing, the First-tier Tribunal may, if it is satisfied that the party was duly notified of the hearing and is not aware of any good reason for such absence<b>—</b></p></intro><level class="para1" eId="schedule-paragraph-18-1-a"><num>(a)</num><content><p>hear and decide the appeal in the absence of the party; or</p></content></level><level class="para1" eId="schedule-paragraph-18-1-b"><num>(b)</num><content><p>adjourn the hearing and may give such orders as it considers necessary (including an order for expenses under rule 24).</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-18-2"><num>(2)</num><content><p>Before deciding to dispose of any appeal in the absence of a party, the First-tier Tribunal must consider any representations in writing submitted by that party.</p></content></subparagraph><subparagraph eId="schedule-paragraph-18-3"><num>(3)</num><content><p>Where an appellant has failed to be present or represented at a hearing of which the appellant was duly notified, and the First-tier Tribunal has disposed of the appeal, no fresh appeal may be made by the appellant to the First-tier Tribunal in relation to the same decision.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1262"><heading>Hearings in public or in private</heading><paragraph eId="schedule-paragraph-19" class="schProv1"><num>19.</num><subparagraph eId="schedule-paragraph-19-1"><num>(1)</num><content><p>A hearing must be held in public unless the First-tier Tribunal, on its own initiative or on an application by a party, decides that in the interests of justice, it is necessary to do otherwise.</p></content></subparagraph><subparagraph eId="schedule-paragraph-19-2"><num>(2)</num><content><p>An order of the First-tier Tribunal under paragraph (1) may require only part of a hearing of an appeal to be in private.</p></content></subparagraph><subparagraph eId="schedule-paragraph-19-3"><num>(3)</num><content><p>The First-tier Tribunal may prohibit photography, audio recording, visual recording or any other recording at any hearing if satisfied that, in the interests of justice, such a prohibition is required</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1288"><heading>Exclusion of persons disrupting proceedings</heading><paragraph eId="schedule-paragraph-20" class="schProv1"><num>20.</num><subparagraph eId="schedule-paragraph-20-1"><num>(1)</num><intro><p>Without prejudice to any other powers it has, the First-tier Tribunal may exclude from any hearing, or part of it,—</p></intro><level class="para1" eId="schedule-paragraph-20-1-a"><num>(a)</num><content><p>any person (including a party, a representative or supporter) whose conduct has disrupted or is likely, in the opinion of the First-tier Tribunal, to disrupt the hearing;</p></content></level><level class="para1" eId="schedule-paragraph-20-1-b"><num>(b)</num><content><p>any person (including a party, a representative or supporter) whose presence the First-tier Tribunal considers is likely to prevent another person from giving evidence or making submissions freely.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-20-2"><num>(2)</num><intro><p>In deciding whether to exercise the power conferred by paragraph (1) the First-tier Tribunal must, apart from other considerations, have regard to—</p></intro><level class="para1" eId="schedule-paragraph-20-2-a"><num>(a)</num><content><p>the interests of the parties; and</p></content></level><level class="para1" eId="schedule-paragraph-20-2-b"><num>(b)</num><content><p>in the case of the exclusion of a party or a representative, whether the party will be adequately represented.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-20-3"><num>(3)</num><content><p>If the First-tier Tribunal decides to exclude a party it must allow the representative of that party sufficient opportunity to consult the party.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1338"><heading>Orders</heading><paragraph eId="schedule-paragraph-21" class="schProv1"><num>21.</num><subparagraph eId="schedule-paragraph-21-1"><num>(1)</num><intro><p>At any stage of the proceedings the First-tier Tribunal may, either on its own cause or on the application of a party, make such orders as it considers necessary for the hearing of the appeal and in particular may order—</p></intro><level class="para1" eId="schedule-paragraph-21-1-a"><num>(a)</num><content><p>a party to provide any further particulars, supplementary statements or documents which may reasonably be required;</p></content></level><level class="para1" eId="schedule-paragraph-21-1-b"><num>(b)</num><content><p>a party which has access to information which is not reasonably available to the other party, to prepare and file a document recording the information;</p></content></level><level class="para1" eId="schedule-paragraph-21-1-c"><num>(c)</num><content><p>a party to set out the issues upon which the First-tier Tribunal requires to hear evidence;</p></content></level><level class="para1" eId="schedule-paragraph-21-1-d"><num>(d)</num><content><p>that evidence should be excluded if the evidence is irrelevant, unnecessary or improperly obtained;</p></content></level><level class="para1" eId="schedule-paragraph-21-1-e"><num>(e)</num><content><p>a party to lodge, before the hearing, an outline argument.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-21-2"><num>(2)</num><content><p>An application by a party for an order under paragraph (1) (otherwise than during a hearing) must, not later than 7 days before the hearing, be made to the First-tier Tribunal in writing and must set out the order which the party is seeking to have made together with the reasons for the application.</p></content></subparagraph><subparagraph eId="schedule-paragraph-21-3"><num>(3)</num><content><p>If a party objects to the order sought, the First-tier Tribunal must consider the objection and, if it considers it necessary for deciding the application, must give the parties an opportunity of being present or represented before the First-tier Tribunal.</p></content></subparagraph><subparagraph eId="schedule-paragraph-21-4"><num>(4)</num><content><p>For the purposes of this rule, a party is not obliged to produce a document which that party would be entitled to refuse to produce in civil proceedings before a court in Scotland.</p></content></subparagraph><subparagraph eId="schedule-paragraph-21-5"><num>(5)</num><content><p>In giving effect to this rule, the First-tier Tribunal must take into account the need to protect any matter that relates to personal or financial circumstances, is commercially sensitive or consists of information communicated or obtained in confidence.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1407"><heading>Alteration of arrangements for hearing and adjournments</heading><paragraph eId="schedule-paragraph-22" class="schProv1"><num>22.</num><subparagraph eId="schedule-paragraph-22-1"><num>(1)</num><intro><p>The First-tier Tribunal may, prior to commencement of the hearing, alter the date, time or place of any hearing and the First-tier Tribunal must give the parties not less than 14 days’ notice of any such alteration unless—</p></intro><level class="para1" eId="schedule-paragraph-22-1-a"><num>(a)</num><content><p>a shorter period of notice is agreed by the parties; or</p></content></level><level class="para1" eId="schedule-paragraph-22-1-b"><num>(b)</num><content><p>the requirement to alter the date of the hearing is due to the illness of a member of the First-tier Tribunal or other exceptional circumstance which affects the availability of a member of the First-tier Tribunal to attend the hearing.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-22-2"><num>(2)</num><content><p>If the First-tier Tribunal alters the date of the hearing under paragraph (1), that date must not, unless the parties agree, be before the date fixed in terms of rule 13(1).</p></content></subparagraph><subparagraph eId="schedule-paragraph-22-3"><num>(3)</num><content><p>The First-tier Tribunal may from time to time adjourn the hearing and, if the date, time and place of the adjourned hearing are announced before the adjournment, no further notice shall be required.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1445"><heading>Persons entitled to be present</heading><paragraph eId="schedule-paragraph-23" class="schProv1"><num>23.</num><subparagraph eId="schedule-paragraph-23-1"><num>(1)</num><intro><p>Subject to rule 20 the following persons shall be entitled to attend a hearing whether or not it is in private—</p></intro><level class="para1" eId="schedule-paragraph-23-1-a"><num>(a)</num><content><p>a member of the First-tier Tribunal not sitting as a member of the First-tier Tribunal for the purpose of the hearing;</p></content></level><level class="para1" eId="schedule-paragraph-23-1-b"><num>(b)</num><content><p>a member of staff of the Scottish Courts and Tribunals Service; and</p></content></level><level class="para1" eId="schedule-paragraph-23-1-c"><num>(c)</num><content><p>any other person permitted by the First-tier Tribunal with the consent of the parties.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-23-2"><num>(2)</num><content><p>None of the persons specified above who are present at the First-tier Tribunal’s deliberations may take any part in those deliberations.</p></content></subparagraph><subparagraph eId="schedule-paragraph-23-3"><num>(3)</num><content><p>Where the First-tier Tribunal sits in private it may admit persons to the hearing on such terms and conditions as it considers appropriate.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1489"><heading>Expenses</heading><paragraph eId="schedule-paragraph-24" class="schProv1"><num>24.</num><subparagraph eId="schedule-paragraph-24-1"><num>(1)</num><content><p>The First-tier Tribunal may make an order for expenses as taxed by the Auditor of the Court of Session against a party if that party’s act, omission or other conduct has caused any other party to incur expense which it would be unreasonable for that other party to be expected to pay, with the maximum recoverable expenses being the expenses incurred.</p></content></subparagraph><subparagraph eId="schedule-paragraph-24-2"><num>(2)</num><content><p>The First-tier Tribunal, of its own initiative or on the application of a party or the parties, may in exceptional circumstances fix by order a sum payable by a party in discharge of an award of expenses.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1509"><heading>Decisions of the First-tier Tribunal</heading><paragraph eId="schedule-paragraph-25" class="schProv1"><num>25.</num><subparagraph eId="schedule-paragraph-25-1"><num>(1)</num><content><p>A decision of the First-tier Tribunal may be taken by a majority and the decision must record whether it was unanimous or taken by a majority.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-2"><num>(2)</num><content><p>Where the First-tier Tribunal is constituted by two members, the chairing member shall have a second vote.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-3"><num>(3)</num><content><p>A decision of the First-tier Tribunal may be given at the end of the hearing or within 30 days of the hearing.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-4"><num>(4)</num><content><p>The decision must be recorded as soon as possible in a decision document which must also contain a statement of reasons for the decision and be signed by the chairing member and dated.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-5"><num>(5)</num><content><p>The First-tier Tribunal must send a copy of the decision to each party to the appeal together with a notice explaining the rights of the parties to appeal the decision of the First-tier Tribunal and the time within which, and the manner in which, the right of appeal may be exercised.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-6"><num>(6)</num><content><p>Except where a decision is announced at the end of the hearing, it shall be treated as having been made on the date on which the chairing member signs the decision.</p></content></subparagraph><subparagraph eId="schedule-paragraph-25-7"><num>(7)</num><intro><p>The First-tier Tribunal may order that particulars of a decision relating to—</p></intro><level class="para1" eId="schedule-paragraph-25-7-a"><num>(a)</num><content><p>evidence heard before the First-tier Tribunal in private;</p></content></level><level class="para1" eId="schedule-paragraph-25-7-b"><num>(b)</num><content><p>evidence which refers to intimate personal or financial circumstances;</p></content></level><level class="para1" eId="schedule-paragraph-25-7-c"><num>(c)</num><content><p>evidence which is considered to be commercially sensitive;</p></content></level><level class="para1" eId="schedule-paragraph-25-7-d"><num>(d)</num><content><p>evidence which consists of confidential communication; or</p></content></level><level class="para1" eId="schedule-paragraph-25-7-e"><num>(e)</num><content><p>any other matter as the First-tier Tribunal considers appropriate for the protection of parties;</p></content></level><wrapUp><p>must be excluded from publication in terms of rule 26 and from inspection in the register in terms of rule 27.</p></wrapUp></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1591"><heading>Publication of decisions</heading><paragraph eId="schedule-paragraph-26" class="schProv1"><num>26.</num><subparagraph eId="schedule-paragraph-26-1"><num>(1)</num><content><p>The First-tier Tribunal must make arrangements for the public pronouncement of its decisions, whether by giving its decisions orally at a public hearing or by publishing its decisions in writing.</p></content></subparagraph><subparagraph eId="schedule-paragraph-26-2"><num>(2)</num><content><p>Where the First-tier Tribunal has made an order in terms of rule 25(7), the First-tier Tribunal may make any necessary amendments to the text of the decision for the purposes of publication.</p></content></subparagraph><subparagraph eId="schedule-paragraph-26-3"><num>(3)</num><content><p>Where any decision refers to any evidence that has been heard in private, the material relating to that evidence must be omitted from the decision and the First-tier Tribunal may make any necessary amendments to the text of the decision for the purposes of publication.</p></content></subparagraph><subparagraph eId="schedule-paragraph-26-4"><num>(4)</num><content><p>Decisions may be published electronically.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1623"><heading>The register</heading><paragraph eId="schedule-paragraph-27" class="schProv1"><num>27.</num><subparagraph eId="schedule-paragraph-27-1"><num>(1)</num><content><p>A register must be kept by the First-tier Tribunal and must be open for the inspection during reasonable hours by any person without charge.</p></content></subparagraph><subparagraph eId="schedule-paragraph-27-2"><num>(2)</num><content><p>The register may be made available electronically.</p></content></subparagraph><subparagraph eId="schedule-paragraph-27-3"><num>(3)</num><intro><p>The register must, unless the First-tier Tribunal has ordered otherwise, include the following details for each appeal—</p></intro><level class="para1" eId="schedule-paragraph-27-3-a"><num>(a)</num><content><p>the case number;</p></content></level><level class="para1" eId="schedule-paragraph-27-3-b"><num>(b)</num><content><p>the name of the appellant;</p></content></level><level class="para1" eId="schedule-paragraph-27-3-c"><num>(c)</num><content><p>the decision of OSCR which is being appealed;</p></content></level><level class="para1" eId="schedule-paragraph-27-3-d"><num>(d)</num><content><p>the date, time and place fixed for the hearing or the date the appeal is to be decided in absence of the parties; and</p></content></level><level class="para1" eId="schedule-paragraph-27-3-e"><num>(e)</num><content><p>the decision of the First-tier Tribunal.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-27-4"><num>(4)</num><content><p>Where any decision refers to any evidence that has been heard in private, the material relating to that evidence must be omitted from the register.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1685"><heading>Proof of documents and decisions</heading><paragraph eId="schedule-paragraph-28" class="schProv1"><num>28.</num><subparagraph eId="schedule-paragraph-28-1"><num>(1)</num><content><p>Any document purporting to be a document duly executed or issued by or on behalf of the First-tier Tribunal shall, unless the contrary is proved, be deemed to be a document so executed or issued as the case may be.</p></content></subparagraph><subparagraph eId="schedule-paragraph-28-2"><num>(2)</num><content><p>A document purporting to be certified by the First-tier Tribunal to be a true copy of any entry of a decision in the register shall, unless the contrary is proved, be sufficient evidence of the entry and of the matters contained in it.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1705"><heading>Correction of clerical mistakes or accidental slips or omissions</heading><paragraph eId="schedule-paragraph-29" class="schProv1"><num>29.</num><intro><p>The First-tier Tribunal may at any time correct any clerical mistake or other accidental slip or omission contained in a decision, order or any document produced by it, by—</p></intro><level class="para1" eId="schedule-paragraph-29-a"><num>(a)</num><content><p>sending notification of the amended decision or order, or a copy of the amended document to all parties; and</p></content></level><level class="para1" eId="schedule-paragraph-29-b"><num>(b)</num><content><p>making any necessary amendment to any information published in relation to the decision, order or document.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1727"><heading>Application for permission to appeal a decision of the First-tier Tribunal</heading><paragraph eId="schedule-paragraph-30" class="schProv1"><num>30.</num><subparagraph eId="schedule-paragraph-30-1"><num>(1)</num><content><p>A party seeking permission to appeal must make a written application to the First-tier Tribunal for permission to appeal.</p></content></subparagraph><subparagraph eId="schedule-paragraph-30-2"><num>(2)</num><intro><p>An application under paragraph (1) must—</p></intro><level class="para1" eId="schedule-paragraph-30-2-a"><num>(a)</num><content><p>identify the decision of the First-tier Tribunal to which it relates;</p></content></level><level class="para1" eId="schedule-paragraph-30-2-b"><num>(b)</num><content><p>identify the alleged point or points of law on which the party making the application wishes to appeal; and</p></content></level><level class="para1" eId="schedule-paragraph-30-2-c"><num>(c)</num><content><p>state the result the party making the application is seeking.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1765"><heading>First-tier Tribunal’s consideration of application for permission to appeal</heading><paragraph eId="schedule-paragraph-31" class="schProv1"><num>31.</num><subparagraph eId="schedule-paragraph-31-1"><num>(1)</num><content><p>The First-tier Tribunal must decide whether to give permission to appeal on any point of law.</p></content></subparagraph><subparagraph eId="schedule-paragraph-31-2"><num>(2)</num><content><p>The First-tier Tribunal must provide a record of its decision to the parties as soon as reasonably practicable.</p></content></subparagraph><subparagraph eId="schedule-paragraph-31-3"><num>(3)</num><intro><p>If the First-tier Tribunal refuses permission on any point of law it must provide with the record of its decision—</p></intro><level class="para1" eId="schedule-paragraph-31-3-a"><num>(a)</num><content><p>a statement of its reasons for such a refusal; and</p></content></level><level class="para1" eId="schedule-paragraph-31-3-b"><num>(b)</num><content><p>notification of the right to make an application to the Upper Tribunal for permission to appeal and the time within which, and the method by which, such an application must be made.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1803"><heading><ins class="first" ukl:ChangeId="key-27e9aad8abc01f97c658b6436e67c4e1-1779267516996" eId="schedule-paragraph-32" class="schProv1"><num>32.</num><subparagraph eId="schedule-paragraph-32-1"><num>(1)</num><content><p>The First-tier Tribunal may either at its own instance or at the request of a party review any decision made by it where it is necessary in the interests of justice to do so.</p></content></subparagraph><subparagraph eId="schedule-paragraph-32-2"><num>(2)</num><intro><p>An application for review under section 43(2)(b) of the 2014 Act must—</p></intro><level class="para1" eId="schedule-paragraph-32-2-a"><num>(a)</num><content><p>be made in writing (and copied to all other parties);</p></content></level><level class="para1" eId="schedule-paragraph-32-2-b"><num>(b)</num><content><p>be made within 14 days of the date on which the decision was made or within 14 days of the date that the written reasons were sent to the parties (if later); and</p></content></level><level class="para1" eId="schedule-paragraph-32-2-c"><num>(c)</num><content><p>set out why a review of the decision is necessary.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-32-3"><num>(3)</num><content><p>If the First-tier Tribunal considers that the application is wholly without merit, the First-tier Tribunal shall refuse the application and shall also inform the parties of the reasons for the refusal.</p></content></subparagraph><subparagraph eId="schedule-paragraph-32-4"><num>(4)</num><intro><p>Except where paragraph (3) applies, the First-tier Tribunal shall send a notice to the parties—</p></intro><level class="para1" eId="schedule-paragraph-32-4-a"><num>(a)</num><content><p>setting a time limit for any response to the application by the other parties and seeking the views of the parties on whether the application can be determined without a hearing; and</p></content></level><level class="para1" eId="schedule-paragraph-32-4-b"><num>(b)</num><content><p>at the discretion of the First-tier Tribunal, setting out the First-tier Tribunal’s provisional views on the application.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-32-5"><num>(5)</num><content><p>Except where paragraph (3) applies, the decision shall be reviewed at a hearing unless the First-tier Tribunal considers, having regard to any response to the notice provided under paragraph (4), that a hearing is not necessary in the interests of justice.</p></content></subparagraph><subparagraph eId="schedule-paragraph-32-6"><num>(6)</num><content><p>Where practicable, the review shall be undertaken by one or more of the members of the First-tier Tribunal who made the decision to which the review relates.</p></content></subparagraph><subparagraph eId="schedule-paragraph-32-7"><num>(7)</num><content><p>Where the First-tier Tribunal proposes to review a decision at its own instance, it shall inform the parties of the reasons why the decision is being reviewed and the decision shall be reviewed in accordance with paragraph (4) (as if an application had been made and not refused).</p></content></subparagraph><subparagraph eId="schedule-paragraph-32-8"><num>(8)</num><content><p>A review by the First-tier Tribunal in terms of paragraph (1) either at its own instance or on an application of a party does not affect the time limit of 30 days in regulation 2(1) of the Scottish Tribunals (Time Limits) Regulations 2016<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2016/231">S.S.I. 2016/231</ref>.</p></authorialNote> for making an application for permission to appeal.</p></content></subparagraph></paragraph></hcontainer></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><heading>EXPLANATORY NOTE</heading><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>The Tribunals (Scotland) Act 2014 created a new structure for tribunals dealing with devolved matters under the judicial leadership of the Lord President of the Court of Session as head of the Scottish Tribunals. It provided for a <abbr title="First-tier Tribunal for Scotland General Regulatory Chamber">First-tier Tribunal</abbr> and an Upper Tribunal and for the <abbr title="First-tier Tribunal for Scotland General Regulatory Chamber">First-tier Tribunal</abbr> to be divided into chambers dependent on the subject-matter of the case before it and similarly for the Upper Tribunal to be divided into divisions. The <abbr title="First-tier Tribunal for Scotland General Regulatory Chamber">First-tier Tribunal</abbr> has been divided into chambers, one of which is the general regulatory chamber. These Regulations provide for the rules of procedure which are to apply in that chamber when hearing charity appeals, which are set out in the schedule of the regulations. Paragraph 4 of schedule 9 of the Tribunals (Scotland) Act 2014 enables the Scottish Ministers, by regulations, to make Tribunal Rules until such time as the provisions conferring responsibility on the Scottish Civil Justice Council and the Court of Session for the making of Tribunal Rules are commenced.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
