6.—(1) When appointing members of [F1 Crown Estate Scotland], the Scottish Ministers are to have regard to the desirability of ensuring that the membership as a whole has skills, expertise and experience relevant to its functions.

(2) The Scottish Ministers may not appoint a person as a member of [F1 Crown Estate Scotland] if the person is—

(a) a member of the Scottish Parliament;

(b) a member of the House of Commons;

(c) a member of the House of Lords;

(d) a member of the European Parliament.
