Coming into force
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 53(1) and (3) and paragraph 8(1)(a) of schedule 5 of the Rent (Scotland) Act 1984 F1 and sections 17(2), and (3), 19(3), 24(1) and (3), 34(1), 48(2), 53(3) and 55(1) of the Housing (Scotland) Act 1988 F2 and all other powers enabling them to do so.C1C3C2
1988 c.43. Section 17(3) was amended by paragraph 16 of schedule 6 of the 2006 Act. Section 19(3) was amended by paragraph 85(b) of schedule 17 of the Housing Act 1988 (c.50). Section 24(1) was amended by paragraph 100(a) of schedule 11 of the Local Government and Housing Act 1989 (c.42). Sections 24(3), 34(1) and 48(2) were amended by paragraph 16 of schedule 6 of the 2006 Act and S.S.I. 2016/337. Section 55(1) contains a definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made. The functions of the Secretary of State were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c.46).

Citation and commencement1
These Regulations may be cited as the Rent Regulation and Assured Tenancies (Forms) (Scotland) Regulations 2017 and come into force on 1st December 2017.
Forms2
The forms set out in the schedule are the forms to be used for the purposes of the provisions of the Rent (Scotland) Act 1984 and the Housing (Scotland) Act 1988 which are referred to in those forms.
Revocations3

Regulation 5(2) and schedule 4 of the Rent Regulation (Forms and Information etc.) (Scotland) Regulations 1991 are revoked.

Regulation 3 and schedule 2 of the First-tier Tribunal for Scotland Housing and Property Chamber (Procedure) Regulations 2016 are revoked.
Saving and transitional provisions4

Despite their revocation by regulation 3, regulation 5(2) and schedule 4 of the Rent Regulation (Forms and Information etc.) (Scotland) Regulations 1991 F3 continue to have effect in relation to any rent book required by section 79(1) of the Rent (Scotland) Act 1984 and in existence immediately before 1st December 2017.

On and after 1st December 2017, a form under the First-tier Tribunal for Scotland Housing and Property Chamber (Procedure) Regulations 2016 F4 which was served on a landlord or tenant or used to make an application to the First-tier Tribunal for Scotland Housing and Property Chamber prior to 1st December 2017, is to be treated for all purposes as if it were the equivalent form under these Regulations.
