Despite the commencement of section 35(3) of the Act paragraph 1A13 of schedule 3 (application of Chapter 1 of Part 7 to certain patients) of the 2003 Act has no effect where the requirement to make the application under section 63 of the 2003 Act (application for compulsory treatment order) by virtue of section 57(1) of that Act (mental health officer’s duty to apply for compulsory treatment order) arises before the appointed day.
