3. Section 291A(1) (conflicts of interest to be avoided) does not apply M1 in circumstances where a delay by the medical practitioner in carrying out a medical examination for the purposes of sections 44(1) or 47(1) would, in the opinion of that medical practitioner, give rise to a serious risk to the health, safety or welfare of the patient or to the safety of other persons.
