name="enactingText"><p>The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 33C(6) of the Civic Government (Scotland) Act 1982<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1982/45">1982 c.45</ref>; the functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c.46)</ref>. Section 33C was inserted by section 70 of the Air Weapons and Licensing (Scotland) Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/asp/2015/10">2015 (asp 10)</ref>.</p></authorialNote> and all other powers enabling them to do so.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Civic Government (Scotland) Act 1982 (Metal Dealers and Itinerant Metal Dealers) (Verification of Name and Address) Regulations 2016 and come into force on 1st September 2016.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Means of verification</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>For the purposes of section 33C of the Civic Government (Scotland) Act 1982 the means by which a person’s name and address may be verified is for the metal dealer or itinerant metal dealer (“the dealer”) to refer to—</p></intro><level class="para1" eId="regulation-2-1-a"><num>(a)</num><content><p>a document listed in paragraph (2) which bears the person’s name, photograph and residential address; or</p></content></level><level class="para1" eId="regulation-2-1-b"><num>(b)</num><level class="para2" eId="regulation-2-1-b-i"><num>(i)</num><content><p>a document listed in paragraph (2) which bears the person’s full name, photograph and date of birth; and</p></content></level><level class="para2" eId="regulation-2-1-b-ii"><num>(ii)</num><content><p>a document listed in paragraph (3) which bears the person’s full name and residential address.</p></content></level></level></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>The documents for the purposes of paragraph (1)(a) or (b)(i) are—</p></intro><level class="para1" eId="regulation-2-2-a"><num>(a)</num><content><p>a valid United Kingdom passport;</p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p>a valid passport issued by an EEA state;</p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>a valid Great Britain or Northern Ireland photo-card driving licence; and</p></content></level><level class="para1" eId="regulation-2-2-d"><num>(d)</num><content><p>a valid biometric immigration document<b>.</b></p></content></level></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>The documents for the purposes of paragraph (1)(b)(ii) are—</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>a bank or building society statement;</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>a credit or debit card statement;</p></content></level><level class="para1" eId="regulation-2-3-c"><num>(c)</num><content><p>a council tax bill or statement where the person’s address is in England, Wales or Scotland;</p></content></level><level class="para1" eId="regulation-2-3-d"><num>(d)</num><content><p>a rate bill or statement where the person’s address is in Northern Ireland; and</p></content></level><level class="para1" eId="regulation-2-3-e"><num>(e)</num><content><p>a utility bill, but not a mobile telephone bill,</p></content></level><wrapUp><p>provided that the date on which the document was issued is not more than three months before the date the metal is acquired by the dealer or not more than three months before the date the metal is disposed of by sale or exchange by the dealer.</p></wrapUp></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><intro><p>In this regulation—</p></intro><hcontainer name="definition"><content><p>“biometric immigration document” means a biometric immigration document issued in accordance with the Immigration (Biometric Registration) Regulations 2008<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/2008/3048">S.I. 2008/3048</ref>, as amended by <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/2009/819">S.I. 2009/819</ref>, <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/2012/594">S.I. 2012/594</ref>, <ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/2015/433">S.I. 2015/433</ref> and <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/2015/897">S.I. 2015/897</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“driving licence” means a licence granted under—</p></intro><level class="para1"><num>(a)</num><content><p>Part 3 of the Road Traffic Act 1988<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1988/52">1988 c.52</ref>.</p></authorialNote>; or</p></content></level><level class="para1"><num>(b)</num><content><p>the Road Traffic (Northern Ireland) Order 1981<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00010" href="http://www.legislation.gov.uk/id/nisi/1981/154">S.I. 1981/154 (N.I. 1)</ref>.</p></authorialNote>;</p></content></level><wrapUp><p>and includes a provisional licence, a Counterpart Community licence and a British external licence within the meaning of those enactments;</p></wrapUp></hcontainer><hcontainer name="definition"><intro><p>“EEA State” means—</p></intro><level class="para1"><num>(a)</num><content><p>a state which is a member State of the EU; or</p></content></level><level class="para1"><num>(b)</num><content><p>any other state which is a party to the Agreement on the European Economic Area signed at Oporto on 2nd May 1992, together with the Protocol adjusting that Agreement signed at Brussels on 17th March 1993;
