exercise of the powers conferred by section 26(1) to (5) of the Fire Services Act 1947<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1947/41">1947 c.41</ref> (“the <abbr title="Fire Services Act 1947 c. 41">1947 Act</abbr>”); section 26 was repealed by sections 52 and 54 and schedule 2 of the Fire and Rescue Services Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2004/21">2004 (c.21)</ref>. Subsections (1) to (5) of section 26 continue to have effect for the purposes of the Firefighters’ Pension Scheme, in relation to England and Scotland by virtue of <ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/2004/2306">S.I. 2004/2306</ref> and in relation to Wales by virtue of <ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/2004/2917">S.I. 2004/2917</ref>. The name of the scheme was changed to the Firefighters’ Pension Scheme by <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/2004/2306">S.I. 2004/2306</ref>. Section 26 of the <abbr title="Fire Services Act 1947 c. 41">1947 Act</abbr> was amended by section 1 of the Fire Services Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1951/27">1951 (c.27)</ref>, section 42 of the Reserve and Auxiliary Forces (Protection of Civil Interests) Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1951/65">1951 (c.65)</ref>, section 33 and schedule 3 of the Theft Act <ref eId="c00008" href="http://www.legislation.gov.uk/id/ukpga/1968/60">1968 (c.60)</ref>, sections 16 and 29 and schedule 8 of the Superannuation Act <ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1972/11">1972 (c.11)</ref>, sections 100 and 101 and schedule 27 of the Social Security Act <ref eId="c00010" href="http://www.legislation.gov.uk/id/ukpga/1973/38">1973 (c.38)</ref>, section 1 and schedule 1 of the Social Security (Consequential Provisions) Act <ref eId="c00011" href="http://www.legislation.gov.uk/id/ukpga/1975/18">1975 (c.18)</ref>, section 32 of the Magistrates’ Courts Act <ref eId="c00012" href="http://www.legislation.gov.uk/id/ukpga/1980/43">1980 (c.43)</ref>, section 1 of the Police and Firemen’s Pensions Act <ref eId="c00013" href="http://www.legislation.gov.uk/id/ukpga/1997/52">1997 (c.52)</ref>, section 256 and schedule 25 of the Civil Partnership Act <ref eId="c00014" href="http://www.legislation.gov.uk/id/ukpga/2004/33">2004 (c.33)</ref>, and <ref eId="c00015" href="http://www.legislation.gov.uk/id/uksi/1976/551">S.I. 1976/551</ref>. The Secretary of State’s functions under section 26 of the <abbr title="Fire Services Act 1947 c. 41">1947 Act</abbr>, in so far as they were exercisable in relation to Scotland, were transferred to Scottish Ministers by <ref eId="c00016" href="http://www.legislation.gov.uk/id/uksi/1999/1750">S.I. 1999/1750</ref> and <ref eId="c00017" href="http://www.legislation.gov.uk/id/uksi/2006/304">S.I. 2006/304</ref>.</p></authorialNote> and section 12 of the Superannuation Act 1972<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00018" href="http://www.legislation.gov.uk/id/ukpga/1972/11">1972 c.11</ref>; section 16 applies section 12 with the necessary modifications to orders under section 26 of the Fire Services Act 1947. Section 16 is repealed by section 52 and schedule 2 of the Fire and Rescue Services Act 2004, but continues to have certain effect by virtue of <ref eId="c00019" href="http://www.legislation.gov.uk/id/uksi/2004/2306">S.I. 2004/2306</ref>.</p></authorialNote> and all other powers enabling them to do so.</p></formula></preamble><body eId="body"><article eId="article-1"><heading>Citation, commencement, effect and extent</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the Firemen’s Pension Scheme (Amendment and Transitional Provisions) (Scotland) Order 2016.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><content><p>This Order comes into force on 6th February 2017, but article 2 has effect from 1st December 2006.</p></content></paragraph><paragraph eId="article-1-3"><num>(3)</num><content><p>This Order extends to Scotland only.</p></content></paragraph></article><article eId="article-2"><heading>Amendment of the Firemen’s Pension Scheme Order 1992</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>Schedule 2 of the Firemen’s Pension Scheme Order 1992<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00020" href="http://www.legislation.gov.uk/id/uksi/1992/129">S.I. 1992/129</ref>; relevant amending instruments are <ref eId="c00021" href="http://www.legislation.gov.uk/id/ssi/2005/566">S.S.I. 2005/566</ref>, <ref eId="c00022" href="http://www.legislation.gov.uk/id/ssi/2006/342">S.S.I. 2006/342</ref>, <ref eId="c00023" href="http://www.legislation.gov.uk/id/ssi/2008/161">S.S.I. 2008/161</ref>, <ref eId="c00024" href="http://www.legislation.gov.uk/id/ssi/2012/106">S.S.I. 2012/106</ref> and <ref eId="c00025" href="http://www.legislation.gov.uk/id/ssi/2015/140">S.S.I. 2015/140</ref>.</p></authorialNote> (in which the Firefighters’ Pension Scheme is set out) is amended as follows.</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p>In rule G1 (pensionable pay and average pensionable pay), at the end of paragraph (4)(b) insert “(or would have been payable but for paragraph (1B) of that rule)”.</p></content></paragraph><paragraph eId="article-2-3"><num>(3)</num><intro><p>In rule G2 (pension contributions)—</p></intro><level class="para1" eId="article-2-3-a"><num>(a)</num><content><p>in paragraph (1), for “A regular firefighter shall” substitute “Subject to paragraphs (1B) to (1D), a regular firefighter shall”; and</p></content></level><level class="para1" eId="article-2-3-b"><num>(b)</num><content><p><mod>before paragraph (2) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(1B)</num><content><p>Paragraph (1) does not apply to a firefighter below the age of 50 who has reckoned 30 years or more pensionable service.</p></content></paragraph><paragraph><num>(1C)</num><intro><p>A firefighter who is—</p></intro><level class="para1"><num>(a)</num><content><p>below the age of 50 and has reckoned 30 years pensionable service; and</p></content></level><level class="para1"><num>(b)</num><content><p>entitled to be credited with additional pension benefit under rule B5B or B5C,</p></content></level><wrapUp><p>is, until that person attains the age of 50, to pay pension contributions to the fire and rescue authority only in relation to that additional pension benefit.</p></wrapUp></paragraph><paragraph><num>(1D)</num><intro><p>Contributions under paragraph (1C) are payable—</p></intro><level class="para1"><num>(a)</num><content><p>at the rate of 11% in the period beginning on 1st December 2006 and ending on 31st March 2012; and</p></content></level><level class="para1"><num>(b)</num><content><p>on and after 1st April 2012 at the rate specified in the Table in paragraph 3 of Part 1A of schedule 8.</p></content></level></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></paragraph></article><article eId="article-3"><heading>Transitional provision</heading><num>3.</num><paragraph eId="article-3-1"><num>(1)</num><content><p>The Scottish Fire and Rescue Service must pay the required amount as described in paragraph (3) to a firefighter who falls within paragraph (2).</p></content></paragraph><paragraph eId="article-3-2"><num>(2)</num><content><p>A firefighter falls within this paragraph if in the period beginning on 1st December 2006 and ending on 5th February 2017, the firefighter paid pensions contributions pursuant to rule G2(1) of the Scheme set out in schedule 2 of the Firemen’s Pension Scheme Order 1992 which, as a consequence of article 2 of this Order, did not fall to be payable.</p></content></paragraph><paragraph eId="article-3-3"><num>(3)</num><content><p>The required amount is a lump sum equal to—</p><tblock class="formula"><foreign><math xmlns="http://www.w3.org/1998/Math/MathML" display="block" altimg="http://www.legislation.gov.uk/ssi/2016/431/images/ssi_20160431_en_001"><mrow><mo stretchy="false">(</mo><mi>A</mi><mo>+</mo><mi>B</mi><mo stretchy="false">)</mo><mo>×</mo><mi>C</mi></mrow></math></foreign><blockContainer class="where"><p>where—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>A is the total value of each contribution <ins class="first last" ukl:ChangeId="key-84f889dec2c809015cc13bc35eb805b5-1758718745785" ukl:CommentaryRef="key-84f889dec2c809015cc13bc35eb805b5"><noteRef uk:name="commentary" href="#key-84f889dec2c809015cc13bc35eb805b5" class="commentary"/>(not including any contribution in relation to an additional pension benefit),</ins> net of any tax which would have been payable by the firefighter had the contribution not been paid;</p></item><item><p>B is the interest calculated on A in accordance with paragraph (4); and</p></item><item><p>C is 100/60.</p></item></blockList></blockContainer></tblock></content></paragraph><paragraph eId="article-3-4"><num>(4)</num><intro><p>Interest must be—</p></intro><level class="para1" eId="article-3-4-a"><num>(a)</num><content><p>calculated separately in relation to each contribution paid; and</p></content></level><level class="para1" eId="article-3-4-b"><num>(b)</num><content><p>applied on a compound basis at the past interest rate on a day to day basis for the period specified in paragraph (5).</p></content></level></paragraph><paragraph eId="article-3-5"><num>(5)</num><content><p>The period specified for the purposes of paragraph (4)(b) begins with the first day of the month in which each contribution was paid and ends with the last day of the month before the month in which the payment of the required amount is made.</p></content></paragraph><paragraph eId="article-3-6"><num>(6)</num><content><p>Where a payment is required to be made under paragraph (1) in respect of a person who died before 6th February 2017 or who dies on or after that date but before the payment is made, the Scottish Fire and Rescue Service must pay the sum due to the person’s executor.</p></content></paragraph><paragraph eId="article-3-7"><num>(7)</num><intro><p>In this article—</p></intro><hcontainer name="definition"><intro><p>“Bank of England base rate” means—</p></intro><level class="para1"><num>(a)</num><content><p>the rate announced from time to time by the Monetary Policy Committee of the Bank of England as the official dealing rate, being the rate at which the Bank is willing to enter into transactions for providing short term liquidity in the money markets;
