The Title Conditions (Scotland) Act 2003 (Conservation Bodies) Amendment Order 2016

Coming into force
The Scottish Ministers make the following Order in exercise of the power conferred by section 38(4) of the Title Conditions (Scotland) Act 20031 and all other powers enabling them to do so.

They are satisfied as to the matters mentioned in section 38(5) of that Act.

Citation and commencement1.

This Order may be cited as the Title Conditions (Scotland) Act 2003 (Conservation Bodies) Amendment Order 2016 and comes into force on 13th December 2016.

Amendment of the list of prescribed conservation bodies2.

(1)

Part 2 of the schedule of the Title Conditions (Scotland) Act 2003 (Conservation Bodies) Order 20032 (conservation bodies prescribed under section 38(4) of the Title Conditions (Scotland) Act 2003) is amended as follows.

(2)

Insert in the appropriate place according to alphabetical order—

(a)

“Chapelton Community Interest Company”; and

(b)

“Tornagrain Conservation Trust”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends the Title Conditions (Scotland) Act 2003 (Conservation Bodies) Order 2003 by adding Chapelton Community Interest Company and Tornagrain Conservation Trust to the list of prescribed conservation bodies. Conservation bodies are bodies in favour of whom it is competent to create a conservation burden under section 38(1) of the Title Conditions (Scotland) Act 2003.
