Section 108(1) contains definitions of “prescribed” and “regulations” relevant to the exercise of the statutory powers under which these Regulations are made. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00014" eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the National Health Service (Payments and Remission of Charges) (Miscellaneous Amendments) (Scotland) Regulations 2015 and come into force on 1st November 2015.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><intro><p>In these Regulations—</p></intro><hcontainer ukl:Name="P1group"><heading>Amendment of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr></heading><hcontainer name="regulation" eId="regulation-2"><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>Regulation 8 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> (eligibility – supply of optical appliances) is amended as follows.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p><mod>For paragraph (3)(q) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(q)</num><intro><p>he is—</p></intro><level class="para2"><num>(i)</num><intro><p>receiving universal credit, either as a single person or as a member of a couple, where the universal credit award does not include—</p></intro><level class="para3"><num>(aa)</num><content><p>the child element;</p></content></level><level class="para3"><num>(bb)</num><content><p>the LCW element; or</p></content></level><level class="para3"><num>(cc)</num><content><p>the LCWRA element,</p></content></level><wrapUp><p>and either has no earned income or has earned income of £435 or less in the assessment period;</p></wrapUp></level><level class="para2"><num>(ii)</num><intro><p>receiving universal credit, either as a single person or as a member of a couple, where the universal credit award includes (assessment periods);</p></content></level><level class="para2"><num>(ii)</num><content><p>“child element” means the child element of universal credit within the meaning of regulation 24(1) of the <abbr title="Universal Credit Regulations 2013 (S.I. 2013/376)">Universal Credit Regulations</abbr> (the child element);</p></content></level><level class="para2"><num>(iii)</num><content><p>“couple” eId="regulation-5"><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>In a case to which paragraph (2) applies, regulation 12 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> continues to have effect as it had effect immediately before the amendments made by regulation 2 of these Regulations came into force.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>This paragraph applies in a case where—</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>a person was issued with a voucher in accordance with regulation 9, 10 or 11 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> before 1st November 2015;</p></content></level><level class="para1" eId="regulation-5-2-b"><num>(b)</num><content><p>that voucher has not been accepted before that date; and</p></content></level><level class="para1" eId="regulation-5-2-c"><num>(c)</num><content><p>but for the application of this regulation, that person would cease to be eligible to present that voucher by virtue of the amendment made to regulation 8 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> by regulation 2 of these Regulations.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>In a case to which paragraph (2) applies, regulation 20 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> continues to have effect as it had effect immediately before the amendments made by regulation 2 of these Regulations came into force.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><intro><p>This paragraph applies in a case where—</p></intro><level class="para1" eId="regulation-6-2-a"><num>(a)</num><content><p>a person was eligible to receive a payment under regulation 20 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> in respect of the supply, replacement or repair of an optical appliance which took place before 1st November 2015; and</p></content></level><level class="para1" eId="regulation-6-2-b"><num>(b)</num><content><p>but for the application of this regulation, that person would cease to be eligible to receive such a payment by virtue of the amendment made to regulation 8 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> by regulation 2 of these Regulations.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>In a case to which paragraph (2) applies, regulation 11 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> continues to have effect as it had effect immediately before the amendments made by regulation 3 of these Regulations came into force.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>This paragraph applies in a case where—</p></intro><level class="para1" eId="regulation-7-2-a"><num>(a)</num><content><p>a person had paid relevant travelling expenses or relevant charges before 1st November 2015 without exercising the person’s right under regulation 3(1) of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr>;</p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p>the person was entitled to a repayment by virtue of regulation 11(1) of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> (entitlement to full remission and payment); and</p></content></level><level class="para1" eId="regulation-7-2-c"><num>(c)</num><content><p>but for the application of this regulation, that entitlement would cease by virtue of the amendments made to regulation 4 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr>”), the National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (<abbr title="Number">No.</abbr> 2) Regulations 2003 (“the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr>”) and the National Health Service (Optical Charges and Payments and General Ophthalmic Services) (Scotland) Amendment Regulations 2015 (“the <abbr title="National Health Service (Optical Charges and Payments and General Ophthalmic Services) (Scotland) Amendment Regulations 2015 (S.S.I. 2015/219)">2015 Regulations</abbr>”).</p></blockContainer><blockContainer ukl:Name="P"><p>Amendments are made to the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> and the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> in order to insert certain income thresholds for persons in receipt of universal credit who are eligible persons in terms of those Regulations.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 8 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> makes provision for eligibility for payments to meet or contribute to the cost of the supply of optical appliances. Those who are eligible for such assistance include persons in receipt of universal credit. Regulation 2 of these Regulations amends regulation 8 of the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr> so that, after 31st October 2015, a person receiving universal credit without a child element, a limited capability for work (LCW) element or a limited capability for work and work-related activity (LCWRA) element is eligible for assistance if that person has no earned income or earned income of £435 per month or less. A person (or a qualifying young person for whom the recipient is responsible) will also be entitled to such assistance if that person is in receipt of universal credit with any of the aforementioned elements to the award and has no earned income or earned income of £935 per month or less.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 3 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> provides that persons of certain descriptions are entitled to payment of the travelling expenses incurred in attending hospital for the provision of <abbr class="acronym" title="National Health Service">NHS</abbr> services (including where necessary overnight accommodation and expenses related to a person accompanying the person receiving the service) and the remission of charges payable for certain <abbr class="acronym" title="National Health Service">NHS</abbr> services. Regulation 4 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> prescribes descriptions of persons for the purpose of this entitlement. Those descriptions include persons in receipt of universal credit. Regulation 3 of these Regulations amends regulation 4 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> so that, after 31st October 2015, certain income thresholds apply in relation to the eligibility of a person receiving universal credit for payment or remission under regulation 3 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr>. The income thresholds are the same as those described above in relation to the <abbr title="National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (S.I. 1998/642)">1998 Regulations</abbr>. Regulation 4 of the <abbr title="National Health Service (Travelling Expenses and Remission of Charges) (Scotland) (No. 2) Regulations 2003 (S.S.I. 2003/460)">2003 Regulations</abbr> is also amended to remove a reference to a member of a couple not included in an award of Universal Credit.</p></blockContainer><blockContainer ukl:Name="P"><p>An amendment is made to the <abbr title="National Health Service (Optical Charges and Payments and General Ophthalmic Services) (Scotland) Amendment Regulations 2015 (S.S.I. 2015/219)">2015 Regulations</abbr> by regulation 4 of these Regulations in order to correct a reference within the <abbr title="National Health Service (Optical Charges and Payments and General Ophthalmic Services) (Scotland) Amendment Regulations 2015 (S.S.I. 2015/219)">2015 Regulations</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 5 to 7 of these Regulations make saving provisions to extend eligibility of certain persons who will no longer be eligible for assistance, or entitled to remission of charges or payment of expenses, because of the insertion of the income thresholds described above.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
