Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 9(2) of the Public Bodies (Joint Working) (Scotland) Act 20141 and all other powers enabling them to do so.

Citation and commencement1

This Order may be cited as the Public Bodies (Joint Working) (Integration Joint Board Establishment) (Scotland) Amendment (No. 2) Order 2015 and comes into force on 21st September 2015.

The Public Bodies (Joint Working) (Integration Joint Board Establishment) (Scotland) Order 20152 is amended as follows.

In the Schedule (integration joint boards), at the end and in the appropriate columns, insert—

Integration joint boards established on 21st September 2015

South Lanarkshire Integration Joint Board

The area of South Lanarkshire Council

West Lothian Integration Joint Board

The area of West Lothian Council

Western Isles Integration Joint Board

The area of Comhairle nan Eilean Siar

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Public Bodies (Joint Working) (Integration Joint Board Establishment) (Scotland) Order 2015 (“the establishment Order”) in order to establish integration joint boards for the purposes of the Public Bodies (Joint Working) (Scotland) Act 2014 (“the 2014 Act”).

The Schedule to the establishment Order contains a list of integration joint boards established for specified local authority areas. Article 2 amends this list to insert details of 3 integration joint boards to be established on 21st September 2015: South Lanarkshire Integration Joint Board, West Lothian Integration Joint Board and Western Isles Integration Joint Board.

By virtue of the 2014 Act, once an integration joint board is established, it is to carry out such statutory health and social care functions as the local authority and health board for that area delegate to it. Full provision for the delegation of functions and the local operation of each integration joint board is set out in an integration scheme prepared under section 1 or 2 of the 2014 Act, which has been approved by the Scottish Ministers in advance of the integration joint board being established.
