Ministers make the following Regulations in exercise of the powers conferred by sections 1 and 54(2) of the Building (Scotland) Act 2003<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/asp/2003/8">2003 asp 8</ref>. Section 24 was relevantly amended by paragraph 22 of schedule 6 to the Housing (Scotland) Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/asp/2006/1">2006 (asp 1)</ref>.</p></authorialNote> and all other powers enabling them to do so.</p><formula name="enactingText"><p>In accordance with section 1(2) of that Act<authorialNote class="footnote" eId="f00002" marker="2"><p>Section 1(2) was amended by section 6(2) of the Public Services Reform (Scotland) Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/asp/2010/8">2010 (asp 8)</ref>.</p></authorialNote> they have consulted with such persons as appear to them to be representative of the interests concerned.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Building (Scotland) Amendment Regulations 2015.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations (other than regulations 3 and 4) come into force on 9th July 2015.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>Regulations 3 and 4 come into force on 1st October 2015.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Building (Scotland) Regulations 2004 – 9th July 2015</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The Building (Scotland) Regulations 2004<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/ssi/2004/406">S.S.I. 2004/406</ref>.</p></authorialNote> are amended in accordance with paragraph (2).</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>In Schedule 5 (building standards applicable to design and construction), in the limitation to the standard contained in paragraph 6.9 (energy performance certificates), in sub-paragraph (b)(i)<authorialNote class="footnote" eId="f00004" marker="4"><p>Sub-paragraph (b) was substituted by <ref eId="c00005" href="http://www.legislation.gov.uk/id/ssi/2012/209">S.S.I. 2012/209</ref>.</p></authorialNote> for “500” substitute “250”.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Amendment of the Building (Scotland) Regulations 2004 – 1st October 2015</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>The Building (Scotland) Regulations 2004 are amended in accordance with paragraph (2).</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>In Schedule 5, in the limitation to the standard contained in paragraph 6.3 (heating system)<authorialNote class="footnote" eId="f00005" marker="5"><p>Paragraph 6.3 was substituted by <ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2006/534">S.S.I. 2006/534</ref>.</p></authorialNote> omit sub-paragraph (c) and “or” immediately preceding that sub-paragraph.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Transitional provision</heading><num>4.</num><intro><p>The amendments made by regulation 3 do not apply to work which, by virtue of regulation 5 of and Schedule 3 to the Building (Scotland) Regulations 2004, does not require a building warrant if that work is—</p></intro><level class="para1" eId="regulation-4-a"><num>(a)</num><content><p>completed before 1st October 2015; or</p></content></level><level class="para1" eId="regulation-4-b"><num>(b)</num><intro><p>not completed before that date and—</p></intro><level class="para2" eId="regulation-4-b-i"><num>(i)</num><content><p>the contract for the work is entered into before 1st October 2015;
