The Scottish Ministers make the following Order in exercise of the power conferred by section 122 of the Land Registration etc. (Scotland) Act 2012(1).

Citation and commencement

1.  This Order may be cited as the Land Registration etc. (Scotland) Act 2012 (Designated Day) Order 2014 and comes into force on 28th May 2014.

Designated day

2.  The designated day for the purposes of the Land Registration etc. (Scotland) Act 2012 is 8th December 2014.

EXPLANATORY NOTE

(This note is not part of the Order)

Under this Order, the designated day for the purposes of the Land Registration etc. (Scotland) Act 2012 is 8th December 2014. The following provisions come into force on the designated day under section 123(2) of that Act—

• Part 1, sections 1 to 20 and schedule 1 (the Land Register)

• Part 2, sections 21 to 48 (registration)

• Part 3, sections 49 to 52, 53(1) to (3) and (5), 54 and 55 and schedule 2 (competence and effect of registration)

• Part 4, sections 56 to 63 (advance notices)

• Part 5, sections 65 and 66 (inaccuracies in the register)

• Part 6, sections 67 to 72 (caveats)

• Part 7, sections 73 to 79 (Keeper’s warranty)

• Part 8, sections 80 to 85 (rectification of the register)

• Part 9, sections 86 to 95 (rights of persons acquiring etc. in good faith).

Sections 101 to 106, 111, 112, 114(2), 115, 118 (and schedule 4), 119 (and schedule 5), 120 and 121.

The Bill for the Land Registration etc. (Scotland) Act 2012 received Royal Assent on 10th July 2012. Sections 113, 114(1), 116, 117, 122, 123 and 124 came into force the following day.
