following Regulations in exercise of the powers conferred by sections 48 and 125(1) of the Police and Fire Reform (Scotland) Act 2012<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/asp/2012/8">2012 asp 8</ref>.</p></authorialNote> and all other powers enabling them to do so.</p><formula name="enactingText"><p>In accordance with section 54(2) of that Act, they have consulted and shared a draft of the Regulations with the persons mentioned in section 54(2)(a)(i) to (vi) and have considered any representations made.</p></formula></preamble><body eId="body"><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Police Service of Scotland (Promotion) Regulations 2013 and come into force on 1st April 2013.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply only in relation to promotions to the ranks below that of assistant chief constable.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations (except where the context otherwise requires)—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Police (Promotion) (Scotland) Regulations 1968 (S.I. 1968/717)">1968 Regulations</abbr>” means the Police (Promotion) (Scotland) Regulations 1968<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/1968/17">S.I.1968/717</ref>, amended by <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/1971/344">S.I.1971/344</ref>, <ref eId="c00011" href="http://www.legislation.gov.uk/id/uksi/1976/1073">1976/1073</ref>, <ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/1981/86">1981/86</ref>, <ref eId="c00013" href="http://www.legislation.gov.uk/id/uksi/1984/648">1984/648</ref>, <ref eId="c00014" (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>” means the Police (Promotion) (Scotland) Regulations 1996<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00018" href="http://www.legislation.gov.uk/id/uksi/1996/221">S.I.1996/221</ref>, amended by <ref eId="c00019" href="http://www.legislation.gov.uk/id/ssi/2004/257">S.S.I.2004/257</ref>, <ref eId="c00020" href="http://www.legislation.gov.uk/id/ssi/2007/528">2007/528</ref> and <ref eId="c00021" href="http://www.legislation.gov.uk/id/ssi/2009/372">2009/372</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“constable” has the meaning given by section 99(1) of the Police and Fire Reform (Scotland) Act 2012, except that it does not include—</p></intro><level class="para1"><num>(a)</num><content><p>the chief constable;</p></content></level><level class="para1"><num>(b)</num><content><p>other senior officers; or</p></content></level><level class="para1"><num>(c)</num><content><p>any special constable (being an individual appointed under section 9 of that Act); </p></content></level></hcontainer><hcontainer name="definition"><content><p><ins class="first last" ukl:ChangeId="key-adaa4f9e514d186c41ca6fd73502a26a-1733738617000" 4A(1);</ins></p></content></hcontainer><hcontainer name="definition"><content><p>“qualifying diploma” has the meaning given by regulation 4(1);</p></content></hcontainer><hcontainer name="definition"><content><p>“qualifying examination A (elementary)” means an examination, a pass in which being a qualification for promotion from the rank of constable to that of sergeant, held before 8th March 1993 under arrangements made by the Police (Scotland) Examinations Board in accordance with the Schedule to the <abbr title="Police (Promotion) (Scotland) Regulations 1968 (S.I. 1968/717)">1968 Regulations</abbr><authorialNote class="footnote" eId="f00004" marker="4"><p>The Schedule was relevantly amended by <ref eId="c00022" href="http://www.legislation.gov.uk/id/uksi/1971/344">S.I.1971/344</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“qualifying examination A (advanced)” means an examination, a pass in which being a qualification for promotion from the rank of sergeant to that of inspector, held before 8th March 1993 under arrangements made by the Police (Scotland) Examinations Board in accordance with the Schedule to the <abbr title="Police (Promotion) (Scotland) Regulations 1968 (S.I. 1968/717)">1968 Regulations</abbr><authorialNote class="footnote" eId="f00005" marker="5"><p>The Schedule was relevantly amended by <ref eId="c00023" Police (Scotland) Promotion Examination, a pass in which being a qualification for promotion, held at any time during the period beginning on 8th March 1993 and ending on 29th February 1996 under arrangements made by the Police (Scotland) Examinations Board in accordance with the Schedule to the <abbr title="Police (Promotion) (Scotland) Regulations 1968 (S.I. 1968/717)">1968 Regulations</abbr><authorialNote class="footnote" eId="f00006" marker="6"><p>The Schedule was relevantly amended by <ref eId="c00024" accordance with Schedule 1 to the <abbr title="Police (Promotion) (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>In these Regulations, except where otherwise indicated, any reference to—</p></intro><level class="para1" eId="regulation-2-2-a"><num>(a)</num><content><p>a numbered regulation, is reference to the regulation so numbered in these Regulations;</p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p>a numbered paragraph in a regulation or Schedule to these Regulations, is a reference to the paragraph so numbered in that regulation or, as the case may be, in that Schedule; and</p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>a numbered Schedule, is a reference to the Schedule to these Regulations so numbered.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading><ins class="substitution first" ukl:CommentaryRef="key-be1c00f0080347ab6ec65a28a4477883">(1)</ins></num><content><p><ins class="substitution" ukl:ChangeId="key-be1c00f0080347ab6ec65a28a4477883-1733738724000" ukl:CommentaryRef="key-be1c00f0080347ab6ec65a28a4477883">A constable qualifies for promotion only if the constable has obtained the qualifying diploma or has completed the PLDP.</ins></p></content></paragraph><paragraph eId="regulation-3-2"><num><ins class="substitution" ukl:ChangeId="key-be1c00f0080347ab6ec65a28a4477883-1733738724000" ukl:CommentaryRef="key-be1c00f0080347ab6ec65a28a4477883">(2)</ins></num><content><p><ins class="substitution last" ukl:ChangeId="key-be1c00f0080347ab6ec65a28a4477883-1733738724000" ukl:CommentaryRef="key-be1c00f0080347ab6ec65a28a4477883">Paragraph (1) does not apply to a constable promoted temporarily to the rank of sergeant for the purpose of their participation in the PLDP.</ins></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Qualifying diploma</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>The qualifying diploma is the Diploma in Police Service Leadership and Management, obtained on or after 1st April 2013.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>A constable is eligible to take the course to obtain the qualifying diploma (“the qualifying diploma course”), only if the constable has—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>completed the required period of probation in the rank of constable; and</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>successfully applied for a place on the course.</p></content></level></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><intro><p>For the purpose of paragraph (2)(a)—</p></intro><level class="para1" eId="regulation-4-3-a"><num>(a)</num><content><p>“required period of probation” means the period of probation determined under regulation 8 of the Police Service of Scotland Regulations 2013<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00026" href="http://www.legislation.gov.uk/id/ssi/2013/35">S.S.I.2013/35</ref>.</p></authorialNote>;</p></content></level><level class="para1" eId="regulation-4-3-b"><num>(b)</num><content><p>a constable is taken to have completed the required period of probation if the constable has completed such period of probation, in any police force specified in regulation 8(4) of those Regulations, as is required of constables appointed to the rank of constable in that police force.</p></content></level></paragraph><paragraph eId="regulation-4-4"><num><noteRef href="#key-ab38b706a8baed8c94e26035a85f2efc" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>(4)</num><content><p>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .</p></content></paragraph><paragraph eId="regulation-4-5"><num>(5)</num><intro><p>The Scottish Ministers must determine—</p></intro><level class="para1" eId="regulation-4-5-a"><num>(a)</num><content><p>the application process and procedures in relation to the qualifying diploma course; and</p></content></level><level class="para1" eId="regulation-4-5-b"><num>(b)</num><content><p>the content and format of the syllabus upon which the qualifying diploma course will be based.</p></content></level></paragraph><paragraph eId="regulation-4-6"><num>(6)</num><content><p>The Scottish Ministers may, in making a determination under paragraph (5), confer such functions on the Authority or the chief constable in relation to that determination as they think fit.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4A"><heading><ins class="first" ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26"><noteRef uk:name="commentary" href="#key-d7e8dc422527bc2bb8973fa0ad412b26" class="commentary"/>Police Leadership Development Programme</ins></heading><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">4A.</ins></num><paragraph eId="regulation-4A-1"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(1)</ins></num><content><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">The PLDP is the Police Leadership Development Programme, completed on or after 1st March 2021.</ins></p></content></paragraph><paragraph eId="regulation-4A-2"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(2)</ins></num><intro><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">A constable may participate in the PLDP only if the constable has—</ins></p></intro><level class="para1" eId="regulation-4A-2-a"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(a)</ins></num><content><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">completed the required period of probation in the rank of constable; ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">successfully applied for a place on the PLDP.</ins></p></content></level></paragraph><paragraph eId="regulation-4A-3"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(3)</ins></num><content><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">A constable who is to participate in the PLDP is to be promoted temporarily to the rank of sergeant on the first day of the constable participating in the PLDP, for such a period and on such conditions as the chief constable may determine.</ins></p></content></paragraph><paragraph eId="regulation-4A-4"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(4)</ins></num><intro><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">The Scottish Ministers may, in making a determination under paragraph (5), confer such functions on the Authority or the chief constable in relation to that determination as they think fit.</ins></p></content></paragraph><paragraph eId="regulation-4A-7"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(7)</ins></num><content><p><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">The chief constable may remove a constable from the PLDP if the chief constable considers that the constable is not performing satisfactorily on the PLDP.</ins></p></content></paragraph><paragraph eId="regulation-4A-8"><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">(8)</ins></num><content><p><ins class="last" ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738538000" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">Where a constable is removed from the PLDP under paragraph (7), the constable is no longer eligible to participate in the PLDP unless they successfully reapply for a place on the PLDP in accordance with paragraph (2)(b).</ins></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4B"><heading><ins class="first" ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738558755" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26"><noteRef uk:name="commentary" href="#key-d7e8dc422527bc2bb8973fa0ad412b26" class="commentary"/>Requirement to hold qualification for promotion process</ins></heading><num><ins ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738558755" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">4B.</ins></num><content><p><ins class="last" ukl:ChangeId="key-d7e8dc422527bc2bb8973fa0ad412b26-1733738558755" ukl:CommentaryRef="key-d7e8dc422527bc2bb8973fa0ad412b26">The chief constable must hold either of the qualifying diploma or the PLDP at least once in each calendar year.</ins></p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Selection for promotion</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>Promotion from one rank to another rank is to be by selection.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The fact that a constable qualifies for promotion does not entitle the constable to promotion, or to promotion before another constable who qualified for promotion at a later date.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Period of probation for constable promoted to the rank of sergeant</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><intro><p>A constable who is promoted to the rank of sergeant (“a sergeant”) is to be on probation in that rank for a period of—</p></intro><level class="para1" eId="regulation-6-1-a"><num>(a)</num><content><p>one year; or</p></content></level><level class="para1" eId="regulation-6-1-b"><num>(b)</num><content><p>for such longer period, not exceeding two years, as the chief constable (whether at the time of the promotion or at any time during the period of probation) considers is appropriate in the circumstances of a particular case.</p></content></level></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>Any period of temporary promotion by virtue of regulation 7(2) is to be disregarded in calculating the period of probation.</p></content></paragraph><paragraph eId="regulation-6-2A"><num><ins class="first" ukl:ChangeId="key-387735616e8ee2e1b69b0152dc2280ef-1733738882000" ukl:CommentaryRef="key-387735616e8ee2e1b69b0152dc2280ef"><noteRef uk:name="commentary" href="#key-387735616e8ee2e1b69b0152dc2280ef" class="commentary"/>(2A)</ins></num><content><p><ins class="last" ukl:ChangeId="key-387735616e8ee2e1b69b0152dc2280ef-1733738882000" ukl:CommentaryRef="key-387735616e8ee2e1b69b0152dc2280ef">Notwithstanding paragraph (2), any period of temporary promotion by virtue of regulation 4A(3) must be taken into account in calculating the period of probation under paragraph (1), unless the constable was removed from the PLDP by virtue of regulation 4A(7) during that period of temporary promotion.</ins></p></content></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><content><p>The chief constable may demote a sergeant to the rank of constable at any time during the period of probation if the chief constable considers that the officer is not likely to perform satisfactorily a sergeant’s duties.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Temporary promotion</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><intro><p>Paragraph (2) applies to a constable who—</p></intro><level class="para1" eId="regulation-7-1-a"><num>(a)</num><content><p>is required to perform the duties of a higher rank; and</p></content></level><level class="para1" eId="regulation-7-1-b"><num>(b)</num><content><p>has obtained the qualifying diploma <ins class="first last" ukl:ChangeId="key-603c2ee0915fd8655ad0ae3ac055fe4e-1733738985000" ukl:CommentaryRef="key-603c2ee0915fd8655ad0ae3ac055fe4e"><noteRef uk:name="commentary" href="#key-603c2ee0915fd8655ad0ae3ac055fe4e" class="commentary"/>or completed the PLDP</ins>.</p></content></level></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>A constable to whom this paragraph applies may be promoted temporarily to that higher rank, for such period and on such conditions as the chief constable may determine.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Accelerated Promotion Programme</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><intro><p>Paragraph (2) applies to a constable of the rank of constable who—</p></intro><level class="para1" eId="regulation-8-1-a"><num>(a)</num><content><p>is selected to participate in an Accelerated Promotion Programme; and</p></content></level><level class="para1" eId="regulation-8-1-b"><num>(b)</num><intro><p>at the beginning of the Programme, has either—</p></intro><level class="para2" eId="regulation-8-1-b-i"><num>(i)</num><content><p>obtained the qualifying diploma; or</p></content></level><level class="para2" eId="regulation-8-1-b-ii"><num>(ii)</num><content><p>passed a previous qualifying examination.</p></content></level></level></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><content><p>A constable to whom this paragraph applies is to be promoted temporarily to the rank of sergeant on the first day of the constable participating in the Programme, for such period and on such conditions as the chief constable may determine.</p></content></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><intro><p>In this regulation—</p></intro><hcontainer name="definition"><content><p>“Accelerated Promotion Programme” means a programme for the time being designated by the Scottish Ministers, for the purpose of this regulation, as the Accelerated Promotion Programme;</p></content></hcontainer><hcontainer name="definition"><intro><p>“previous qualifying examination” means—</p></intro><level class="para1"><num>(a)</num><content><p>qualifying examination A (elementary);</p></content></level><level class="para1"><num>(b)</num><content><p>qualifying examination B; or</p></content></level><level class="para1"><num>(c)</num><content><p>qualifying examination C.</p></content></level></hcontainer></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Recognition of examinations in certain police forces</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><intro><p>If, during any previous service in a police force specified in paragraph (2), a constable has passed an examination or course which would qualify the constable for promotion in that police force—</p></intro><level class="para1" eId="regulation-9-1-a"><num>(a)</num><content><p>from the rank of constable to that of sergeant, the constable is taken to have obtained the qualifying diploma to qualify for promotion up to (and including) the rank of inspector for the purposes of regulations 3, 7 and 8; or</p></content></level><level class="para1" eId="regulation-9-1-b"><num>(b)</num><content><p>from the rank of sergeant to that of inspector, the constable is taken to have obtained the qualifying diploma to qualify for promotion to any rank below that of assistant chief constable for the purposes of regulations 3 and 7.</p></content></level></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><intro><p>The police forces are—</p></intro><level class="para1" eId="regulation-9-2-a"><num>(a)</num><content><p>a police force maintained under section 2(1) of the Police Act 1996<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00027" href="http://www.legislation.gov.uk/id/ukpga/1996/16">1996 c.16</ref>; section 2 was amended by paragraph 4 of Schedule 16 to the Police Reform and Social Responsibility Act <ref eId="c00028" href="http://www.legislation.gov.uk/id/ukpga/2011/13">2011 (c.13)</ref>.</p></authorialNote>;</p></content></level><level class="para1" eId="regulation-9-2-b"><num>(b)</num><content><p>the metropolitan police force;</p></content></level><level class="para1" eId="regulation-9-2-c"><num>(c)</num><content><p>the City of London police force;</p></content></level><level class="para1" eId="regulation-9-2-d"><num>(d)</num><content><p>the Police Service of Northern Ireland;</p></content></level><level class="para1" eId="regulation-9-2-e"><num>(e)</num><content><p>the British Transport Police Force;</p></content></level><level class="para1" eId="regulation-9-2-f"><num>(f)</num><content><p>the States of Jersey Police Force;</p></content></level><level class="para1" eId="regulation-9-2-g"><num>(g)</num><content><p>the salaried police force of the Island of Guernsey; and</p></content></level><level class="para1" eId="regulation-9-2-h"><num>(h)</num><content><p>the Isle of Man Constabulary.</p></content></level></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><content><p>Paragraph (1) does not apply in the case of a constable who has passed an examination which would qualify the constable for promotion in the Isle of Man Constabulary where that examination was taken before 1st<span ukl:Name="NonBreakingSpace"> </span>January 1983.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Determinations</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><intro><p>Before making a determination under these Regulations, the Scottish Ministers must—</p></intro><level class="para1" eId="regulation-10-1-a"><num>(a)</num><content><p>consult and share a draft of that determination with the persons mentioned in section 54(2)(a)(i) to (vi) of the Police and Fire Reform (Scotland) Act 2012<authorialNote class="footnote" eId="f00009" marker="9"><p><ref eId="c00029" href="http://www.legislation.gov.uk/id/asp/2012/8">2012 asp 8</ref>.</p></authorialNote>; and</p></content></level><level class="para1" eId="regulation-10-1-b"><num>(b)</num><content><p>consider any representations made.</p></content></level></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><intro><p>A determination under these Regulations may—</p></intro><level class="para1" eId="regulation-10-2-a"><num>(a)</num><content><p>make different provision for different cases and circumstances;</p></content></level><level class="para1" eId="regulation-10-2-b"><num>(b)</num><content><p>vary or revoke earlier determinations under these Regulations.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Revocations and transitional provisions</heading><num>11.</num><paragraph eId="regulation-11-1"><num>(1)</num><content><p>The instruments specified in column 1 of Schedule (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>, continues to have effect on and after that date as if it had been done for the purposes of (and in accordance with) the corresponding provision of these Regulations—</p></intro><level class="para1" eId="schedule-2-paragraph-3-a"><num>(a)</num><content><p>any application, selection or promotion made;</p></content></level><level class="para1" eId="schedule-2-paragraph-3-b"><num>(b)</num><content><p>any place obtained; or</p></content></level><level class="para1" eId="schedule-2-paragraph-3-c"><num>(c)</num><content><p>any course held.</p></content></level></paragraph><paragraph eId="schedule-2-paragraph-4" class="schProv1"><num>4.</num><content><p>Any period of probation served, before 1st April 2013, as a constable of a police force maintained under the Police (Scotland) Act 1967<authorialNote class="footnote" eId="f00010" marker="10"><p><ref eId="c00030" href="http://www.legislation.gov.uk/id/ukpga/1967/77">1967 c.77</ref>.</p></authorialNote> for the purpose of (and in accordance with) regulation 2(2A)(a) or 4(1) of the <abbr title="Police (Promotion) (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>, continues to have effect on and after that date as if it had been service on probation in the Police Service for the purpose of (and in accordance with) regulation 4(2)(a) or 6(1), respectively.</p></content></paragraph></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><heading>EXPLANATORY NOTE</heading><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations make provision in relation to the eligibility and procedure for the promotion of constables of the Police Service of Scotland.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>apply only to promotions to the ranks below that of assistant chief constable, which are promotions the chief constable makes under section 11(3) of the Police and Fire Reform (Scotland) Act 2012 (regulation 1(2));</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>define “constable” so as to apply to constables (other than the chief constable, other senior officers and special constables) of the Police Service of Scotland, including those on temporary service under section 15 or 16 of that Act (regulation 2(1));</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>require such constables to have obtained the qualifying diploma to qualify for promotion (regulation 3);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>make provision in relation to the qualifying diploma, including eligibility to take the qualifying diploma course and the Scottish Ministers’ function of determining certain matters (subject to a consultation requirement) (regulations 4 and 10);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(e)</num><p>provide that promotion is to be by selection, and that qualification for promotion is not an entitlement to promotion (regulation 5);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(f)</num><p>require a constable, who is promoted to the rank of sergeant, to serve a period of probation in that rank, and authorise the chief constable to demote any such constable, during the period of probation, if satisfied that the constable is not likely to perform satisfactorily a sergeant’s duties (regulation 6);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(g)</num><p>provide for temporary promotion, both generally (regulation 7) and in relation to constables, holding the rank of constable, who are selected to participate in an Accelerated Promotion Programme (regulation 8);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(h)</num><p>recognise examinations passed in certain other <abbr class="acronym" title="United Kingdom">UK</abbr> police forces as relevant qualification for promotion in the Police Service of Scotland (regulation 9);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(i)</num><p>revoke the Police (Promotion) (Scotland) Regulations 1996 (“the <abbr title="Police (Promotion) (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>”) and the enactments that have amended those Regulations (regulation 11(1) and Schedule 1); and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(j)</num><p>make transitional provisions, including provision that constables, who before 1st April 2013 were qualified for promotion under the <abbr title="Police (Promotion) (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>, are taken to have obtained the qualifying diploma to qualify for promotion in the Police Service of Scotland; and that periods of probation served as a constable of a police force maintained under the Police (Scotland) Act 1967 for the purposes of the <abbr title="Police (Promotion) (Scotland) Regulations 1996 (S.I. 1996/221)">1996 Regulations</abbr>, continue to have effect as if they had been service on probation in the Police Service of Scotland for the purposes of these Regulations (regulation 11(2) and Schedule
