The Defamation Act 2013 (Commencement) (Scotland) Order 2013

The Scottish Ministers make the following Order in exercise of the power conferred by section 17(5) of the Defamation Act 2013(1).

Citation and commencement

1.  This Order may be cited as the Defamation Act 2013 (Commencement) (Scotland) Order 2013 and comes into force on 1st January 2014.

Appointed day

2.  The day appointed for the coming into force of sections 6 (peer-reviewed statement in scientific or academic journal) and 7(9) (reports etc protected by privilege) of the Defamation Act 2013, in so far as those sections extend to Scotland, is 1st January 2014.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force sections 6 and 7(9) of the Defamation Act 2013 (“the 2013 Act”) in so far as those sections extend to Scotland. Sections 6, 7(9), 15, 16(5) (in so far as it relates to sections 6 and 7(9)) and 17 of the 2013 Act extend to Scotland.

The Bill for the 2013 Act received Royal Assent on 25th April 2013. Section 15, section 16(4) to (8) and section 17 of the 2013 Act came into force that day.

2013 c.26. The Scottish Ministers’ power is exercisable in relation to sections 6 and 7(9) of the Act in so far as they extend to Scotland. Commencement of other provisions of the Act in so far as they extend to England and Wales, and are not already commenced by section 17(6), is exercisable by the Secretary of State under section 17(4) of the Act.
