IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/10" id="regulation-10"><Pnumber>10</Pnumber><P1para><Text>No person may use as an extraction solvent in the production of food any extraction solvent that is not a permitted extraction solvent.</Text></P1para></P1></P1group><P1group RestrictStartDate="2013-10-31"><Title/><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/11" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/11" id="regulation-11"><Pnumber>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>No person may place on the market—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/11/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/11/1/a" id="regulation-11-1-a"><Pnumber>a</Pnumber><P3para><Text>an extraction solvent that is not a permitted extraction solvent; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/11/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/11/1/b" id="regulation-11-1-b"><Pnumber>b</Pnumber><P3para><Text>any food having in it or on it an added extraction solvent that is not a permitted extraction solvent.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>No person may place on the market an extraction solvent that does not meet the requirements of regulation 12.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2023-02-09"><Title/><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/12" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/12" id="regulation-12-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraph (2), the following information must appear on the packaging, container or label—</Text><P3 IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/12/1/c" id="regulation-12-1-c"><Pnumber>c</Pnumber><P3para><Text>a reference by which the batch or lot may be identified;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/12/1/d" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/12/1/d" id="regulation-12-1-d"><Pnumber>d</Pnumber><P3para><Text>the name or business name and address of the manufacturer or packer or of a seller established in the  <Substitution ChangeId="key-e14d5b8f4c5899ceffe8bd30b5baedd2-1664544143449" CommentaryRef="key-e14d5b8f4c5899ceffe8bd30b5baedd2">United Kingdom</Substitution>;</Text></P3para></P3><P3 id="regulation-12-1-e"><Pnumber>e</Pnumber><P3para><Text>the net quantity given as units of volume; and</Text></P3para></P3><P3 id="regulation-12-1-f"><Pnumber>f</Pnumber><P3para><Text>if necessary, the special storage conditions or conditions of use.</Text></P3para></P3></P2para></P2><P2 IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/17/1" id="regulation-17-1"><Pnumber>1</Pnumber><P2para><Text>The following provisions of the Act apply for the purposes of these Regulations with the modification that any reference in those provisions to the Act or Part of it is to be construed as a reference to these Regulations—</Text><P3 id="regulation-17-1-a"><Pnumber>a</Pnumber><P3para><Text>section 20 (offences due to fault of another person);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/17/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/17/1/b" id="regulation-17-1-b"><Pnumber>b</Pnumber><P3para><Text>section 21 (defence of due diligence) <CommentaryRef Ref="c21894451"/> with the modification that—</Text><P4 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/17/1/b/i" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/17/1/b/i" id="regulation-17-1-b-i"><Pnumber>i</Pnumber><P4para><Text>subsections (2) to (4) apply in relation to an offence under regulation 3, 4, 5, 6 or 15 as they apply in relation to an offence under id="regulation-17-1-c"><Pnumber>c</Pnumber><P3para><Text>section 30(8) (which relates to documentary evidence);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/266/regulation/17/1/d" IdURI="http://www.legislation.gov.uk/id/ssi/2013/266/regulation/17/1/d" id="regulation-17-1-d"><Pnumber>d</Pnumber><P3para><Text>section 35(1) (punishment of offences), in so far as it relates to offences under section 33(1) as applied by paragraph id="regulation-17-2"><Pnumber>2</Pnumber><P2para><Text>The following provisions of the Act apply for the purposes of these Regulations with the modification that any reference in those provisions to 4</Emphasis>).</Text></P3para></P3></P1para></P1><P1><Pnumber>4</Pnumber><P1para><Text>Part 3 of these Regulations implement Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2009/0032" id="c00023" Class="EuropeanUnionDirective" Year="2009" Number="32">2009/32/EC</Citation> relating to extraction solvents, in particular by—</Text><P3><Pnumber>a</Pnumber><P3para><Text>specifying the circumstances where the controls on extraction solvents do not apply (<Emphasis>regulation 8</Emphasis>);</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>defining what constitutes a permitted extraction solvent (<Emphasis>regulation 9</Emphasis>);</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>prohibiting any person from using an extraction solvent other than a permitted extraction solvent, as defined, in the production of food (<Emphasis>regulation 10</Emphasis>);</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>prohibiting any person from placing on the market an extraction solvent that is not a permitted extraction solvent or which is not accompanied by certain information on the packaging, container or label (<Emphasis>regulations 11 and 12</Emphasis>).</Text></P3para></P3></P1para></P1><P1><Pnumber>5</Pnumber><P1para><Text>These Regulations in Part 4—</Text><P3><Pnumber>a</Pnumber><P3para><Text>designate the Food Standards Agency as the competent authority for the purposes of applications for authorisation of a smoke flavouring (<Emphasis>regulation 13</Emphasis>);</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>assign the duty of enforcing these Regulations to food authorities (<Emphasis>regulation 14</Emphasis>);</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>provide for the maximum penalty to which a person may be liable on conviction for an offence under these Regulations (<Emphasis>regulation 15</Emphasis>);</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>provide that, where it appears to an authorised officer that a product fails to comply with certain requirements or that food is placed on the market contrary to a specified prohibition, the food will be treated for the purposes of subsections (3) to (9) of section 9 of the Food Safety Act 1990 (with certain modifications) as failing to comply with food safety requirements (<Emphasis>regulation 16</Emphasis>); and</Text></P3para></P3><P3><Pnumber>e</Pnumber><P3para><Text>apply, with certain modifications, various provisions of the Food Safety Act 1990 for the purposes of these Regulations (<Emphasis>regulation 17</Emphasis>).</Text></P3para></P3></P1para></P1><P1><Pnumber>6</Pnumber><P1para><Text>These Regulations in Part 5—</Text><P3><Pnumber>a</Pnumber><P3para><Text>make a minor amendment to the Food Labelling Regulations 1996 (<Emphasis>regulation 20</Emphasis>) and the Jam and Similar Products (Scotland) Regulations 2004; and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>revoke certain instruments in whole or in part (<Emphasis>regulation 19 and Schedule
