Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 13(3) of the Marine Navigation Act 20131.

Citation and commencement1

This Order may be cited as the Marine Navigation Act 2013 (Commencement) (Scotland) Order 2013 and comes into force on 1st October 2013.

Appointed day2

The day appointed for the coming into force of sections 1 to 6 of the Marine Navigation Act 2013 in Scotland is 1st October 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings sections 1 to 6 of the Marine Navigation Act 2013 (“the Act”) into force in Scotland on 1st October 2013. These sections concern pilotage matters, harbour directions and harbour closure orders.

Sections 1 to 6 are the only sections of the Act which fall to be commenced by an order made by the Scottish Ministers. The Marine Navigation Act 2013 (Commencement) Order 2013 (S.I. 2013/1489) brought sections 7 to 11 of the Act into force on 26th June 2013. It also provided for 1st October 2013 to be the commencement date for sections 1 to 4 in England and Wales and for sections 5 and 6 (in England and Wales, except in relation to fishery harbours in Wales).
