The Public Services Reform (Scotland) Act 2010 Modification Order 2013
In accordance with section 25(3)(a) of that Act, they have consulted Children’s Hearings Scotland.
In accordance with section 25(3)(b)(ii) of that Act, they have laid before the Scottish Parliament an explanatory document.
Citation and commencement1.

This Order may be cited as the Public Services Reform (Scotland) Act 2010 Modification Order 2013.

Modification of schedule 5 to the Public Services Reform (Scotland) Act 20102.
In schedule 5 (improvement of public functions: listed bodies) to the Public Services Reform (Scotland) Act 2010—
(a)
omit “any Children’s Panel” and “any Children’s Panel Advisory Committee”; and
(b)
after “Caledonian Maritime Assets Ltd” insert “Children’s Hearings Scotland”.

This Order makes modifications to schedule 5 of the Public Services Reform (Scotland) Act 2010 (“the 2010 Act”) in consequence of the Children’s Hearings (Scotland) Act 2011.
Schedule 5 of the 2010 Act is introduced by section 15 (public functions: further provision) of that Act and lists the persons, bodies and office-holders in respect of which the Scottish Ministers may, by order under section 14 of that Act, make any provision which they consider would improve the exercise of public functions having regard to efficiency, effectiveness and economy.
This Order adds Children’s Hearings Scotland (a new body created under the Children’s Hearings (Scotland) Act 2011) to the list of bodies in schedule 5 and removes the entries for Children’s Panels and Children’s Panel Advisory Committees.
