accession of Croatia to the European Union) has effect.</Text></P1para></P1></P1group><P1group RestrictStartDate="2013-07-01"><Title>Transitional Provision</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5" id="regulation-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>In this regulation—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/1/a" id="regulation-5-1-a"><Pnumber>a</Pnumber><P3para><Text>“<Term id="term-the-2000-regulations">the 2000 Regulations</Term>” means the European Communities (Lawyer's Practice) (Scotland) Regulations 2000; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/1/b" id="regulation-5-1-b"><Pnumber>b</Pnumber><P3para><Text>“<Term id="term-relevant-lawyer">relevant lawyer</Term>” means a European lawyer (as defined in regulation 2(1) of the 2000 Regulations as amended by these Regulations) who satisfies either or both of the conditions set out in paragraph (2).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>Those conditions are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/2/a" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/2/a" id="regulation-5-2-a"><Pnumber>a</Pnumber><P3para><Text>that the person is a national of Croatia;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/2/b" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/2/b" id="regulation-5-2-b"><Pnumber>b</Pnumber><P3para><Text>that the person is authorised in Croatia to pursue professional activities under any of the professional titles appearing in regulation 2(4) of the 2000 Regulations as it is amended by these Regulations, opposite the name of that State.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2013/177/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/ssi/2013/177/regulation/5/3" id="regulation-5-3"><Pnumber>3</Pnumber><P2para><Text>Regulation 1(2) to (5) of the 2000 Regulations applies to a relevant lawyer with the following modifications—</Text><P3 Regulations)</Emphasis></Text></P><P><BlockText><Para><Text>These Regulations make amendments in consequence of the Treaty concerning the accession of the Republic of Croatia to the European Union, signed at Brussels on 9th December 2011 (<Acronym Expansion="Official Journal">OJ</Acronym> No L 112, 24.04.2012).</Text></Para></BlockText></P><P><BlockText><Para><Text><Strong>Regulation 2</Strong></Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 2 implements the adaptations to Article 1(2) of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1977/0249" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1977" Number="249">77/249/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation> of 22 March 1977 to facilitate the effective exercise by lawyers of freedom to provide services (OJ No L 78, 26.03.77, p.17-18) made by Council Directive.</Text></Para></BlockText></P><P><BlockText><Para><Text>It amends the definition of  “European lawyer” in the European Communities (Services of Lawyers) Order 1978 (“<Term>the 1978 Order</Term>”) to include a reference to Croatia and the national designations of lawyers in that country. The effect of the amendment is to confer certain rights to practise on a temporary basis as a lawyer on lawyers professionally qualified in Croatia.</Text></Para></BlockText></P><P><BlockText><Para><Text><Strong>Regulations 3 and 5</Strong></Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 3 implements the adaptations to Article 1(2) of Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1998/0005" id="c00002" Class="EuropeanUnionDirective" Year="1998" Number="5">98/5/<Acronym Expansion="European Community">EC</Acronym></Citation> of the European Parliament and of the Council of 16 February 1998 to facilitate practise of the profession of lawyer on a permanent basis in a Member State other than that in which the qualification was obtained (OJ No L 77, 14.03.98, p.36-43), made by Council Directive.</Text></Para></BlockText></P><P><BlockText><Para><Text>It amends the definition of  “European lawyer” in the European Communities (Lawyer's Practice) (Scotland) Regulations 2000 (the  “<Term>2000 Regulations</Term>”) to include a reference to Croatia and the national designations of lawyers in that country. The effect of the amendment is to confer certain rights to practise on a permanent basis as a lawyer on persons who are nationals of an <Acronym Expansion="European Union">EU</Acronym> or EEA State or Switzerland and who are authorised to practise in Croatia, and nationals of Croatia who are authorised to practise in one of those States.</Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 5 makes transitional provision as to the application of the 2000 Regulations as amended by regulation 3.</Text></Para></BlockText></P><P><BlockText><Para><Text><Strong>Regulation 4</Strong></Text></Para></BlockText></P><P><BlockText><Para><Text>Regulation 4 gives effect to the further amendments made to primary and secondary legislation by the Schedule. Those amendments are made so as to ensure that certain definitions of  “EEA State” which are used will incorporate a reference to Croatia following its accession to the European Union.</Text></Para></BlockText></P><P><BlockText><Para><Text>No business and regulatory impact assessment has been prepared for these Regulations as no impact upon business, charities or voluntary bodies is foreseen.</Text></Para></BlockText></P></ExplanatoryNotes></Secondary><Commentaries><Commentary id="c21800141" Type="M"><Para><Text><Citation URI="http://www.legislation.gov.uk/id/ukpga/1972/68" id="c00003" Year="1972" Class="UnitedKingdomPublicGeneralAct" Number="68">1972 c.68</Citation>.
