The Scottish Ministers make the following Order in exercise of the powers conferred by section 32(3) and (4)(b) of the Certification of Death (Scotland) Act 2011(1).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Certification of Death (Scotland) Act 2011 (Commencement No. 1) Order 2013 and comes into force on 8th June 2013.

(2) In this Order, “the Act” means the Certification of Death (Scotland) Act 2011.

Appointed day

2.  The day appointed for the coming into force of the provisions of the Act specified in column 1 of the Schedule (the subject matter of which is described in column 2 of the Schedule) is 8th June 2013, but where a purpose is specified in column 3 of the Schedule in relation to a provision, that provision comes into force on 8th June 2013 for that purpose only.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 8th June 2013, sections 1(3), 20, 26, 27 and 31 of, and schedule 1 to, the Certification of Death (Scotland) Act 2011 (“the Act”) for all purposes, and section 1(1) and (2) for the limited purpose of enabling medical reviewers, and the senior medical reviewer, to exercise functions under sections 20 and 21 of the Act. Sections 21 and 22 are also commenced for the purposes of section 20 only.

The Act received Royal Assent on 20th April 2011. Sections 28, 29 and 32 came into force the following day.
